OR DETROIT 2016(1)
Detroit Area Visitor Portal, Bikeway and Day Use Enhancements
# General Technical Question Answer Date
1 X
SCR Subsection 107.10(e) references hazardous material investigation reports performed for this project. I’ve reviewed the reports, and there still seems to be some significant unknown related to the hazardous materials at the Visitor Portal Area (old school). The final phase one concludes there’s still a small amount of residual heating oil contamination at the site, and that some of the soil removed from some of the excavations may be contaminated due to the heating oil as well as other materials. Although a subsequent lead testing report was conducted to show that lead levels in the soil are not a concern and that the lead levels qualify the soil as “clean,” no other testing was done regarding other hazardous materials that are/may be present at the site. The phase one report also discusses testing, construction design/planning, and disposal options to consider when hazardous materials are encountered. However, it does not appear that any of these recommendations have been incorporated in the contract documents. In recent years, the Oregon Department of Transportation has developed very specific procedures, plans, and methods of compensation in their contracts to deal with unknown situations like this. We view this situation with the unknown quantity of hazardous materials, as well as the unknown process for dealing with these materials as an issue that will affect the contract in terms of time and money; it could possibly increase time and money significantly. Thus, how should we bid these unknowns?
Bid according to the information provided and the contract requirements.
