Build America, Buy America (BABA) Information
What is Build America, Buy America (BABA)?
The Build America, Buy America Act (BABA) requires that all iron, steel, manufactured products, and construction materials used for federally funded infrastructure projects are produced in the United States, unless otherwise exempt or subject to an approved waiver. This requirement is known as the “Buy America Preference (BAP)”.
When does BABA apply to projects?
The Build America, Buy America Act (BABA) applies to all federally funded infrastructure projects. The Community Development Block Grant (CDBG) is a federal funding source and BABA would apply for all infrastructure project funded with CDBG. If additional funding sources are being used, the entire project must meet BABA requirements if any federal funding source is being utilized.
What is considered an infrastructure project?
The following are considered infrastructure projects according to BABA:
• Rehabilitation, maintenance, and reconstruction of buildings and real property, including housing
• Construction and repair of public facilities and improvements, such as water, sewer, or other utilities, parks, roads, bridges, sidewalks, homeless shelters, or broadband infrastructure
Do all materials have to be manufactured in the United States?
The U.S. Department of Housing and Urban Development (HUD) is requiring that BABA be met in phases to assist with the current transition. The phases are based on the year the funds were obligated. If you are unsure which fiscal year the funds were obligated for your project, reach out to the city you were awarded by or CDBG@volusia.org.

What information is required for BABA reporting?
For Community Development funded infrastructure projects, the following is required:
• BABA Certification form
• Supporting documentation to show that all required materials were produced in the United States o Invoices, receipts, etc.
The form to be completed by the contractor is subject to change as additional information is provided by HUD.
NOTE: Volusia County shall maintain this form and supporting documentation a minimum of five years in the project files for review during monitoring. The contractor must retain a copy of the reports in their files for a minimum of five years after completion of the project.

Build America, Buy America (BABA) Pre-Certification This document must be completed and returned from the primary contactor following the pre-construction meeting before work begins. An additional certification must be submitted once work has been completed before final payment will be dispersed. This document may be required from all sub-contractors as well.
