Underground Storage Tank Regulatory Requirements what you need to know
Introduction what is an underground storage tank (UST)?
A tank and any underground piping connected to the tank that has at least 10 percent of its combined volume underground.
GSA owns and operates approximately 550 underground storage tanks (USTs). These are used primarily to store fuel for heating buildings, and/or powering emergency generators.
Many of our tenants also operate tanks to support activities such as vehicle fueling. Leaks or spills from tanks not only pose potential threats to the environment, but are expensive to clean-up, damage property, risk damaging community relations, and pose a danger to building tenants and PBS personnel.
USTs must be managed in accordance with federal and state regulations for design, installation, operation, maintenance, and closure of USTs. The Environmental Protection Agency (EPA) and states periodically conduct inspections of all federally regulated tanks. The information provided herein is intended to give an overview of how UST regulations apply to GSA USTs.
CAUTION! In 2007 the EPA and state regulators launched strategies to inspect all USTs that were last inspected before 1999.

do federal rules apply to all tanks?
No, federal rules apply only to USTs that have a capacity greater than 110 gallons, and contain petroleum products or hazardous substances. The following USTs are exempt from federal requirements:
Tanks used only for storing heating fuel used on the premises where it is stored. BEWARE! In many jurisdictions, state and local requirements are more stringent than federal laws.
Tanks on or above the floor of underground areas, such as basements or tunnels.
Tanks that are part of an emergency spill containment system.
Updated June 2007 1 what are the basic requirements for an UST?
Next to proper design/retrofitting; one of the most critical elements to a successful tank management program is the ability to prove through documentation, that the tank system is managed in accordance with all federal, state and local regulatory guidance for installation, operation, maintenance, and closure. In many jurisdictions, state and local requirements are more stringent than federal laws.

Building Manager Responsibilities
Verify that design, installation, and closure of GSA-owned USTs are in accordance with federal, state, and local requirements.
Determine the owner of each tank, and maintain an accurate inventory of all USTs (including heating oil and fuel oil) at GSA-controlled facilities, and for tanks for which GSA manages a service contract.
Be fully aware of the location, size, contents, and condition of all USTs.
Ensure all tanks are properly registered with state and local authorities.
NOTE: GSA tank inventories must include all tanks used to store fuel. Although certain USTs, and aboveground storage tanks are exempt from federal regulations, they are regulated in some states. Further, releases from these tanks pose the same risks to our assets, tenants, and the environment as federally regulated tanks.
Ensure that tanks are properly operated and maintained.
Check exposed components of tank for signs of corrosion.
Ensure that leak detection systems are operational.
Maintain accurate records of all tank related activity (to include, but not limited to fill records, monitoring records, tightness tests, spill reports, inspections, registration).
Budget for tank repairs and upgrades in R&A requests.
Partner with the regional environmental staff to develop an UST Management
Plan for all GSA-owned or operated USTs.
Notify Regional environmental staff immediately of any release (spill/leak).
Notify State of reportable spills (suspected and confirmed).
Coordinate spill clean-up, and the remediation of leaking USTs.
Monitor tank contractor performance to ensure their compliance with UST management regulations.
Verify that tenant owned/operated tanks are managed properly.
CAUTION: Releases from fuel storage tanks can trigger compliance requirements of other environmental regulations such as the Comprehensive Environmental Response Compensation, and Liability Act (CERCLA), and the Clean Water Act (CWA).

Recordkeeping and Reporting Records must demonstrate compliance with all applicable laws, statutes, and policies related to tank management. Records must be (1) kept at the UST site and immediately available for inspection by the inspecting agency; or (2) at a readily available alternative site and be provided for inspection upon request. In addition to the items listed throughout this guide, the following records should be retained: copies of performance claims provided by leak detection manufacturers; records of recent maintenance, repair, and calibration of on-site leak detection equipment records showing the required inspections and tests of the corrosion protection system; and site assessment results required for permanent closure.
NOTE: The following UST releases must be reported to the appropriate regulatory authority within 24 hours:
Any hazardous substances release greater than the established RQ.
Any petroleum release greater than 25 gallons.
ATTENTION: Accurate recordkeeping is a critical element of a successful tank management program.
Tank Management Plan The Property Management and the Regional Environmental staff must develop a management plan for the tanks under their jurisdiction. This plan will identify specific actions planned for the tanks.
Minimum Elements of a Management Plan
1) An inventory of all tanks to include comprehensive tank management data. The inventory will include all tanks, to include tanks identified here as exempt, and above ground tanks used for storing petroleum, and/or hazardous substances.
2) Records of tank notifications to the state agencies (installation/closure, leaks/spills, etc.)
3) A priority ranking system for tank closure, and/or replacement. First priority should be given to tanks known/suspected to be leaking; second consider tanks that are not leaking but are not compliant will all applicable regulations/governing standards.
4) Release Mitigate/Response Plan.
5) An estimate of funds and schedule for tank project implementations.
6) A plan for ongoing leak detection tests and repairs.
7) Reporting procedures for notifications of releases.
8) Records management system and internal reporting of data to the regional office.
will my tanks be inspected?
The Energy Policy Act (EPAct) of 2005 mandated that EPA and the state environmental agencies (State) develop an inspection strategy for all tanks that have not been inspected since 1998. The determination of when inspections will be conducted is at the sole discretion of the EPA/State.
Updated June 2007 3 what do inspectors look for?
Inspectors will evaluate all evidence -- primarily documentation -- that can help determine the compliance status of the tanks. Inspectable items include, but are not limited to:
tank system design/installation criteria tightness tests registration installation certification manufacturer’s performance claims closure/upgrade/repair leak detection monitoring signage, etc.
signs of spills/overfills records of spill reporting/clean-up who is responsible for USTs compliance at delegated facilities?
The client agency is responsible for meeting all management and operational compliance requirements associated with USTs at their delegated facilities.
