About this file
This is a Maintenance Bond document for the City of Fort Worth, Texas, related to the 2027 Concrete Restoration Contract 3 (City Project No. 106806). The project involves approximately 11,705 square yards of 9-inch concrete pavement, 3,685 square yards of 7-inch concrete pavement, 2,000 cubic yards of flex base, and 8,000 square yards of geogrid installation. The bond establishes the Principal contractor's obligation to maintain all work free from defects in materials or workmanship for a two-year period following final acceptance by the City. Should defective work be identified during this maintenance period, the Principal is required to repair or reconstruct the affected work at no cost to the City.
The maintenance bond is executed jointly by the Principal contractor and a corporate surety authorized to conduct business in Texas, with the bond amount to be determined and filled in upon execution. If the Principal fails to remedy any defective work timely noticed by the City, the City may procure repairs independently, with all associated costs charged to both the Principal and the Surety under the bond. Venue for any legal action is established in Tarrant County, Texas or the United States District Court for the Northern District of Texas, Fort Worth Division, and successive recoveries may be pursued for successive breaches. The bond date shall not precede the contract award date, and both the Principal and Surety must provide current contact information and addresses.
