The form is required for all vendors submitting proposals or contracts to Los Fresnos C.I.S.D., regardless of whether interested parties exist. Vendors must electronically complete, print, and sign Form 1295 through the Texas Ethics Commission website, obtain a certification number, and submit the completed form with their proposal response or at the time of contract execution. The instructions provide vendors with a step-by-step process: accessing the Ethics Commission website at https://www.ethics.state.tx.us/whatsnew/elf_info_form1295.htm, registering and completing the form online with the proposal number and contract or RFP name, printing the certified copy, and including it with the proposal.
The document defines key terms essential to Form 1295 compliance, including "business entity" (any entity conducting business with the district, excluding governmental entities), "controlling interest" (ownership exceeding ten percent, board membership, or officer status), and "interested party" (persons with controlling interest or intermediaries who facilitate contracts). An intermediary is defined as a person who actively participates in contract facilitation, receives compensation, communicates directly with the district, and is not an employee of the business entity. The form applies to all contracts except those exempt under specific categories, including sponsored research contracts, interagency contracts, certain health and human services contracts, contracts with publicly traded entities, and contracts with electric or gas utilities. The document references supplementary resources including frequently asked questions and instructional videos to assist first-time users.
