About this file
This is a New Mexico Resident Preference Information form applicable to state and local contract solicitations, specifically governing resident business contractor preferences for Gallup-McKinley County Schools' fence materials and installation contract. The form establishes the requirements and procedures for bidders and offerors to claim resident preference status under New Mexico Statutes 13-1-21 and 13-1-22. All bidders and offerors seeking to obtain a resident preference must submit a valid Resident Preference Certificate issued by the New Mexico Taxation and Revenue Department with their bid or proposal; failure to include this documentation will result in no preference being applied to the submission. The document defines four preference categories: Resident Business/Contractor, Resident Native American Business/Contractor, Resident Veteran Business/Contractor, and Native American Veteran Business/Contractor, with preferences taking effect as of January 1, 2012.
The form specifies that preferences are non-cumulative, meaning each bidder is entitled to only one preference category. For joint bids or proposals involving both resident and nonresident businesses, the resident business preference is reduced proportionally based on the percentage of contract work to be performed by the nonresident business, as determined by the dollar amount of goods or services provided. Bidders submitting joint proposals must complete a detailed breakdown identifying both resident and nonresident firm names, locations, work to be performed, and the percentage of total contract work attributable to each entity. Interested parties seeking additional information and applications for Resident Preferences should contact the New Mexico Taxation and Revenue Department or visit www.tax.newmexico.gov.
