About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the Department of Veterans Affairs, VISN 10, Dayton Ohio Medical Center. The sole source procurement is for a firm-fixed-price contract to upgrade and modernize the Paralleling Switchgear in Building 330, specifically to replace outdated electrical system components that ensure emergency power reliability for the inpatient tower. The total estimated value of the Russelectric Brand Name items is $258,000.

The contract will be awarded to Russelectric, A Siemens Business, which is the proprietary developer of the paralleling switchgear system used by the Dayton VA Medical Center. The unique requirements include removing and replacing existing GE Fanuc 90-30 series PLC hardware with Rx3i PLC hardware, installing new Wonderware software for the Operator Interface Panel, and providing associated installation and testing services. The justification emphasizes that Russelectric is the only vendor capable of performing the integration without risking system performance and patient safety, and the procurement is being conducted under the statutory authority of "Only One Responsible Source" per FAR 6.302-1.

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID:__________________________

1. Contracting Activity: Department of Veterans Affairs, VISN 10, Dayton Ohio Medical

Center, 4100 West Third St, Dayton, OH 45428.

The Contracting Agency responsible for the proposed contracting action is Network Contracting Office 10 (NCO 10), 2780 Airport Drive – Suite 340, Columbus, OH 43219.

Purchase Request Number: 552-25-4-6932-0019

2. Nature and/or Description of the Action Being Processed:

This action will be awarded as a new firm-fixed-price contract to address the upgrade and modernization of the Paralleling Switchgear in Building 330. The requirement is to replace outdated and inoperable components to ensure the reliability of the emergency power system that supports the inpatient tower.

The VAMC’s critical and life safety essential electrical systems rely on on-site electrical generation to support patient care functions during primary utility source failures (power outages). The on-site generation and utility service is connected via paralleling switchgear, an intelligent, integrated electrical system that allows multiple generators and electrical utility to energize a single bus. This system is proprietary and must be installed by a Russelectric employee.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The supplies/services required are the removal and replacement of the existing GE Fanuc 90-30 series PLC hardware with the latest Rx3i PLC hardware, new Wonderware software for the Operator Interface Panel (OIP), and associated installation and testing services. The estimated value of the Russelectric Brand Name items is $258,000.

4. Statutory Authority Permitting Other than Full and Open Competition:

(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The contractor, Russelectric, A Siemens Business, is uniquely qualified to provide the required upgrade as they are proprietary developers of the paralleling switchgear system used by the Dayton VA Medical Center. Russelectric's expertise in the replacement of GE Fanuc PLC hardware and integration with Siemens technology ensures continuity and reliability without risking substantial duplication of costs or unacceptable delays. Additionally, Russelectric’s familiarity with Caterpillar genset controls reinforces the necessity of their involvement.

Accordingly, Russelectric is the only firm capable of providing the supplies and services described without the Veteran’s Health Administration experiencing substantial duplication of cost and unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

No other vendors demonstrated the technical capability to perform the required integration of Russ Electric control systems specific to the needs outlined. This procurement has not been synopsized further as no other capable sources were identified.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

The Contracting Officer anticipates that bids will be received by two or more SDVOSBs for the Upgrade Parallel Switchgear project, and will determine the cost to be fair and reasonable based on a comparison with the Independent Government Cost Estimate (IGCE).

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

Market research was conducted in accordance with FAR Part 10. The research included a review of the inquiries to the industry, and a thorough analysis of past and current vendor capabilities. The findings confirm that Russelectric is the only vendor that can meet the specific technical requirements for this upgrade.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: The proprietary nature of the Russelectric system and its critical role in hospital operations necessitates the use of a specified vendor. The integration of parts and software specific to Russelectric's design does not lend itself to open competition without risking system performance and patient safety.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

• Russelectric, A Siemens Business
