About this file
Summary
This document is a General Terms and Conditions Acknowledgment Form for the Bergen County Utilities Authority (BCUA) establishing mandatory procurement requirements applicable to all solicitations issued through the BCUA procurement portal. The form applies to a Request for Pre-Qualification (RFPQ) for Financial Professional Services for the Bergen County Utilities Authority in New Jersey. The contract term is two years unless otherwise noted in the specifications, with continuation contingent upon availability of funds in the following year's budget. The BCUA reserves the right to award contracts in whole or in part to the lowest responsible bidder meeting specifications, to award each item separately, or to make awards based on total bid price at the authority's discretion. Bidders must carefully examine all contract documents and site conditions prior to submission and are expected to attend any pre-bid conferences noted in the Notice to Bidders. The document does not specify quantities, response dates, or award dates, as these are to be detailed in solicitation-specific documents.
The pricing structure is established as a firm fixed contract with prices firm and FOB to the BCUA's locations, with no price escalation authorized without written confirmation from the contracting agent. Payment is contingent upon proper execution and approval of an Owner's voucher by the local unit governing body at a subsequent regular meeting, and the BCUA will not pay penalties or interest on overdue bills. Bidders must submit bid security in the form of a certified check, cashier's check, or bid bond equal to ten percent of the total bid price (not to exceed $20,000) and a Consent of Surety certificate confirming performance bond availability. Successful bidders must provide a performance bond equal to 100 percent of the awarded contract amount. The BCUA requires compliance with New Jersey prevailing wage requirements if applicable based on the contract threshold ($16,263 for municipal government as of July 1, 2019), EEO/Affirmative Action regulations, the New Jersey Right to Know Act, HIPAA compliance (if applicable), and the Americans with Disabilities Act. Contractors must obtain workers' compensation insurance, comprehensive general liability insurance of at least $1,000,000 combined single limit, and comprehensive general automobile liability insurance of at least $1,000,000 combined single limit, all naming BCUA as an additional insured with 30 days' notice of cancellation provisions.

The contractor's cost for developing the value engineering construction proposal shall not be eligible for reimbursement by the contracting unit.
III. The contractor shall be liable for all reasonable costs incurred by the contracting unit for the technical evaluation and engineering review of a value engineering construction proposal presented by the contractor.
IV.
