3.1 Regulatory Monitoring and Intervention Support

Overview: Effective management of the telecommunications/network services utilized by the FEAs requires continuous monitoring of the Federal, State, and local regulatory landscape. In specific instances, interventions are necessary to protect the interests of Federal telecommunications/network services customers and ensure that the Federal Government is represented in judicial and administrative proceedings impacting the purchase of telecommunications/network services. The tasks described below support regulatory information gathering, decision-making, and intervention efforts.

3.1.1 Continuous Regulatory Monitoring

3.1.1.1 The Contractor shall continuously track and monitor telecommunications/network services matters at issue before local, State, and Federal regulatory bodies including, but not limited to, the Federal Communications Commission (FCC), local public utility commissions (PUCs), standards-setting bodies, and other similar forums. 3.1.1.2.2 The RMR will describe regulatory activities pending in Federal and local jurisdictions (includes States, territories, counties, and the District of Columbia) and include a comprehensive summary of regulatory actions, rulings, hearings, pending legislation, etc., currently or potentially impacting the telecommunications/network services interests of the FEAs. The scope of the monitoring effort – including the range and number of cases under consideration -- will be directed by the COR based on consultations with Government telecom managers and recommendations supplied by the Contractor.

3.1.1.2.3 Cases will be presented and grouped by jurisdiction as follows:

• Section I: Federal Communications Commission

• Section II: Local Telecommunications Proceedings

• Section III: Other Administrative & Judicial Proceedings.

2 Reader’s Note: The first digit of the assigned CLIN in SECTION B, SUPPLIES OR SERVICES AND PRICES/ COSTS, corresponds to the contract option year (Base Period = 0, Option Year 1 = 1, Option Year 2 =2, Option Year 3 =3, Option Year 4 = 4). The generic “X” in the cross-referenced CLINs is a placeholder representing “all option years,” e.g., “X00101” refers collectively to CLINSs 000101, 100101, 200101, 300101, and 400101.

SECTION Number of Cases

I FCC 14-18

II Local Telecom Proceedings 55-70 III Other 5-7

3.1.1.2.3.2 For easy reference, a unique Short Name (5 words or less) will be assigned to each case or project by the COR. The Short Name references shall be specified in all discussions or reports when discussing a numbered case, activity, or proceeding.

3.1.1.2.3.4 High Impact Cases: The COR will consult with the

Contractor to identify dockets or issues requiring especially close scrutiny and tracking because potential outcomes are deemed to weigh significantly or immediately on the price, quality, or availability of Federal telecommunications/ network services. High impact cases will be designated high or medium priority on the RMR and highlighted as appropriate on the RMR Executive Summary.

3.3 TFS Assessments and Allowability Tracking

Overview: Data related to the taxes, fees, and surcharges (TFSs) payable by the Federal Government under GSA telecommunications/network services contracts are maintained in GSA’s Conexus system.

Accurate data ensures that improperly invoiced charges are rejected upon submission. The tasks described below support the accurate collection, compilation, management, retention, analysis, protection, validation, formulation, and distribution of TFS allowability data.

3.3.1 General

The Contractor shall assist GSA network’s managers and COs in identifying and interpreting regulatory rules, statutes, and policies, as these pertain to the allowability of TFSs applied to Federal telecommunications/network services. This effort consists of three functions:

• TFS Database Management [CLINs X00104/05/06/07]

• Continuous Allowability Monitoring [CLINs X000108/09/10]

• Directed TFS Allowability Reviews [CLINs X002]

3.3.2 TFS Database Management [CLINs X00104/05/06/07]

3.3.2.1 The ALLTAX data file shall be furnished by the Government in Comma

Separated Value (CSV) format at the inception of the contract on or before the kick-off meeting.

3.3.2.2 Within 20 days of contract award, the Contractor shall construct a relational TFS

Database to maintain the TFS data contained in the ALLTAX allowability data file. (Refer to Database Workflow Process, Attachment 3, for details describing the structure, size, and content of the relational database.)

3.3.2.3 Initial Data Validation [CLINs X00105]: After construction of the TFS Database and within 20 days of contract award a complete and current ALLTAX data file shall be downloaded and submitted to the Government in CSV format for synchronization and validation. (Refer to Table of Deliverables, Attachment 1, Validated Initial Data.) The Contractor shall work with the EPRE COR to accommodate any required modifications, adjustments, adaptations, or corrections to data or the database structure during data validation and synchronization.

3.3.2.4 The operability and accuracy of the database, including the validation of all data content, shall be established no later than 30 days after contract award. The EPRE COR will notify the Contractor when the ALLTAX data file has been validated and accepted.

3.3.2.5 No later than three weeks after the operability and accuracy of the database are established and all data has been validated, the Contractor shall submit the Database Management Plan and Project Design Documentation specified in the Table of Deliverables, Attachment 1.

3.3.2.5.1 The Database Management Plan shall describe how Contractor will internally store and manage the ALLTAX data retained in the TFS Database. Plans shall include data validation protocols, regulatory monitoring schedules, updates, reporting formats, automated processes, and historical data retrieval capabilities.

3.3.2.5.2 Project Design Documentation shall include a user manual and describe the architecture, workflow, processes, customization, tools, and source code associated with the TFS Database.

3.3.2.6 The design, development, and long-term management of the TFS Database is the responsibility of the Contractor.

3.3.2.7 The Database Management Plan and Project Design Documentation shall be updated no later than three weeks after changes are implemented.

3.3.2.8 Quarterly Revalidations [CLINs X00107]: Each quarter comprehensive ALLTAX data files shall be submitted to the Government via web service for a summary synchronization and re-validation. (Refer to Table of Deliverables, Validated Quarterly Allowable Tax Data, Attachment 1.)

3.3.2.8.1 Data files shall be submitted in CSV format.

3.3.2.8.2 Location Data Sync: The Contractor shall consult with the EPRE

COR to ensure all new jurisdictions are included in the database and posted on the CSV file.

3.3.2.8.3 All new items and status changes (allowable/unallowable) shall be up-to-date and accurate. Data shall include all regulatory/statutory references. Changes since the last quarterly validation shall be highlighted.

3.3.3 Continuous Allowability Monitoring [CLINs X00108/09/10]

3.3.3.1 The Contractor shall continually monitor the regulatory landscape for changes impacting the allowability of TFSs [CLINs X00108].

3.3.3.2 New TFSs, revised rates, new locations, or changes in allowability status shall be documented in the Contractor’s database and formatted for upload into Conexus.

Per Table of Deliverables, Attachment 1, TFS Data Updates [CLINs X00109] containing revised data shall be transmitted via web service in CSV format within the stated time frames. The Contractor shall simultaneously submit a TFS Change Notice [CLINs X00110], Attachment 4, to the EPRE COR via email.
