About this file

This is a Resident Veteran's Preference Affidavit form for New Mexico state procurement, applicable to the Civil Site Construction & Earthwork Services contract opportunity with a New Mexico school district. The affidavit certifies whether a contractor qualifies for New Mexico's resident veterans' preference program and must be completed only by vendors who currently possess a resident veteran's preference certificate. The form requires the contractor to declare under penalty of perjury that the business generated prior year revenue of $3 million or less in the preceding tax year to qualify for a 10 percent preference discount on this solicitation. Contractors must acknowledge various statutory requirements and limitations associated with the preference program.

The affidavit establishes material representations subject to protest that may result in denial of contract award if found to be incorrect. Qualifying resident veteran businesses are subject to significant restrictions, including a limitation of ten consecutive years of preference eligibility for both the business entity and individual owners, and prohibition against receiving preference benefits from more than one business concurrently. Award-winning contractors must agree to submit annual reports to the State Purchasing Division of the General Services Department documenting awarded contract amounts, designated as either public body purchases or public works contracts. All statements made in the affidavit constitute material representations enforceable under state law, with false or misleading information subject to criminal penalties.
