VENDOR QUESTIONS:

Q1: Section 2.2.2 stated Proposals will not be opened publicly. However, information shared during Pre-Proposal stated otherwise. Will proposals be opened publicly?

A1: During the Pre-Proposal Conference, a statement was made indicating that the Financial Proposals would be publicly opened. The State hereby clarifies that this statement was incorrect.

As provided in the RFP, 2.2.2, there will be no public opening of Financial Proposals.

Financial Proposals will remain unopened until completion of the Technical Proposal evaluation and the determination of which proposals remain reasonably susceptible of being selected for award. Financial Proposals meeting the applicable requirements will then be opened in accordance with the Maryland Procurement Manual and applicable COMAR requirements.

The provisions of the RFP regarding the receipt, opening, evaluation, and handling of Financial Proposals remain unchanged and continue to govern this procurement.

Q2: Debriefing of unsuccessful offerors

A2: During the Pre-Proposal Conference, a statement was made indicating that a vendor debriefing would not be necessary for this procurement. The State hereby clarifies this statement.

In accordance with COMAR 21.05.03.06, an unsuccessful Offeror may submit a written request for a debriefing to the Procurement Officer within a reasonable time following notification of the procurement decision.

The RFP and applicable provisions of COMAR remain controlling with respect to debriefings of unsuccessful Offerors.

Q3: Waterfront work statement in section 1.4.1, is this an error?

A3: The State does not currently anticipate assigning waterfront work under this solicitation. The

August 14, 2026 referenced requirement is included for informational purposes to address the licensing requirements that would apply to the subcontractor performing the work should waterfront work be assigned as part of a future Work Order. The license requirement is not required of the prime contractor/offeror.

The inclusion of this provision should not be construed as an indication that waterfront work will be assigned or that any minimum amount of waterfront work is anticipated under the solicitation.
