About this file

This document is an Emergency Procurement Form from the University of New Mexico (UNM) for the replacement of an engine that powers one of UNM's cogeneration machines used to generate power and heat for the university. The emergency condition is that the existing engine must be replaced immediately, as the inability to use the cogeneration machine would result in an additional annual cost of $1.25 million to the university for the purchase of external electrical power, and would also impair the university's ability to guarantee heat in the winter. UNM is procuring the replacement engine from the sole source vendor, Solar Turbines, at a total cost of $2.5 million. The emergency procurement was approved by the UNM Chief Procurement Officer.

The contract opportunity is a sole source contract with Souder, Miller & Associates (SMA) for design and construction phase engineering services for a water system improvements project for the Mora Mutual Water and Sewer Works Association (MW & SWA) in New Mexico. The project includes the installation of a new water supply well to replace the system's failed Well 3. SMA was chosen due to their intimate knowledge of the Mora MW & SWA water system and their ability to provide design, bidding, construction, and construction observation services. The contract is valued at $330,959.02 before tax, with an estimated tax amount of $21,581.18, and the project completion is estimated to be approximately 365 calendar days from contract execution.

Emergency Procurement Form

In rare situations, the Chief Procurement Officer may exempt a purchase from the competitive selection process when the purchase qualifies as an Emergency Procurement under NMSA 13-1-

127. An Emergency Procurement is defined as a serious threat to the functioning of government, the health and safety of any person or the preservation or protection of property. This threat would typically arise from floods, fires, epidemics, riots, acts of terrorism, equipment failures or similar events and includes the planning and preparing for an emergency response. The existence of the emergency condition creates an immediate and serious need for services, construction or items of tangible personal property that cannot be met through normal procurement methods.

An Emergency Procurement should not be used unless clearly necessary and justifiable. A

Department must obtain approval from the University’s Chief Procurement Officer in advance of an Emergency Procurement. Each Emergency Procurement form will be posted on the UNM

Sunshine Portal within 3 days.

The engine that powers one of UNM’s cogeneration machines to make power & heat for the university must be replaced. Solar Turbines is the only vendor that can do this. UNM has a replacement engine in line but must get a PO to the vendor soonest.

The inability to use this machine will incur an extra annual cost of $1.25M to the university for the purchase of external electrical power to make up for the lack of generation. It will also impair the university’s ability to guarantee heat in the winter due to the lack of the boiler attached to the exhaust of the engine.
