About this file

This is a Performance Bond document required for the City of Fort Worth's 2026 Concrete Restoration Contract 3 (City Project No. 106668) in Texas. The bond serves as a financial guarantee that the Principal contractor will faithfully perform all obligations under the contract, including the furnishing of materials, equipment, labor, and accessories necessary for the work. The contract encompasses approximately 11,260 square yards of 9-inch concrete pavement, 9,472 square yards of 6-inch concrete pavement, 4,100 cubic yards of flex base, and 18,250 square yards of geogrid. The bond is executed in compliance with Chapter 2253 of the Texas Government Code and establishes that the penal sum (bond amount) will be forfeited if the contractor fails to perform the work according to the plans, specifications, contract documents, and any approved change orders.

The performance bond requires both a Principal (the contractor) and a corporate Surety authorized to conduct business in Texas to jointly and severally bind themselves to the City of Fort Worth. Venue for any legal action related to the bond is established in Tarrant County, Texas or the United States District Court for the Northern District of Texas, Fort Worth Division. The bond becomes null and void upon faithful performance of all contract obligations; otherwise, it remains in full force and effect. The bond date must not be prior to the contract award date, and if the Surety's physical address differs from its mailing address, both must be provided. A certified extract from the Surety's bylaws must be on file demonstrating the signatory officer's authority to execute such obligations.
