About this file

The document is a Build America, Buy America (BABA) information packet from the Volusia County Community Assistance Department located in DeLand, Florida. The document provides detailed guidance on federal requirements for infrastructure projects funded through the Community Development Block Grant (CDBG), mandating that certain materials used in these projects must be produced in the United States. The BABA requirements are being implemented in phases from fiscal years 2023/24 to 2025/26, with different material categories becoming subject to the "Buy America Preference" (BAP) in each phase, starting with iron and steel in FY 2023/24 and expanding to include non-ferrous metals, lumber, and composite building materials in FY 2024/25, and then progressing to other materials like glass, fiber optic cables, and drywall in FY 2025/26.

The document includes two certification forms that contractors must complete: a pre-certification form before work begins and a final certification form upon project completion. These forms require contractors to specify which materials will be purchased for the project and whether those materials are produced in the United States. Contractors must also list all manufacturers planned or used and attach supporting documentation such as invoices and receipts. Volusia County will maintain these forms and supporting documentation for a minimum of five years for monitoring purposes. The requirements apply to a broad range of infrastructure projects, including rehabilitation of buildings, construction of public facilities, utilities, parks, roads, bridges, and broadband infrastructure, with the ultimate goal of supporting domestic manufacturing and infrastructure development.

Build America, Buy America (BABA) Information

What is Build America, Buy America (BABA)?

The Build America, Buy America Act (BABA) requires that all iron, steel, manufactured products, and construction materials used for federally funded infrastructure projects are produced in the United States, unless otherwise exempt or subject to an approved waiver. This requirement is known as the “Buy America Preference (BAP)”.

When does BABA apply to projects?

The Build America, Buy America Act (BABA) applies to all federally funded infrastructure projects. The Community Development Block Grant (CDBG) is a federal funding source and BABA would apply for all infrastructure project funded with CDBG. If additional funding sources are being used, the entire project must meet BABA requirements if any federal funding source is being utilized.

What is considered an infrastructure project?

The following are considered infrastructure projects according to BABA:

• Rehabilitation, maintenance, and reconstruction of buildings and real property, including housing

• Construction and repair of public facilities and improvements, such as water, sewer, or other utilities, parks, roads, bridges, sidewalks, homeless shelters, or broadband infrastructure

Do all materials have to be manufactured in the United States?

The U.S. Department of Housing and Urban Development (HUD) is requiring that BABA be met in phases to assist with the current transition. The phases are based on the year the funds were obligated. If you are unsure which fiscal year the funds were obligated for your project, reach out to the city you were awarded by or CDBG@volusia.org.

Obligated Fiscal Year Materials that must follow BABA

FY 2023/24 • Iron

• Steel

FY 2024/25

• Non-ferrous metals

• Lumber

• Plastic- and polymer-based composite building materials, pipes, and tubes

FY 2025/26

• All other plastic- and polymer-based products

• Glass

• Fiber optic cable

• Optical fiber

• Engineered wood

• Drywall

What information is required for BABA reporting?

For Community Development funded infrastructure projects, the following is required:

• BABA Certification form

• Supporting documentation to show that all required materials were produced in the United States o Invoices, receipts, etc.

The form to be completed by the contractor is subject to change as additional information is provided by HUD.

NOTE: Volusia County shall maintain this form and supporting documentation a minimum of five years in the project files for review during monitoring. The contractor must retain a copy of the reports in their files for a minimum of five years after completion of the project.
