About this file

This is a federal acquisition regulation (FAR) provision form requiring corporate representations regarding delinquent tax liability and felony convictions. The document implements FAR 52.209-11 as prescribed by sections 744 and 745 of the Consolidated and Further Continuing Appropriations Act, 2015, establishing mandatory disclosure requirements for corporate offerors.

The provision prohibits the government from contracting with corporations that have unpaid federal tax liabilities (where all remedies have been exhausted and payments are not current under an agreement) or that were convicted of felony violations under federal law within the preceding 24 months, unless the awarding agency has considered suspension or debarment and determined it unnecessary to protect government interests. Corporate offerors must represent whether they fall into either category by completing checkboxes and providing a principal's signature and date. This form relates to solicitation W911S625QA005 for preventative maintenance and repair services for autoclaves and glasswashers at the Army's BioTesting Division at Dugway Proving Ground.
