About this file

This Storm Water Pollution Prevention Plan (SWPPP) document is a comprehensive permit application and environmental compliance filing submitted to the Kansas Department of Health and Environment (KDHE) for the Courtyards at Jacobs Farm Second Addition residential development project in Wichita, Kansas. The project involves a residential development with public infrastructure across approximately 97 acres of the 153-acre total site, located at 647 N 135th St W in Sedgwick County. The Notice of Intent (NOI) was submitted on May 8, 2026, with a project start date of June 1, 2026, and anticipated completion date of December 31, 2027. Authorization was granted under Kansas General Permit S-MCST-2208-1 (Federal Permit No. KSR124185) and became effective on June 4, 2026, expiring July 31, 2027. The project owner is Perfection Signature Properties, LLC (Scott Lehner), with MKEC Engineering, Inc. serving as the engineering contact. The erosion and sediment control plan includes construction of a temporary construction entrance/exit, installation of silt fence and BMPs around the perimeter, grading, dust control through water application, stabilization of disturbed areas, placement of BMPs at drainage inlets, and removal of temporary measures only after final paving and 75 percent vegetative cover establishment.

The annual permit fee is $60.00, with annual renewal required until Notice of Termination is submitted. The KDWP Ecological Review (conducted May 28, 2026) identified the project as requiring further review due to potential impacts to Designated Critical Habitat for the Plains Spotted Skunk (Spilogale interrupta); however, KDWP determined that no Action Permit would be required prior to project commencement. The agency provided recommendations to minimize vegetation and soil disturbance, replant disturbed soils with native grasses and forbs, and densely pile cleared trees in adjacent woodlands. The stormwater runoff drains to the City of Wichita's Municipal Separate Storm Sewer System (MS4) and ultimately to an unnamed tributary within the Lower Arkansas River Basin. The project includes detention basins, bioswales, rain gardens, road construction on new alignment, sidewalks, and wastewater collection system extensions. No contaminated soils, groundwater contamination, threatened or endangered species, or historical or archeological sites were identified within the site boundary during initial review.

Subject: KDWP Completed Review ERT20260578: Courtyards at Jacobs Farm Second Addition, SG Co.

CAUTION: This email originated from outside of MKEC Engineering, Inc. Do not click links or open attachments unless you recognize the sender and know the content is safe.

Lesley Schmidt, Thank you for submitting information to the KDWP Ecological Review Tool website regarding the proposed

Courtyards at Jacobs Farm Second Addition residential development in Sedgwick County, Kansas (S14-T27S-

R2W). The site's Automated Determination for the project indicates secondary review by KDWP staff is necessary. We have reviewed the project for potential impacts to critical wildlife habitats, current state-listed threatened or endangered species and species in need of conservation, as well as Kansas Department of Wildlife and Parks managed areas for which this agency has administrative authority.

We note the project was flagged by the Ecological Review Tool for potential impacts to Designated Critical Habitat for the Plains Spotted Skunk (Spilogale interrupta). Based on the limited areal extent of disturbance, we will not require

Action Permit issuance prior to project commencement. However, we recommend that vegetation and soil disturbance is minimized to the greatest extent practicable and that all disturbed soils are replanted with native grasses and forbs. Additionally, we recommend that trees cleared during construction are densely piled in adjacent woodlands to serve as potential escape cover for the Plains Spotted Skunk. Finally, we provide the following comments and general recommendations. When applicable:

• KDWP recommends borrow/waste sites, materials stockpiles, staging, and laydown areas be sited in previously disturbed habitats (e.g., cropland, non-native pasture).

• Avoid impacts to streams and rivers, adjacent riparian zones, wetlands and springs as well as native prairie and woodland areas. Use bridges to span streams crossed by access roads.

• Avoid or minimize development in floodplain areas due to probable flooding, potential destruction or damage to development, and the impacts to natural hydrologic interaction of the stream with its floodplain.

• Avoid open trenching of wetted stream channels. Minimize all bank or instream activity, particularly during general fish spawning season (March 1 – Aug. 31).

• Stream crossing, bridge, and dam designs should allow for aquatic organism passage. KDWP is willing to provide technical assistance on incorporating aquatic organism passage.

• KDWP advocates for the use of span or bottomless type bridge/culvert designs (e.g., conservation culverts).

Consult the Kansas Fish Passage Guide for design considerations:

https://ksoutdoors.com/content/download/55966/608381/file/FishPassageGuide.pdf.

• Culvert bottoms should be buried a minimum of 12 inches below the existing streambed grade to prevent perching and allow aquatic organism passage. This allows streambed substrate to deposit in the culvert providing a bottom similar to the natural channel. Expedite this process by using the excavated substrate to backfill the culvert once placed.

• Minimum culvert width should meet or exceed bankfull width of the stream. Match culvert slope with the existing stream channel profile.

• If additional water conveyance is required, install additional culverts at floodplain elevation.

• Detention basins and bioswales should not impound any streams. Ephemeral and Intermittent streams are important breeding and nursery habitats for aquatic organisms. Off-channel basins or dry dams can provide the necessary detention functions without impeding aquatic organism movement in stream channels.

• Depth of basins/bioswales should allow for seasonal drying which prevents the establishment of fish.

Predatory fish reduce the suitability of the basin for breeding amphibians by preying on larvae.

• Plant a diverse mixture of native wetland species to maximize water quality functions and habitat quality for wildlife.

• When feasible, strictly follow existing road rights-of-way with new linear infrastructure projects.

• Avoid or minimize the removal of native upland or riparian hardwood timber and vegetation when repairing, moving, or constructing underground utility lines.

• If a stream or dry water conveyance is open trenched, then restore the streambank and streambed to its original morphology and function (e.g. avoid channel widening and streambank degradation).

• When feasible, design stormwater and wastewater collection systems to use a gravity flow to reduce the need for aboveground pump stations.

• Design outfall structures to mimic natural systems to the extent possible. Incorporate gentle slopes and native vegetation to reduce erosion from outfalls. Consider constructing bioswales, detention basins, and/or constructed wetlands below outfall locations to filter pollutants and create habitat for wildlife.

• Prevent the introduction of aquatic or terrestrial non-native, invasive species during construction. Clean, Drain, and Dry all equipment of water, mud, plant material, and other debris prior to beginning construction. Equipment should be cleaned with pressurized, hot water (120F) or dried for 5 days. Non-native, invasive species in the riparian area should be controlled during construction until native vegetation is established.

• Avoid fuel spills or other contaminant releases. Have operational contingency plans (such as a

Spill Prevention, Control, and Countermeasure plan), which comply with all applicable guidance from Kansas Department of Health and Environment in place to respond to leaks and spills. For more information about SPCC plans, see:

https://www.epa.gov/sites/production/files/documents/spccbluebroch.pdf.

• Erosion control blankets can adversely impact reptiles and amphibians by ensnaring and entrapping individuals moving over/through the mesh. We recommend using compost, mulch, or biodegradable/natural fiber blankets (coconut/coir fiber is common) as potential alternatives to plastic erosion control blankets. Such alternatives can also promote the growth of vegetation further improving slope stability. Though less preferable than the aforementioned options, looseweave mesh is also acceptable, specifically types with weaves that are not welded at the intersections that would allow the opening to expand if an animal attempts to pass through.

• Incorporate principles of low impact development (LID), such as permeable asphalt pavement, porous concrete, swales, bioretention, or raingardens. More info on LID:

https://www.epa.gov/nps/urban-runoff-low-impact-development.

• Implement and maintain standard erosion control Best Management Practices during all aspects of construction by installing sediment barriers (wattles, filter logs, rock check ditches, mulching, or any combination of these) across the entire construction area to prevent sediment and spoil from entering aquatic systems. Barriers should be maintained at high functioning capacity until construction is completed and vegetation is established. For more information on erosion BMPs go to: https://www.kdhe.ks.gov/757/Construction-Stormwater-Program.

• Minimize light pollution by using low-intensity, shielded lighting. Consider using warmer color temperatures (below 3000K) to reduce skyglow.

• Restore disturbed soils with native grasses, forbs, shrubs, and/or trees as appropriate for the ecological site. KDWP Ecological Services Division staff can provide technical assistance for site restoration.

Results of our review indicate there will be no significant impacts to critical wildlife habitats; therefore, no special mitigation measures are recommended. The project will not impact any public recreational areas, nor could we document any potential impacts to currently-listed threatened or endangered species or species in need of conservation. No Department of Wildlife and Parks permits or special authorizations will be needed if construction is started within one year, and no design changes are made in the project plans. Permits may still be required from other agencies, and we recommend consultation with all other applicable regulatory authorities.

Since the Department’s recreational land obligations and the State’s species listings periodically change, if construction has not started within one year of this date, or if design changes are made in the project plans, the project sponsor must contact this office to verify continued applicability of this assessment report. For our purposes, we consider construction started when advertisements for bids are distributed.

Please consider this email our official review for this project. Thank you for the opportunity to provide these comments and recommendations. Please let me know if you have any questions or concerns about the preceding information.

Please submit all future projects through the KDWP Ecological Review Tool (ERT) that can be accessed at ert.ksoutdoors.gov to streamline the review process for all parties. If you have any questions or need assistance with the

ERT please contact us at kdwp.ess@ks.gov.

Thank you.

Sedimentation Basin Explanation The site is divided into multiple drainage areas, each routed to a designated sedimentation basin. Five sediment basins are provided to capture and treat runoff from disturbed areas before discharge. Each basin includes a controlled outlet structure to allow for proper dewatering and sediment settling.

Stormwater leaves the site at multiple locations, and erosion control measures will be used to prevent sediment from leaving the site.

Potential Sources of Pollution The following materials or substances may be present onsite during construction:

Acids

Cleaning solvents

Concrete

Concrete Additives

Concrete Washout

Detergents

Dust

Fertilizer

Non-Industrial Waste

Paints

Paint Solvents

Pesticides

Petroleum Products

Soil

Soil stabilization additives

Temporary Sewage Container

Trash/Litter

Vehicle Tracking of Sediments

Erosion and Sediment Controls

Stabilization Practices Stabilization practices for this site include:

• Land clearing activities shall be done only in areas where earthwork will be performed and shall progress, as earthwork is needed.

• Frequent watering of disturbed areas shall occur frequently to minimize dust during construction.

• Interim Best Management Practices (BMPs) shall be installed to reduce the amount of sediment leaving the site.

• Stabilization of disturbed areas must, at a minimum, be initiated immediately whenever any clearing, grading, excavating, or other soil disturbing activities have permanently ceased on any portion of the site, or temporarily cease on any portion of the site and will not resume for a period exceeding 14 calendar days. The disturbed areas shall be protected from erosion by maintaining the erosion control stabilization practices, or stabilizing the area with mulch or other similarly effective soil stabilizing BMPs. Initial stabilization activities must be completed within 14 days. If disturbed areas have a consistent snow cover or exhibit frozen soil conditions they are considered to be stabilized. Normal stabilization measures are required as soon as the area thaws.

Note: Local municipal ordinances may require stabilization to be initiated/completed in 7 days.

Always defer to the stricter requirement.

Structural Practices Structural practices for this site include but are not limited to the following range of BMPs. Construction details of BMPs are included on the Erosion Control Details:

• Inlet protection and outlet protection using silt fences, sandbags, etc.

• Perimeter protection using silt fences

• Sedimentation basin

• Stabilized construction exit points and sufficient staging area for construction materials.

• Containment of the on-site sanitation facility to prevent uncontrolled waste discharges during pumping and cleaning activities. The sanitation facility shall be placed a reasonable distance (at least 50 feet) from all inlets and drainage ways.

• Silt Fences will be installed around the downstream side of the perimeter of all disturbed areas.

• Vegetated filter strips

• Other structural BMPs installed and maintained by the contractor, as warranted by site conditions.

Sequence of Major Activities The Contractor will be responsible for implementing the following erosion control and storm water management control structures. All structural practices shall be maintained through the course of the construction and shall be sequenced according to activities in the field. The Contractor may designate these tasks to certain subcontractors as he sees fit, but the ultimate responsibility for implementing these controls and ensuring their proper functioning remains with the Contractor. Refer to the erosion control plans in Section 2 of this SWPPP for details. The order of activities will be as follows and shall be documented on the Record of Stabilization and Construction Activities Form:

1) Construct a temporary construction entrance/exit.

2) Install silt fence and other BMPs around the perimeter.

3) Perform Grading.

4) Water disturbed areas frequently to minimize dust.

5) Stabilization of disturbed areas where construction activity has ceased and “will not resume” for more than 14 days. Stabilization activities must be completed within 14 days after ceasing of construction activity.

6) Install BMPs at the locations of all grate inlets, curb inlets, and at the ends of all exposed storm sewer pipes

7) Carry out final grading and gravel and/or asphalt placement

8) Remove BMPs only after all paving is complete and exposed surfaces are stabilized. Exposed surfaces are stabilized when 75% vegetative cover has been established

9) Remove temporary construction entrances/exits.

Materials Management Practices

Management of Materials Management of materials and practices, outside of soil disturbing activities, shall be the responsibility of the Contractor. Such activities shall include, but not be limited to, the items shown below.

• Waste Disposal

All waste materials will be collected and stored in securely lidded metal dumpsters rented from local waste haulers. The dumpsters will meet all local and state solid waste management regulations. All waste and construction debris from the site will be deposited in the dumpsters. The dumpsters will be emptied on a periodic basis. No construction waste materials will be buried, dumped, or discharged onsite.

• Sanitary Waste

All sanitary waste will be collected from the portable units on a frequent, periodic basis by a licensed sanitary waste management contractor. These portable units shall be located a reasonable distance (at least 50 feet) from inlets and drainage ways.

• Concrete Waste from Concrete Trucks

All concrete wash water and excess concrete must be managed to prevent high-pH discharges.

o Containment: All wash water must be directed to a leak-proof container or a liner-protected pit designed to prevent infiltration into the ground or discharge into the storm sewer system.

o Prohibition: The discharge of concrete wash, rinse waters, or slurry to "Waters of the State" or the MS4 is strictly prohibited.

o Setbacks & Signage: Washout facilities must be located at least 50 feet away from storm drain inlets, open ditches, or waterbodies. Each location must be clearly identified with highly visible signage.

o Maintenance: Washout facilities must be cleaned out once they reach 75% capacity to prevent overspill.

• Hazardous Substances and Hazardous Waste

All hazardous waste materials will be disposed of in the manner specified by applicable local, state, and federal regulation and by the manufacturer. The contractor’s site personnel will be instructed in these practices and the Contractor’s Site Superintendent will be responsible for seeing that these practices are followed.

Good Housekeeping The following good housekeeping practices will be followed onsite during the construction project.

• An effort will be made to store only enough products required to do the job

• All materials stored onsite will be stored in a neat, orderly manner and, if possible, under a roof or other enclosure

• Products will be kept in their original containers with the original manufacture’s label in legible condition.

• Substances will not be mixed with one another unless recommended by the manufacturer.

• Manufacturer's recommendations for proper use and disposal will be followed.

https://mkeceng-my.sharepoint.com/personal/lschmidt_mkec_com/Documents/Documents/Ks SWPPP_220296N.docx

• The Contractor will be responsible for daily inspections to ensure proper use and disposal of materials.

• All of the product in a container will be used before the container is disposed of. All such containers will be triple-rinsed with water prior to disposal. The rinse water used in these containers will be disposed of in a manner in compliance with state and federal regulations and will not be allowed to mix with storm water discharges.

• If surplus product must be disposed of manufacturer or local/state/federal recommended methods for proper disposal will be followed.

• Any track out of sediment from the construction site onto streets will be removed daily.

Spill Prevention Practices In addition to the good housekeeping, the following practices will be followed for spill prevention and cleanup.

• Manufacturer's recommended methods for spill cleanup will be clearly posted and site personnel will be trained regarding these procedures and the location of the information and cleanup supplies.

o Post the KDHE Spill Line: 785-291-3333.

• Materials and equipment necessary for spill cleanup will be kept in the material storage area onsite in spill control and containment kit (containing, for example, absorbent such as cat litter or sawdust, acid neutralizing powder, brooms, dust pans, mops, rags, gloves, goggles, plastic and metal trash containers, etc.).

• All spills will be cleaned up immediately after discovery.

• The spill area will be kept well ventilated and personnel will wear appropriate protective clothing to prevent injury from contact with the hazardous substances.

Control of Allowable Non-Stormwater Discharges Certain types of discharges are allowable under the U.S. Environmental Protection Agency General Permit, and it is the intent of this SWPPP to allow such discharges. These types of discharges will be allowed under the conditions that no pollutants will be allowed to come in contact with the water prior to or after its discharge. The control measures, which have been outlined in this SWPPP, will be strictly followed to ensure that no contamination of these non-stormwater discharges takes place. The following allowable non-stormwater discharges that may occur from the job site include:

• Discharges from fire fighting activities

• Fire hydrant flushing

• Waters used to wash vehicles or control dust in order to minimize offsite sediment tracking

• Potable water sources including waterline flushing, irrigation drainage from watering vegetation, routine exterior building wash-down (without detergents present)

• Pavement wash waters where spills or leaks of toxic or hazardous materials have not occurred and detergents are not used

• Air conditioning condensate

• Springs

• Uncontaminated groundwater https://mkeceng-my.sharepoint.com/personal/lschmidt_mkec_com/Documents/Documents/Ks SWPPP_220296N.docx

• Uncontaminated groundwater dewatering is allowed, provided it is discharged through a sediment filter bag or a turbidity curtain to ensure no sediment-laden water reaches the MS4 or Waters of the State.

• Foundation or footing drains where flows are not contaminated with process materials such as solvents

• Spray water from dust control activities

Inspection and Recordkeeping Procedures

Maintenance/Inspection The following inspection and maintenance practices will be used to maintain erosion and sediment controls and stabilization measures to be performed by the Contractor.

• All control measures will be inspected at minimum of once every 14 days and within 24 hours following a 0.5 inch or greater rainfall event.

• All measures will be maintained in good working order; if repairs are found to be necessary, they shall be noted on the inspection report and initiated within 24 hours.

• Built up sediment will be removed from silt fence when it has reached one-third the height of the fence.

• Silt fences will be inspected for depth of sediment, tears, etc., to see if the fabric is securely attached to the fence posts, and to see that the fence posts are securely in the ground.

• The sediment basin, if present, will be inspected for depth of sediment, and built up sediment will be removed when it reaches 10 percent of the design capacity.

• Diversion dikes, if present, will be inspected and any breaches promptly repaired.

• Temporary and permanent seeding and all other stabilization measures will be inspected for bare spots, washouts, and healthy growth.

• A maintenance inspection report will be made after each inspection. Copies of the Inspection Report Forms to be completed by the inspector are included in this SWPPP under Section 3.

• Any modifications to the Erosion Control Plan shall be noted on the Erosion Control Plan (Section 2.4).

• All site inspections must be conducted by a Qualified Inspector. In accordance with Kansas state requirements, a "Qualified Inspector" is a person who has successfully completed a KDHE-recognized training program and holds a current certification such as:

o KDOT CIT (Certified Inspection and Testing) o CISEC (Certified Inspector of Sediment and Erosion Control) o CESSWI (Certified Erosion, Sediment and StormWater Inspector) or CPESC (Certified Professional in Erosion and Sediment Control)

The Qualified Inspector is responsible for conducting all routine and rain-event inspections, identifying necessary maintenance or repair activities, and accurately completing all required reports. A copy of the inspector’s current, valid certification must be maintained in Section 3 of this binder.

• Personnel selected for the inspection and maintenance responsibilities will receive training from the Contractor. Documentation of this personnel training will be kept in the Contractor’s SWPPP Folder.

https://mkeceng-my.sharepoint.com/personal/lschmidt_mkec_com/Documents/Documents/Ks SWPPP_220296N.docx

• Disturbed areas and materials storage areas that are exposed to precipitation will be inspected for evidence of or potential for pollutants entering storm water systems.

• Report to the U.S. Environmental Protection Agency and the local government within 24 hours any noncompliance with the SWPPP that will endanger public health or the environment.

Inspection and Maintenance Report Forms The SWPPP, Notice of Intent (NOI), and all Inspection/Maintenance Reports must be readily accessible on-site for the duration of construction.

• All records, including inspection forms and the SWPPP, must be maintained by the permittee for a period of three (3) years following the acceptance of the Notice of Termination (NOT).

• If electronic inspection software is utilized, a printed copy of the most recent 30 days of reports must be kept in the on-site binder. The full digital history must be made immediately available to governmental officials upon request via mobile device or tablet.

If an inspection identifies a Best Management Practice (BMP) that is missing, improperly installed, or significantly damaged (not functioning as intended), it shall be logged as a Corrective Action.

• Corrective action(s) must be initiated within 24 hours of discovery.

• Repairs or installations must be completed no later than 7 calendar days after discovery. If the 7-day deadline cannot be met, the SWPPP must be updated with a written justification for the delay.

Hazardous Material Spill Reports The Contractor shall provide copies of the completed forms and reports that are filed with regulatory Agencies if reportable quantities of hazardous materials are spilled.
