About this file
This is an Affirmative Steps compliance document for Letcher County Fiscal Court in Kentucky, outlining requirements for contracting with small and minority businesses, women's business enterprises, and labor surplus area firms under 2 CFR 200.321. The document applies to a demolition services procurement (Round 8) in support of a disaster-related property acquisition and demolition project. The affirmative steps requirement mandates that Letcher County Fiscal Court and any contractors or engineers utilizing subcontractors must take all necessary measures to ensure qualified minority businesses, women-owned enterprises, and labor surplus area firms participate in the solicitation and contracting process whenever economically feasible.
The specific affirmative steps required include placing qualified enterprises on solicitation lists, ensuring they are solicited as potential sources, dividing total project requirements into smaller tasks or quantities to maximize participation opportunities, establishing delivery schedules that encourage enterprise participation, and utilizing assistance from organizations such as the Small Business Administration and the Minority Business Development Agency. These requirements are standard federal compliance obligations tied to the disaster-related demolition procurement and apply to all tiers of contracting, including prime contractors and any subcontractors they engage.
