About this file
This is a certification form issued by the State of New Jersey pursuant to N.J.S.A. 52:32-60.1 (L. 2022, c. 3) for vendors seeking to enter into or renew contracts with New Jersey state agencies. The certification requirement applies to all vendors providing goods or services, or selling bonds or other obligations to the state. The form requires vendors to verify their status against the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons list and certify whether they are identified on that list due to activity related to Russia or Belarus. Vendors must select one of three certification options: confirming they are not identified on the OFAC list for Russia/Belarus-related activities, disclosing that they are identified on the list, or stating they are identified but their activities are consistent with federal law, regulation, licenses, or exemptions.
The form requires completion by an authorized representative of the vendor and mandates the submission of detailed contact information, including the vendor's Federal Employer Identification Number (FEIN), business address, telephone number, fax number, and email address. If a vendor cannot certify non-involvement due to OFAC listing, they must provide a detailed written explanation of how their Russia or Belarus-related activities comply with applicable federal law. The Department of the Treasury is authorized to take enforcement actions against vendors making false certifications, including imposing sanctions, seeking compliance, recovering damages, declaring default, or pursuing debarment or suspension. This certification applies broadly to any natural person, corporation, partnership, limited liability entity, governmental instrumentality, or any parent, subsidiary, or entity under common ownership or control with such entities.
