About this file
This is a Resident Veteran's Preference Affidavit form for the State of New Mexico, used in conjunction with a Civil Site Construction & Earthwork Services procurement for an unnamed District seeking to establish one or more Indefinite Delivery/Indefinite Quantity (IDIQ) unit price contracts. The affidavit allows qualified businesses to certify eligibility for New Mexico's resident veteran's business preference, which provides a 10% preference discount on solicitations. The form requires vendors to declare under penalty of perjury that their prior year revenue does not exceed $3 million in order to qualify for the preference benefit. Completion of this affidavit is optional and only required for vendors currently possessing a resident veteran's preference certificate.
The affidavit imposes specific limitations and reporting requirements on resident veteran businesses claiming the preference. Businesses are subject to a maximum of ten consecutive years of preference benefits, both at the business entity level and for individual owners. Additionally, an individual cannot benefit from the preference through multiple businesses concurrently. Awardees must agree to submit annual reports to the State Purchasing Division of the General Services Department detailing prior calendar year revenues and the awarded contract amounts, distinguishing between public body purchases and public works contracts. False or misleading statements on the affidavit or subsequent reports constitute crimes, and material misrepresentations may result in denial of award or unaward of the procurement. The affidavit requires signature from an authorized business representative and acknowledgment that representations made are subject to protest.
