About this file

This is a Storm Water Pollution Prevention Plan (SWPPP) document for the City of Wichita, Kansas, prepared by MKEC Engineering, Inc., in coordination with the Kansas Department of Health and Environment (KDHE). The project involves the reconstruction of 21st Street North from Mosley Avenue to Interstate 135 in Wichita, with an anticipated start date of March 1, 2023, and completion date of March 31, 2024. The project encompasses 3.10 acres of total disturbance and includes removal of existing pavement, excavation and grading for new street pavement and sidewalks, installation of new storm sewers and water lines, and relocation of gas lines. The SWPPP outlines erosion control measures, best management practices (BMPs), and pollution prevention strategies to be implemented throughout the construction phases. Phase 1 construction will occur east of the Middle Fork Chisholm Creek bridge between the bridge and Interstate 135, while Phase 2 construction will occur west of the bridge between Mosley Avenue and the bridge. Excavation volumes total approximately 2,163 cubic yards across both phases, with anticipated excavation depths ranging from 0 to 8 feet below ground surface.

The project is located within an area impacted by petroleum hydrocarbon contamination associated with the former Coastal Derby Refinery. Previous environmental investigations conducted by GSI Engineering identified two soil boring samples exceeding KDHE Tier 2 screening levels for hydrocarbons. The soil management plan designates excavated materials as Type 1 (without visual free-phase petroleum hydrocarbons) or Type 2 (with petroleum saturation) and requires appropriate staging, testing, and disposal procedures in accordance with applicable Kansas regulations. All backfill material will consist of clean, geotechnically appropriate material obtained from off-site locations. The project received KDHE authorization on November 30, 2022, with Kansas Permit No. S-AR94-1800 and Federal Permit No. KSR121041, valid through July 31, 2027. Stormwater runoff will drain to the City of Wichita Municipal Separate Storm Sewer System (MS4) and ultimately to E Fork Chisholm Creek. The annual permit fee of $60.00 was submitted, and Kara Anderson, P.E., CFM, License No. 18596, is identified as the engineer responsible for SWPPP development.

Overview The City of Wichita (City) has contracted with MKEC Engineering, Inc. (MKEC) to design the reconstruction of 21st Street North between Mosley and I-135 in Wichita, Kansas. The activities that will occur as part of the construction of this design will consist of the following:

Removal of existing 21st Street pavement.

Excavation and grading for new street pavement and sidewalks.

Excavation and removal of existing storm sewers.

Excavation for the installation of new storm sewers.

Excavation for the installation of water lines.

Excavation of bore pits for the installation of water lines using trenchless methods.

Excavation for the relocation of gas lines at locations where gas lines conflict with proposed improvements.

The planned activities are located in an area known to be impacted by petroleum hydrocarbon contamination principally associated with the former Coastal Derby Refinery. The information included is intended to provide notice to the Kansas Department of Health & Environment (KDHE) that planned activities may result in the disturbance of petroleum-contaminated soils and provide KDHE with a description of the City’s soil management plan to be implemented during construction of the planned activities. All construction and excavation activities are planned to occur at a depth of 10 feet or less below the existing ground surface. The City does not plan to encounter groundwater at these depths based on previous groundwater depth measurements. Exhibit 1 is an overview map showing the location of the proposed construction with respect to the former Coastal Derby Refinery property.

Background In 2016, the City of Wichita removed portions of an existing reinforced box culvert and constructed a new bridge on 21st Street across the Middle Fork Chisholm Creek. The bridge is located at the southwest corner of the old Coastal Derby Refinery property. Construction activities for the improvements required soil excavation in areas known to be contaminated with hydrocarbons. In preparation for the excavation, the City and MKEC contracted with GSI Engineering (GSI) to perform subsurface explorations in 2014 and 2015 to determine the nature and extent of soil and groundwater contamination in the vicinity of the planned construction activities. Summaries of the investigative results are noted as follows:

2014 Investigation The GSI investigation concluded that with respect to volatile organic compounds (VOCs), no soil results exceeded the KDHE RSK soil pathway values, but did show that naphthalene was detected at levels exceeding the soil to groundwater RSK level for residential and non-residential soils. The GSI investigation indicated that total petroleum hydrocarbons (TPH) in both the gasoline range organics (GRO) and diesel range organics (DRO) were present in the soils at levels exceeding the residential RKS levels for the soil pathway. The GSI investigation also stated that none of the soils tested for RCRA metals had residential RSK exceedances.

2015 Investigation In 2015, a second investigation of the soils at the 21st Street Bridge replacement site was conducted by GSI. The focus of the investigation was shallow soils above the water table in areas that were going to be excavated under the revised bridge replacement approach. Five new borings were made. Borings 21A and 21B were located on the north side of 21st Street while borings 21C, 21D and 21E were made on the south side of 21st Street. The investigation revealed several shallow soil samples with minor TPH-DRO and TPH- GRO results had PID readings exceeding 100 parts per million (ppm) levels. No soil samples had metals

J:\Projects\2021\2101010455_COW_21st Street from Mosley to I-135\05 Civil\Docs\KDHE Soil Management Plan Letter\Proposed Soil Management Plan.docx Page 2 results exceeding KDHE’s Tier 2 standards. The soil sample collected at location B-21D from the depth of 8 to 10 feet had naphthalene at 1,430 µg/kg which exceeds the KDHE Tier 2 industrial soil to groundwater standard of 659 µg/kg and elevated levels of TPH-GRO (829 mg/kg) and TPH characterized as diesel fuel (7,350 mg/kg). The soil sample at B-21E from a depth of 8 to 10 feet, also had elevated Naphthalene (1,380 µg/kg), and TPH-GRO (106 mg/kg). No samples appeared to have results that would be indicative of a classification as hazardous waste.

Exhibit 2 is a record of correspondence between the City and KDHE outlining proposed soil handling efforts related to the planned 21st Street bridge construction. The exhibit consists of two letters prepared by the City with responses for each prepared by the KDHE.

In April 2020, EnviroAnalytics Group prepared a Soil Waste Management Plan for the purpose of establishing procedures for disturbance of existing contaminated soils within the former Coastal Derby Refinery property. The Kansas Department of Health & Environment (KDHE) approved the plan in May 2020. The plan established zones of soil management protocols based on the level of various soil contaminants found on site. Exhibit 3 is a copy of Figure 4-6 from the EnviroAnalytics report. This figure indicates that all soil in the first five feet of depth adjacent to the 21st Street public right-of-way was found to be soil having no specific soil management protocols due to known KDHE Tier 2 RSK non-residential soil pathway criteria exceedances.

For the purpose of constructing the 21st Street planned improvements, MKEC hired GSI in May of 2022 to conduct environmental borings at twenty separate locations along 21st Street within public right-of-way between the west side of the 21st and Mosley intersection to the west side of the 21st and Interstate 135 interchange. Borings were taken immediately north and south of the existing 21st Street pavement within this corridor. Boring locations were evenly spaced throughout the corridor and three samples from discrete depth intervals in each boring were analyzed for a total of 60 samples submitted for analysis. All planned activities will occur within the depth ranges noted for each boring location. Exhibit 4 is a subsurface investigation report prepared by GSI outlining the soil investigation and its results.

Field headspace screening for poly aromatic hydrocarbons (PAH) indicated that eighteen soil samples had measurable levels. The measured levels varied from 0.1 ppm in SB-18 to 803 ppm in SB-7. Thirteen of the eighteen samples with measurable PAH’s had levels less than 2 ppm which may be related to ambient or background levels, four samples had levels between 6 and 27 ppm, and one sample had a level of 803 ppm.

Soil borings with field screening levels above 2 ppm included SB-7 (1 sample), SB-9 (2 samples), SB-12 (1 sample), and SB-17 (1 sample).

A total of 60 soil samples were submitted to the laboratory for low, medium, and high range hydrocarbon analysis (180 separate analyses). Nine of the 180 laboratory analysis had detectible amounts of hydrocarbons and only two samples had levels above the KDHE Tier 2 Screening Levels. The two samples that exceeded the KDHE Tier 2 levels were boring SB-7, in the 2.0’ to 4.0’ depth interval that exceeded the mid-range hydrocarbon limit and boring SB-9, in the 6.0’ to 8.0’ depth interval that exceeded the low range hydrocarbon limit.

Based on previous explorations in the area by GSI and EnviroAnalytics Group, volatile organic compounds (VOCs) and RCRA metals are not expected to be encountered and were not tested for.

Groundwater Management Plan The City does not plan to encounter or extract any groundwater while performing the planned construction activities. The water table is typically monitored to be between 12 to 14 feet below ground surface in this area. Planned construction activities will typically be between 0 to 6 feet below ground surface with proposed storm sewer construction extending to 8 feet below ground surface. If groundwater is unexpectantly encountered by the proposed construction efforts or if it is determined necessary to extend construction excavations below 8 feet below ground surface, the groundwater will be extracted, containerized, tested, and appropriately treated and disposed. If groundwater extraction becomes necessary, the City will notify KDHE and prepare a groundwater treatment plan and submit to KDHE under separate cover.

Soil Excavation Plan The proposed 21st Street reconstruction will be completed in two separate phases. Phase 1 construction will occur east of the Middle Fork Chisholm Creek bridge between the bridge and Interstate 135. Phase 2 construction will occur west of the Middle Fork Chisholm Creek bridge between Mosley Avenue and the bridge. Based on the soil contamination findings from the GSI report (Exhibit 4), we have designated an approximate 350 feet long corridor within the 21st Street public right-of-way in Phase 1 and an approximate 200 feet long corridor in Phase 2 as the area of concern regarding potentially contaminated soil that may be encountered during construction. Exhibit 5 is an illustration of the excavation plan areas of concern with associated excavation details. A summary of the anticipated excavation volumes for the various construction activities is provided below.

Excavation of soil below and adjacent to existing pavement to accommodate new concrete pavement and base rock is anticipated to be 1,266 cubic yards in Phase 1 and 384 cubic yards in Phase 2. The excavated material will be located within the top 2 to 3 feet below ground surface.

Excavations for new sidewalks are included in this soil volume.

Excavation of soil for the construction of new storm sewer is anticipated to be 212 cubic yards in Phase 1 and 192 cubic yards in Phase 2. This will include excavations necessary for the installation of storm sewer pipe, manholes and inlets. The excavated material will be located within the top 6 to 8 feet below ground surface.

Excavation of soil for the construction of new water lines is anticipated to be 86 cubic yards in Phase 1 and 23 cubic yards in Phase 2. The excavated material will be located within the top 6 feet below ground surface.

Soil Management Plan As noted above, the City and MKEC anticipate that approximately 2,163 cubic yards of material may be excavated during this project. All of the petroleum-impacted soil is anticipated to occur at a depth between 0 to 8 feet below normal ground surface, above the groundwater level and is anticipated to be found in a zone defined within 200 feet west and 350 foot east of the Middle Fork Chisholm Creek bridge on 21st Street, within public right-of-way. The following is the City’s Soil Management Plan during this construction effort.

Soils will be visually and olfactory monitored for obvious petroleum contamination.

Excavated soils with no evidence of separate phase petroleum hydrocarbons (Type 1 soils) will be handled as typical special waste soils. They will be staged wherever the construction manager deems appropriate. More than likely it will be placed on private property formerly designated as part of the Coastal Derby Refinery on the south side of 21st Street. At the staging area, the excavated soils will be placed on plastic sheeting or within a lined roll-off box.

Soils with evidence of separate phase petroleum contamination (petroleum saturated material – Type 2 soils) are not anticipated. However, if this type of material is observed it will be directly placed in a lined roll-off box and segregated from all other materials.

Any given area requiring backfill will be backfilled with petroleum free, geotechnically appropriate material provided by the City’s construction contractor from off-site locations.

Upon completion of excavation activities, any stockpiled Type 1 or Type 2 material will be covered with plastic sheeting to protect it from precipitation and storm water run-on/runoff.

Type 1 stockpiled material will be hauled offsite and properly disposed either by land farming or as special waste. Land farming arrangements will be made by the City’s consultant while working with KDHE staff.

Type 2 stockpiled material will be tested and characterized to determine how it should be classified and handled. Most likely, Type 2 material will end up being characterized either as Special Waste

J:\Projects\2021\2101010455_COW_21st Street from Mosley to I-135\05 Civil\Docs\KDHE Soil Management Plan Letter\Proposed Soil Management Plan.docx Page 4 or Hazardous Waste and will be transported and disposed of following the appropriate and applicable regulation.

Characterization results will be provided to KDHE.

For materials meeting the definition of a Special Waste, one of two activities will take place as described below.

o Option 1. If material is suitable for land farming, the City’s consultant will work with KDHE staff to identify an appropriate location and obtain approval for the land farming process following the applicable regulations and guidelines.

o Option 2. A document will be submitted to KDHE’s Bureau of Waste Management requesting authorization to dispose of the impacted material at a KDHE-permitted municipal solid waste landfill (MWSLF). Upon determination from KDHE that the material qualifies as Special Waste, the material will be transported and disposed at an approved MWSLF that will accept the material.

For materials meeting the definition of a Hazardous Waste, arrangements will be made to have the material property transported and disposed of at facility yet to be determined.

Summary The City intends to reconstruct 21st Street North between Mosley Avenue and Interstate 135 in Wichita, Kansas. The proposed reconstruction project is located within the North Industrial Corridor site adjacent to the former Coastal Derby Refinery. The reconstruction will involve excavation of approximately 2,163 cubic yards of soil located within an identified area of soil that is potentially contaminated with petroleum hydrocarbons. The City’s contractor performing the improvements will stockpile the excavated soil onsite and will segregate the material with visual free phase hydrocarbons from the rest of the material. These materials will be designated as Type 2 and further evaluated as Special or Hazardous waste then disposed of properly based on these classifications. Soil excavated not having visual free phase hydrocarbons will be designated as Type 1 soil and will be disposed of properly as Special Waste. All backfill soil material will consist of clean, geotechnically appropriate material obtained from offsite locations.

From: Cordes, Zackary [KDWP] <Zackary.Cordes@KS.GOV> Sent: Thursday, October 27, 2022 5:02 PM To: Lesley Schmidt Subject: KDWP Review 20221124: 21st Street North Improvements Project (Sedgwick)

CAUTION: This email originated from outside of MKEC Engineering, Inc. Do not click links or open attachments unless you recognize the sender and know the content is safe.

Lesley Schmidt, We have reviewed the information for the proposed 21st Street North reconstruction project in Wichita, Sedgwick County, Kansas (Sec. 4&9-T27S-R01E). The project was reviewed for potential impacts to critical wildlife habitats, current state-listed threatened or endangered species and species in need of conservation, as well as Kansas Department of Wildlife and Parks managed areas for which this agency has administrative authority.

We have no objections to the project and provide the following comments and general recommendations. When applicable:

• Avoid impacts to existing streams and rivers, adjacent riparian zones, wetlands, and native prairie and woodland areas.

• Minimize all bank or instream activity, particularly during general fish spawning season (March 1 –

Aug. 31).

• Incorporate principles of low impact development (LID), such as permeable asphalt pavement, porous concrete, swales, bioretention, or raingardens. More info on

LID: https://www.epa.gov/nps/urban-runoff-low-impact-development.

• Implement and maintain standard erosion control Best Management Practices during all aspects of construction by installing sediment barriers (wattles, filter logs, rock check ditches, mulching, or any combination of these) across the entire construction area to prevent sediment and spoil from entering aquatic systems. Barriers should be maintained at high functioning capacity until construction is completed and vegetation is established. For more information on erosion BMPs go to: http://www.kdheks.gov/stormwater/#construct.

• Reseed disturbed areas with native warm-season grasses, forbs, and trees.

Results of our review indicate there will be no significant impacts to critical wildlife habitats; therefore, no special mitigation measures are recommended. The project will not impact any public recreational areas, nor could we document any potential impacts to currently-listed threatened or endangered species or species in need of conservation. No Department of Wildlife and Parks permits or special authorizations will be needed if construction is started within one year, and no design changes are made in the project plans. Permits may still be required from other agencies. We recommend consultation with all other applicable regulatory authorities which, among others, may include Kansas Department of Health and Environment, Kansas Department of

Agriculture-Division of Water Resources, and the U.S.
