CALCULATION OF LIQUIDATED DAMAGES

PROJECT # 1139374

REPLACE HVAC PACKAGE UNIT B140

Damages listed are for Civil Engineer and Contracting Squadrons. Pay tables A31-1/A32-1 for FY23.

Estimates received from 17 CES and 17 CONS are at the rates indicated in AFI 65-503, Cost Factors.

I. First Day of Liquidated Damages Calculations without Escorts:

1. CIVIL ENGINEER: Hours

a. Project Manager, GS-12 4 @ $75.33 X 1 Days = $301.32

b. Supervisory Engineer, GS-13 1 @ $92.14 X 1 Days = $92.14

2. CONTRACTING: Hours

a. Contract Administrator, GS-12 2 @ $75.33 X 1 Days = $150.66

b. Contracting Officer, GS-13 1 @ $92.14 X 1 Days = $92.14

c. Director Of Business Operations, GS-14 1 @ $111.29 X 1 Days = $111.29

3. JUDGE ADVOCATE:

a. Legal Review, GS-13 2 @ $92.14 X 1 Days = $184.28

TOTAL for First Day: $931.83

The liquidated damages in the amount of $931.83 for the first day of delay has been established.

This figure will be rounded to $932.00 for the first day of delay.

II. Second and subsequent days of liquidated damages calculations:

1. CIVIL ENGINEERS:

a. Project Manager, GS-12 1 @ $75.33 X 10 Days = $753.30

b. Supervisory Engineer, GS-13 0.4 @ $92.14 X 10 Days = $368.56

2. CONTRACTING:

a. Contracting Officer, GS-13 0.25 @ $92.14 X 10 Days = $230.35

b. Contract Administrator, GS-12 1 @ $75.33 X 10 Days $753.30

3. Site Visits and Administrative Daily @ $112.38 X 10 Days = $1,123.80 Expense considers inspection, administrative, & coordinating man-hours from non-specified positions; vehicle milage; equipment; and production loss

TOTAL for second and subsequent days $3,229.31 TOTAL Per Day/10 Calendar Days: $322.93

The liquidated damages in the amount of

$322.93 per day for the second and subsequent days of delay has been calculated by dividing the total above by 10 calendar days.

This figure will be rounded to $323.00 for the second and subsequent day(s) of delay.

III. The Liquidated Damages Rate for the first day $932.00 and for each additional day of delay. $323.00

IV. It is also determined that the contractor has control of the pace of work and the application of liquidated damages to this contract is permissible.
