About this file

This is a Certification of Noninvolvement in Prohibited Activities in Russia or Belarus form issued by the State of New Jersey, applicable to vendors seeking to enter into or renew contracts with state agencies. The certification, revised January 22, 2024, implements N.J.S.A. 52:32-60.1, et seq. (L. 2022, c. 3) and requires all vendors providing goods, services, or purchasing bonds or other obligations to certify their status against the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list. Vendors must complete the form by checking one of three boxes: confirming they are not identified on the OFAC list for Russia and/or Belarus-related activity; stating they cannot confirm this status because they are identified on the list for such activity; or confirming they are listed but engaged in activities consistent with federal law, regulation, licenses, or exemptions, with detailed explanations required for the third option.

The form requires vendors to provide comprehensive identifying information including legal name, Federal Employer Identification Number (FEIN), contact details, business address, and authorization for a designated representative to sign. The Department of the Treasury is empowered to enforce compliance through sanctions, debarment, suspension, recovery of damages, and declaration of default for vendors making false certifications. The certification applies broadly to any natural person, corporation, partnership, limited liability entity, business association, sole proprietorship, joint venture, trust, governmental entity, or multilateral development institution, as well as any parent, subsidiary, or entity under common ownership or control with such entities.
