DEFINITIONS:

The following definitions are used throughout the bid:

Actuarial Risk Assessment:
An empirically-validated tool that focuses primarily on static (unchangeable) factors that influence recidivism, in which the offender’s particular characteristics are inventoried and the offender’s risk is determined by the extent to which the offender possesses various risk factors associated with recidivism, such as the Static-99R.
Agent of Record (AOR):
The Probation and Parole Agent assigned to supervise an offender under community supervision.
Alternative to Revocation (ATR):
A comprehensive set of planned and organized therapeutic experiences and interventions, which are intended to address a specific criminogenic need associated with violation behavior.
Anti-Social Cognition:

(Criminal Associates and Peers; Cognitive Behavioral; Criminal Opportunity; Social Isolation; Social Adjustment Problems; Socialization Failure; Social Environment).
Anti-Social Companions:
Programs targeting this specific criminogenic need seek to reduce association with offenders and enhance contact with pro-social peer associations. (Criminal Associates and Peers; Cognitive Behavioral; Criminal Opportunity; Social Isolation; Social Adjustment Problems; Socialization Failure; Social Environment).
Anti-Social Personality or Temperament:
Programs targeting this specific criminogenic need seek to build problem solving, self-management, anger management, and coping skills. (Criminal personality; Criminal Opportunity, Cognitive Behavioral; Social Isolation; Socialization Failure; Social Adjustment Problems; Anger).
ARMIDILO-S:
The Assessment of Risk and Manageability of Individuals with Developmental and Intellectual Limitations who Offend - Sexually (ARMIDILO-S) is an instrument designed specifically for use with individuals with a borderline or mild intellectual impairment, with or without learning disabilities, who have offended sexually or have displayed sexually offensive behavior.

Bidder:
Firm submitting a bid in response to this Request for Bid.
Case Plan:
Identified and ranked goals and objectives and resources agreed upon by the offender, the program provider and the DOC agent to be utilized in facilitation of the offender’s successful program completion.
Cognitive-Behavioral Program:
An evidence-based program that teaches specific strategies or techniques to enable offenders to (1) identify the specific thoughts that support criminal behavior (self-observation); (2) recognize the pattern and consequences of thinking; (3) utilize reasoning, problem solving, self-talk, and social interaction skills as a means of controlling and changing thinking; (4) recognize and evaluate potential choices and make a conscious decision to change or not to change a behavior. This program combines two types of cognitive interventions: cognitive restructuring (changing the thinking patterns, attitudes, and beliefs that lead persons to offend) and cognitive skills training (learning and practicing reasoning, problem solving, and social skills).

DOC program area person responsible for implementing and monitoring the Contract for compliance.
Contract Staff:
Includes all employees, interns, subcontractors, temporary employees, and volunteers.
Contractor:
Successful vendor awarded the Contract.
Corrections Offender Management Profiling for Alternative Sanctions Assessment (COMPAS):
An actuarial assessment tool that has been validated on a national population of adults. This means that it predicts the general likelihood that those with a similar history of offending are either less likely or more likely to commit another crime generally within the two year period following release from custody. The COMPAS assessment does not, however, attempt to predict specifically the likelihood that an individual offender will commit a certain type of offense within the same two year period. In addition to identifying general levels of risk to re-offend, COMPAS also identifies criminogenic needs specific to the offender that are most likely to affect future criminal behavior. For purposes of Evidence-based Sentencing, actuarial assessment tools are especially relevant to identify offenders who should be targeted for interventions.
Criminogenic Needs:
Aspects defined by a risk assessment that are identified as an area of risk for re-offending due to criminal/problematic areas in an offender’s life.

1.0 INTRODUCTION, PURPOSE, AND SCOPE

1.1 PURPOSE OF THIS REQUEST FOR BID

The Department of Corrections (DOC), Division of Community Corrections (DCC) requests bids for the purchase of secular, non-residential Sex Offender Treatment (SOT) Services in multiple DCC Regions in Wisconsin. Appendix 1 is a map of Wisconsin identifying the eight (8) DCC Region locations.

The scope of this Request for Bid (RFB) is to solicit pricing for SOT Services that meet the Wisconsin DOC Sex Offender Service Standards (Appendix 2). The program must provide sex offender treatment to male and female offenders convicted in adult court and under the supervision of the Wisconsin DOC.

The Corrections Program Checklist (CPC) is used by the Department to evaluate and assist programs in obtaining alignment with Evidence Based Practices. Appendix 3 is included to assist bidders in understanding this concept and its role in helping the Department move its staff and Contractors together towards the main goal of the Wisconsin DOC – excellence in correctional practices while fostering safety for victims and communities.

DOC intends to make one award per bid location. Bidders can respond to one or multiple bid locations, but must submit a price for each listed service (bid item) to be eligible for award at that bid location. Bidders may be awarded one or more bid locations.

The bid locations on the Cost Sheet (Exhibit I) request services from the following service provision categories:

1. Services provided by a Lead Facilitator(s) at a DCC provided location.

2. Services provided by a Lead Facilitator(s) at a contractor provided location.

3. Services provided by a Lead Facilitator and Co-facilitator at a DCC provided location.

4. Services provided by a Lead Facilitator and Co-facilitator at a contractor provided location.

5. Telehealth services provided with the use of two or more DCC provided locations, staff and telehealth equipment (Region 5 and Region 8).

6. Telehealth services provided with contractor owned telehealth equipment from a contractor provided location. Offenders receive services at one or more DCC provided location(s) with DOC owned telehealth equipment (Region 5, Region 8 and Statewide).

During the term of the resulting contract, DOC may request that the contractor(s) increase the Sex Offender Treatment services available to an area(s) outside the cities listed in this RFB. If the contractor agrees to provide the possible expansion of Sex Offender Treatment services, then the per group rate, per assessment rate, and individual session rate for these additional Sex Offender Treatment services will be contracted at the same rates as the awarded city/ies. However, bidders shall not expect that the DOC will request to expand the Sex Offender Treatment services specified in this RFB.

On some Cost Sheets, the bid location services are provided at a DCC office. Informational pricing is requested at some of these bid locations to identify the cost for services provided at a bidder provided site. During the term of the resulting contract, DCC office space may not be adequate for offender service needs. Bid location contracts may be amended to allow for services to be provided at a contractor provided site(s) in the City noted on the bid locations cost sheet.

Other DCC Regions, DOC Divisions and State agencies may use the resulting Contract, if agreeable to both the DOC and the vendor, to obtain the benefits of volume purchases and/or reduction in administrative expenses.

1.1.1 Program Goals

The treatment provided through this contract is intended to assist the offender in identifying and addressing individual risk and need areas, with the ultimate goal of reducing overall recidivism risk. Effective management of sex offender cases requires the cooperative efforts of qualified clinicians and knowledgeable Corrections’ professionals. Regular contact and ongoing communication between the agent and treatment contractor is essential.

The goals of sex offender treatment services are as follows:

1. To assess the level of risk for re-offense presented by sex offenders supervised by the DOC

3. To provide offender accountability and community protection

4. To reduce risk factors identified during (re)evaluation; completion of re-offense prevention plan; and completion of all required tasks identified in curriculum

5. To educate the offender on appropriate sexual behavior and/or outlets

6. To provide assistance to DOC staff in providing community education and/or training to enhance the DOC’s ability to supervise sex offenders

1.1.2 Target Population

DOC staff will refer male or female offenders that are under the supervision of the DOC for SOT services.

Priority placement shall be given to male offenders who are medium to high risk to re-offend based upon the applicable risk needs assessment and female offenders with significant criminogenic needs.

1. Youthful offenders

2. Child pornography offenders

3. Offenders with a serious mental illness

4. Offenders with adaptive deficits

1.2 CONTRACT TERM

The Contract term will be for one (1) year, with options to renew for four (4) additional one (1) year terms. Contracts will be reviewed by the DOC before a decision is made. Any renewal(s) must be authorized by mutual written agreement of the vendor and DOC.

1.3 contract documents In the event of a contract award, the contents of this RFB (including all attachments), RFB addendums, the bid submittal, and additional written terms agreed to in writing by the parties shall become part of the contract. Failure of the successful bidder to accept these as part of the contractual agreement may result in a cancellation of award.

The following priority for contract documents will be used if there are conflicts or disputes:

1.3.1 Official Purchase Order including:

2. Supplemental Terms and Conditions (Form DOA-3681)

The State shall be the sole judge as to compliance with the instructions contained in this RFB.

3.3

BID REVIEW

Bids will be reviewed by the DOC's Procurement Manager and DOC Contract Administrators to verify that all specified requirements have been met. Prior to award, DOC may consider results of past awards to the bidder by the State of Wisconsin.

Failure to meet a mandatory requirement shall disqualify the bid.

If no bidder is able to comply with a given specification, condition of bid or provide a specific Cost Sheet item, the Procurement Manager reserves the right to delete that specification, condition of bid or item.

3.4 METHOD OF AWARD

DOC intends to make one (1) award to the lowest responsive, responsible bidder(s), who meet all mandatory requirements for each bid location. Informational pricing is requested for some bid locations. The informational pricing is not included in the combined bid total for bid award. Awards will be made by one of the following methods, in the following order:

3.4.1 For bid locations that require English speaking services, awards will be based on the lowest combined bid total for that location.

3.4.2 For bid locations that require English and Spanish speaking services, awards will be based on the lowest English speaking and Spanish speaking/translated combined bid total for that location. Informational pricing is not included in the combined bid total.

If no bids are received for required Spanish speaking/translated services at a location, awards will be based on the lowest English speaking combined bid total at that location.

3.4.3 Telehealth services bid for DCC Region 5 or 8 (bid locations 37–40) will be awarded to the lowest combined bid total for that region. Primary and secondary contractors may be awarded within a Region. The same price for each service shall be invoiced for all telehealth services within the bid location. Wisconsin DHS telehealth certification is not required at time of award, but required prior to providing services. At a minimum, services may be implemented at the locations in the DCC Region without awarded in person SOT service contracts.

3.4.4 Telehealth services bid Statewide (bid location 41) will be awarded to the lowest combined bid total. The same price for each service shall be invoiced for all telehealth services statewide. Wisconsin DHS telehealth certification is not required at time of award, but required prior to providing services. Services may be implemented at bid locations, or expanded to other DCC locations without an in person service contract.

3.4.5 DOC reserves the right to make secondary and subsequent awards at each bid location to ensure that operational needs are met and services are provided in a timely manner. It is DOCs goal to avoid offenders being on “waiting lists” to receive services. If the primary awarded contractor is unable to provide the volume of services required, DOC reserves the right to obtain these services from the secondary or subsequent bidders. If the location has no secondary or subsequent bidders to provide in person services, telehealth contractor service referrals may be implemented. During the contract term, more than one (1) contractor may be providing services for a bid location.

The DOC reserves the right to accept or reject any and all bids in whole or in part. DOC also reserves the right to reject bids that exceed available funding for the services requested in this RFB.
