About this file

The provided document is an Emergency Procurement Form from the University of New Mexico's Utility Services Department. The emergency situation involves the failure of an engine that powers one of the university's cogeneration machines, which produces power and heat for the campus. Solar Turbines is the only vendor capable of replacing the engine, and the university must obtain a purchase order to the vendor as soon as possible. The inability to use the cogeneration machine will result in an additional annual cost of $1.25 million to purchase external electrical power and impair the university's ability to provide heat during the winter. The total estimated cost for the emergency procurement with Solar Turbines is $2,500,000.

The document also includes information about a related state and local contract opportunity for the Mora Mutual Water and Sewer Works Association in New Mexico. The association is seeking a sole source contract with Souder, Miller & Associates for design and construction phase engineering services for a water system improvements project, including the installation of a new water supply well. The contract is valued at $330,959.02 before tax, with an estimated tax amount of $21,581.18, and the project completion is estimated to be approximately 365 calendar days from contract execution.

Emergency Procurement Form

In rare situations, the Chief Procurement Officer may exempt a purchase from the competitive selection process when the purchase qualifies as an Emergency Procurement under NMSA 13-1-

127. An Emergency Procurement is defined as a serious threat to the functioning of government, the health and safety of any person or the preservation or protection of property. This threat would typically arise from floods, fires, epidemics, riots, acts of terrorism, equipment failures or similar events and includes the planning and preparing for an emergency response. The existence of the emergency condition creates an immediate and serious need for services, construction or items of tangible personal property that cannot be met through normal procurement methods.

An Emergency Procurement should not be used unless clearly necessary and justifiable. A

Department must obtain approval from the University’s Chief Procurement Officer in advance of an Emergency Procurement. Each Emergency Procurement form will be posted on the UNM

Sunshine Portal within 3 days.
