About this file

This file contains Federal Acquisition Regulation (FAR) clause 52.232-18, which addresses the contingency of funds availability for government contracts. The clause stipulates that funds are not currently available for the subject contract and that the Government's obligation is conditional upon the appropriation and availability of funds from which payment can be made. No legal liability for payment will accrue to the Government until funds have been made available to the Contracting Officer and the Contractor has received written confirmation of such availability from the Contracting Officer.

This is a standard contractual provision included in solicitations when contracting officers anticipate potential funding constraints. It protects the Government by establishing that contract performance and payment obligations are dependent on future funding appropriations, rather than existing current funding. The clause applies to the Coast Guard District One solicitation (70Z02426Q000064) for 80 gym memberships at a fitness facility in Boston, Massachusetts, for assigned personnel at the John Foster Williams Building.

52.232-18 Availability of Funds.

As prescribed in 32.706-1(a), insert the following clause:

AVAILABILITY OF FUNDS (APR 1984)

Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
