About this file
This file contains sample bond templates for the City of Amarillo, Texas, specifically designed for use in municipal construction contracts. The document provides three standardized bond forms: a Maintenance Bond (General Contract), a Payment Bond, and a Performance Bond. These templates are intended to be completed by contractors and their surety companies to guarantee contract performance and compliance. The Maintenance Bond requires the principal contractor to guarantee work against defects in materials or workmanship for a specified period following project acceptance, with the surety obligated to correct defects within thirty calendar days of written notification or reimburse the city for correction costs, including engineering and legal expenses. The Payment Bond ensures that the principal contractor will pay all claimants supplying labor and materials for the contracted work, executed pursuant to Chapter 2253 of the Texas Government Code. The Performance Bond guarantees faithful performance of work in accordance with plans, specifications, and contract documents, also governed by Chapter 2253 of the Texas Government Code.
All three bond forms establish joint and several liability between the principal contractor and the surety company, with exclusive venue for legal actions established in Potter County, Texas. The bonds are executed without predetermined effective dates, as indicated by the instruction "DO NOT DATE THE BOND" appearing on each template. The surety company must be authorized to conduct surety business in the State of Texas, and all bonds require signature and seal attestation from authorized representatives of both the principal contractor and the surety. These sample bonds would be applicable to the City of Amarillo's Storm Drain Improvements project at SW 45th Avenue and S. Lamar Street, ensuring contractor accountability and financial protection for the municipality throughout the project lifecycle and any applicable warranty periods.
