About this file
This is a Supplementary General Conditions document for a state and local contract opportunity issued by the Texas Workforce Commission (TWC) for HVAC Energy Recovery Ventilator, ceiling tiles, flooring tiles, and ductwork modifications at the TWC Mopac Building located at 12312 North MoPac Expressway, Austin, Texas. The document establishes contractual requirements and conditions that govern the contractor's obligations and performance standards throughout the contract term. Key provisions address insurance requirements and project performance accountability measures that contractors must comply with during execution of the work.
The contractor is required to obtain and maintain umbrella liability insurance during the contract term in an amount equal to one hundred percent (100%) of the total awarded contract sum, including any selected alternate pricing amounts. The umbrella policy must provide coverage at least as broad as primary liability coverages and include "drop down" coverage provisions where underlying primary insurance coverage limits are insufficient or exhausted. Additionally, liquidated damages have been established at $660.00 per calendar day, which represents the predetermined daily penalty assessed for contractor non-performance or project delays. This financial accountability measure protects the TWC by establishing a clear cost for each day of contract non-compliance.
