SOLICITATION PROVISIONS

Representations, Certifications and Other Statements of Bidders

The bidder makes the following representations and certifications as a part of its bid.

52.204-8 Annual Representations and Certifications. (MAR 2023) [DEVIATION JAN 2024]

(a) (1) The North American Industry Classification System (NAICS) code for this acquisition is NAICS 237310 – Highway, Street & Bridge Construction.

(2) The small business size standard is $45 million.

(3) The small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition—

(i) Is set aside for small business and has a value above the simplified acquisition threshold;

(ii) Uses the HUBZone price evaluation preference regardless of dollar value, unless the offeror waives the price evaluation preference; or

(iii) Is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.

(b)

(1) If the provision at 52.204-7, System for Award Management, is included in this solicitation, paragraph

(d) of this provision applies.

BRIDGE CONSTRUCTION

Section 575. — MINOR BRIDGE WORK

(ADDED SECTION)

Description

575.01 This work consists of furnishing materials, placing, and constructing minor bridge repair work. This work includes removal of the existing asphalt concrete pavement and repair of the existing timber decking when required.

Material

575.02 Conform to the following Subsections:

Construction Requirements

575.03 Asphalt Concrete Pavement Removal. Remove existing asphalt concrete pavement (estimated average thickness is 2-inches) and all other foreign substances present down to the original level of the timber deck surface by approved methods ensuring no damage to the existing timber deck. Remove traces of overlay materials from the faces of the timber curbs up to the level of the new surfacing. Remove dust and loose material from the deck with compressed air or with vacuum equipment and provide a smooth surface for the new asphalt concrete pavement.

If timber decking is damaged during existing asphalt concrete pavement removal, notify the CO and do not commence with further removal until approved. Submit a plan to the CO to repair the damage, and do not begin repair work until the plan is approved. Provide repair materials that match the existing decking. Repair any damage to the timber decking caused during existing asphalt concrete pavement removal at the expense of the contractor.

Special Contract Requirements Project: MT BIGHORN 46(1), Warman Loop Road

After removal of the asphalt concrete pavement, coordinate with the CO to determine if any areas of the deck need repair or replacement before placement of the new asphalt concrete pavement. If areas of repair or replacement are identified, submit a plan to the CO to complete this work.

Provide repair or replacement materials that match the existing decking. Do not begin work until the plan is approved.

Dispose of all removed materials according to Subsection 203.05.

575.04 Asphalt Concrete Pavement Placement. Do not place new asphalt concrete pavement until all repairs identified in Subsection 575.03 are complete and approved by the CO approves the receiving surfaces. Place asphalt concrete pavement in accordance with Section 401. Do not use vibratory rollers on the bridge. Compact asphalt concrete pavement with alternative equipment according to Subsection 401.14. Do not damage existing timber curb to remain in place. If damaged, replace as approved by the CO at no cost to the Government. Plug curb scupper openings to prevent asphalt concrete pavement from filling openings and preventing deck drainage. Remove plug material after completion of paving operations.

575.05 Acceptance. Minor bridge work will be evaluated under Subsections 106.02 and 106.04.

Construction and material for timber decking repair will be evaluated under Subsection 557.20.

Measurement

575.06 Measure Section 575 items listed in the bid schedule according to Subsection 109.02.

Payment

575.07. The accepted quantities will be paid at the contract price per unit of measurement for the Section 575 pay items listed in the bid schedule. Payment will be full compensation for the work prescribed in this Section. See Subsection 109.05.

Payment for lump sum pay items will be prorated based on the certified cost breakdown and the work completed.
