About this file

This is a Vendor Questions and Answers document for Solicitation No. 69056726Q000034 concerning Post-Construction Environmental Compliance Monitoring Services for the OR FLAP GRANT 24(2), Granite Hill Road Reconstruction, Phase II project.

The document addresses seven technical questions raised by potential vendors regarding contract scope, pricing, and implementation. Key issues discussed include: the unpredictable nature of maintenance work under Task 1 due to variable weather and site conditions, with the government confirming assumptions for maintenance align with Task 5 and will be addressed in an upcoming amendment; confirmation that contractors are not required to include costs for major repairs, replacement, reconstruction, significant sediment removal, or work requiring specialized equipment in their base bids; clarification that turbidity monitoring and corrective actions under Task 3 will follow the same assumptions as maintenance and corrective action tasks and be addressed in an upcoming amendment; sediment removal under Task 4 to be performed with hand tools only during site inspections with flexibility for disposal within the project area; confirmation that work exceeding Task 5 limitations requires notification to the Technical Point of Contact to request modification determination, though the government does not guarantee modification approval; Task 8 documentation requirements limited to post-construction phase records and inspections conducted under this contract only; and inspection start timing confirmed for November of 2026 with completion by November 30, 2027, following an inactive period through September 25. All answers are dated August 25-31, 2026.

VENDOR QUESTIONS AND ANSWERS

Solicitation No.: 69056726Q000034

Project Name:

# General Technical Question Answer Date

1 X

The maintenance required under Task 1 presents a significant pricing challenge because the level of effort will depend on unpredictable weather and site conditions. If additional work is required, will that work be addressed under Task 5?

Because the quantity and severity of potential deficiencies cannot reasonably be determined before award, this requirement could involve substantial and unpredictable work, including replacing failed measures, repairing erosion damage, removing accumulated sediment, installing additional controls, or correcting pre-existing noncompliant conditions. These costs cannot reliably be included in a competitively bid lump-sum price.

Would WFLHD consider revising this work to an “Each” bid item so the Contractor can bill for each event as it occurs? The anticipated number and extent of these events cannot reasonably be predicted.

The assumptions for maintenance under Task 1 are the same as those for Task 5. Will be addressed in an upcoming amendment.

2 X

Please confirm that the Contractor is not required to include costs in its base bid for major repairs;

replacement or reconstruction of controls; significant sediment removal; extensive erosion repair; or work requiring machinery or specialized equipment.

Task 5 specifically states "This statement of work does not cover more extensive repairs or use of specialized equipment." See also the response to Question #1

Task 3 states “If turbidity exceeds 25 NTU or higher, notify TPOC immediately. Take immediate action to address cause of exceedance. Continue to monitor until the stormwater discharge is measured at less than 25

NTU.”

This requirement cannot reasonably be priced as a lump-sum item because the number, duration, and severity of potential turbidity exceedance events are unknown.

Would WFLHD consider establishing a separate bid item with an estimated quantity for each turbidity-monitoring or corrective-action event

Alternatively, could the requirement be revised to state:

“Notify the TPOC, and a contract modification will be issued if corrective action is required”?

Use the same assumptions as the maintenance and corrective actions under Tasks 1 and 5. Will be addressed in an upcoming amendment.

4 X

Task 4 – Sediment Removal: Please provide an estimated quantity of sediment or soil to be removed under Task 4 so the Contractor can determine and price the anticipated level of effort. As currently written, the quantity of material, removal effort, and disposal requirements are undefined, making the task difficult to price competitively.

This is not possible to provide. Based on the assumption of maintenance and corrective action being completed during the day of the site inspection with hand tools only, then this uncertainty can be addressed.

Disposal of sediment should be outside of riparian areas and surface waters, but can be redistributed in the project area.

5 X

Task 5 – Work Exceeding the Stated Limitation: Please confirm that corrective work exceeding the Task 5 limitation will require separate written authorization and will be compensated through a contract modification/change order. Clearly defining the level of effort included in the base task, with additional work handled by modification, will allow bidders to price the base requirement consistently.

The SOW specifically states If damage or failure is found which is so extensive that it cannot be repaired as stated above, immediately notify the TPOC to request a determination regarding a modification to increase the scope.. It does not state that we will modify.

6 X

Task 8 – Complete ESCP: Does the “complete ESCP of record” required under Task 8 include documentation from both the original construction phase and the post-construction stabilization phase, or only the post-construction stabilization work performed under this contract?

This task is to provide any records that are done as part of the post-construction phase and documenting inspections and maintenance done as part of this contract.

I see the inactive period goes till September 25th and inspections stop November 30th 2027. What is the government's expectation for a starting month for inspections?

The inspections will start in November of this year. 31-Aug-2026
