SAFEGUARDING AND DISSEMINATION OF SENSITIVE BUT UNCLASSIFIED

(SBU) BUILDING INFORMATION

This clause applies to all recipients of SBU building information, including offerors, bidders, awardees, contractors, subcontractors, lessors, suppliers, and manufacturers.

(a) Marking SBU. Contractor-generated documents that contain building information must be reviewed by GSA to identify any SBU content, before the original or any copies are disseminated to any other parties. If SBU content is identified, the contracting officer may direct the contractor, as specified elsewhere in this contract, to imprint or affix SBU document markings to the original documents and all copies, before any dissemination.

(b) Authorized recipients. Building information considered SBU must be protected with access strictly controlled and limited to those individuals having a need to know such information. Those with a need to know may include Federal, State, and local government entities, and nongovernmental entities engaged in the conduct of business on behalf of or with GSA. Nongovernmental entities may include architects, engineers, consultants, contractors, subcontractors, suppliers, and others submitting an offer or bid to GSA or performing work under a GSA contract or subcontract. Contractors must provide SBU building information when needed for the performance of official Federal, State, and local government functions, such as for code compliance reviews and for the issuance of building permits. Public safety entities such as fire and utility departments may require access to SBU building information on a need to know basis. This clause must not prevent or encumber the dissemination of SBU building information to public safety entities.

(c) Dissemination of SBU building information:

(1) By electronic transmission. Electronic transmission of SBU information outside of the GSA firewall and network must use session (or alternatively file encryption). Sessions (or files) must be encrypted with an approved NIST algorithm, such as Advanced Encryption Standard (AES) or Triple Data Encryption Standard (3DES), in accordance with the Federal Information Processing Standards Publication (FIPS PUB) 140-2, Security Requirements for Cryptographic Modules. Encryption tools that meet FIPS 140-2 are referenced on the NIST web page found at the following URL: http://csrc.nist.gov/groups/STM/cmvp/documents/140-1/1401vend.htm. All encryption products used to satisfy the FIPS 140-2 requirement should have a validation certificate that can be verified at the following URL:

http://csrc.nist.gov/groups/STM/cmvp/validation.html#02. (Not all vendors of security products that claim conformance with FIPS 140-2 have validation certificates.) Contractors must provide SBU building information only to authorized representatives of State, Federal, and local government entities and firms currently registered as “active” in the Systems for Award Management (SAM) database at www.sam.gov that have a need to know such information. If a subcontractor is not registered in the CCR and has a need to possess SBU building information, the subcontractor shall provide to the contractor its DUNS number or its tax ID number and a copy of its business license.

(2) By non-electronic form or on portable electronic data storage devices. Portable electronic data storage devices include but are not limited to CDs, DVDs, and USB drives. Non-electronic forms of SBU building information include paper documents.

(i) By mail. Utilize only methods of shipping that provide services for monitoring receipt such as track and confirm, proof of delivery, signature confirmation, or return receipt.

(ii) In person. Contractors must provide SBU building information only to authorized representatives of State, Federal, and local government entities and firms currently registered as “active” in the CCR database that have a need to know such information.

(3) Record Keeping. Contractors must maintain a list of State, Federal, and local government entities and the firms to which SBU is disseminated under sections (c) (1), and (c) (2) of this clause. The list must include at a minimum (1) the name of the State, Federal, or local government entity or firm to which SBU has been disseminated; (2) the name of the individual at the entity or firm who is responsible for protecting the SBU building information, with access strictly controlled and limited to those individuals having a need to know such information; (3) contact information for the named individual; and (4) a description of the SBU building information provided. Once work is completed, or for leased space with the submission of the http://csrc.nist.gov/groups/STM/cmvp/documents/140-1/1401vend.htm http://csrc.nist.gov/groups/STM/cmvp/validation.html#02 http://www.sam.gov/

“as built” drawings, the contractor must collect all lists maintained in accordance with this clause, including those maintained by any subcontractors and/or suppliers, and submit them to the contracting officer. For federal buildings, final payment may be withheld until the lists are received.

(d) Retaining SBU documents. SBU building information (both electronic and paper formats) must be protected, with access strictly controlled and limited to those individuals having a need to know such information.

(e) Destroying SBU building information. SBU building information must be destroyed such that the marked information is rendered unreadable and incapable of being restored, or returned to the contracting officer, when no longer needed, in accordance with guidelines provided for media sanitization within Appendix A of NIST Special Publication 800-88, Guidelines for Media Sanitization, available at http://csrc.nist.gov/publications/nistpubs/800-88/NISTSP800-88_rev1.pdf. If SBU building information is not returned to the contracting officer, examples of acceptable destruction methods for SBU building information are burning or shredding hardcopy; physically destroying portable electronic storage devices such as CDs, DVDs, and USB drives; deleting and removing files form electronic recycling bins; and removing material from computer hard drives using a permanent-erase utility such as bit wiping software or disk crushers.

(f) Notice of disposal. The contractor must notify the contracting officer that all SBU building information has been destroyed, or returned to the contracting officer, by the contractor and its subcontractors or suppliers in accordance with section (e) of this clause, with the exception of the contractor’s record copy. This notice must be submitted to the contracting officer at the completion of the contract in order to receive final payment. For leases, this notice must be submitted to the contracting officer at the completion of the lease term.

(g) Incidents. All improper disclosures of SBU building information must be immediately reported to the contracting officer. If the contract provides for progress payments, the contracting officer may withhold approval of progress payments until the contractor provides a corrective action plan explaining how the contractor will prevent future improper disclosures of SBU building information. Progress payments may also be withheld for failure to comply with any provision of this clause until the contractor provides a written corrective action plan explaining how the contractor will rectify any noncompliance and comply with the clause in the future.

(h) Subcontracts. The Contractor must insert the substance of this clause in all subcontracts.

CONTRACTOR PERFORMANCE INFORMATION

(1) Evaluating Contractor Performance: The General Services Administration is using the Contractor Performance Assessment Reporting System (CPARS) module as the secure, confidential, information management tool to facilitate the performance evaluation process. CPARS enables a comprehensive evaluation by capturing comments from both GSA and the contractor. The website for CPARS is http://www.cpars.gov

Completed CPARS evaluations are sent to the Past Performance Information Retrieval System (PPIRS) which may then be used by Federal acquisition community for use in making source http://csrc.nist.gov/publications/nistpubs/800-88/NISTSP800-88_rev1.pdf http://www.cpars.gov/ selection decisions. PPIRS assists acquisition officials by serving as the single source for contractor past performance data. The Contracting Officer also reserves the right to use personal knowledge of a quoter’s past performance into account during the proposal evaluation.

(2) CPARS Registration: Each award requiring an evaluation must be registered in CPARS. The contractor will receive several automated emails. Within thirty days of award, the contractor will receive an e-mail that contains user account information, as well as the applicable contract and order number(s) assigned. Contractors will be granted one user account to access all evaluations.

(3) Contractor CPARS Training: Contractors may sign up for CPARS training. A schedule of classes will be posted to the CPARS training site (http://www.cpars.gov/allapps/cpcbtdlf.htm) and updated as needed.

(4) Contractor Representative (CR) Role: All evaluations will be sent the Contractor Representative (CR) named on your award. The CR will be able to access CPARS to review and comment on the evaluation. If your CR is not already in the CPARS system, the contracting officer will request the name and email address of the person that will be responsible for the CR role on your award.

Once an evaluation is ready to be released the CR will receive an email alerting them the evaluation is ready for their review and comment. The email will indicate the time frame the CR has to respond to the evaluation; however, the CR may return the evaluation earlier than this date.

GSA shall provide for review at a level above the contracting officer (i.e., contracting director) to consider any disagreement between GSA and the contractor regarding GSA’s evaluation of the contractor. Based on the review, the individual at a level above the contracting officer will issue the ultimate conclusion on the performance evaluation.

Copies of the evaluations, contractor responses, and review comments, if any, will be retained as part of the contract file.

This shall include, but not be limited to, instances where an employee is determined, in the Government's sole discretion, to be incompetent, careless, insubordinate, unsuitable or otherwise objectionable.

(b) A contractor employee may also be removed where the continued employment of the contractor employee in connection with the Government work is deemed, in the Government's sole discretion, contrary to the public interest, inconsistent with the best interests of security, or a potential threat to the health, safety, security, general well-being or operational mission of the facility and its population.

SECURITY CLEARANCE REQUIREMENTS (NON-CLASSIFIED CONTRACT)

SECURITY CLEARANCE REQUIREMENTS (NONCLASSIFIED CONTRACT)

(NOTE: DOES NOT INCLUDE LEASED SPACE)

1) Introduction

a) Homeland Security Presidential Directive 12 (HSPD-12) “Policy for a Common Identification Standard for Federal Employees and Contractors” mandated the implementation of a government-wide standard for secure and reliable forms of identification, also known as security credentials.

http://www.finance.gsa.gov/

b) All contractor employees who require routine access to GSA-controlled facilities or its Information Technology (IT) infrastructure are required to be issued this type of credential. Routine access is defined as regularly scheduled access to Government facilities for a period greater than six (6) months.

c) Prior to being issued this form of identification, each individual must have both their identity and trustworthiness proven. This is accomplished by conducting a personnel security investigation (Tier 1) and a Federal Bureau of Investigation (FBI) Criminal History Fingerprint check. All contractors seeking to conduct business on or within federal facilities that are controlled and operated by the Federal Government are required to have a personnel security investigation conducted.

d) Contractors require a favorable initial suitability determination based off the submission of a Tier 1 to receive an identification credential meeting HSPD-12 requirements.

e) The Contractor is responsible for returning all HSPD-12 badges to GSA upon project completion.

2) Clearance Type

a) Long-Term Contractor Clearance Tier 1

i) This section covers the procedures for obtaining a security clearance for contractors working on GSA-controlled facilities.

ii) The Tier 1 clearance is required for contractors who require access for more than six (6) months and those who need Information Technology (IT) access (regardless of how long they will be working on a GSA-controlled facility).

iii) Procedures for each Tier 1 applicant to be cleared:

a. The prime contractor will submit to the Contracting Officer and then maintain throughout the course of the contract, a list of all prime contractor employees (applicant) and subcontractor employees (applicant) who are required on the project using the form:

Requesting Official (RO) Contractor Approval List. (Note: Submission of the RO list will trigger GSA to provide HSPD-12 and e-Qip training for the prime contractor.)

b. The Contractor Information Worksheet (CIW) (form GSA850) will be submitted by GSA to the prime contractor after prime contractor has received HSPD-12 and e-Qip training. (Note:

The prime contractor must designate a Point of Contact (POC) on the CIW.)

c. Each applicant for the HSPD-12 compliant Tier 1 credential will complete section 1 of the CIW and return the CIW to the POC. The POC is responsible to submit all completed CIW's via email to zonec-hspd12@gsa.gov. (Note: applicants for the Tier 1 credential will not be eligible for escort during credential processing.)

d. The applicant will then receive an email that will invite them to apply to e-QIP, and they will also receive an email with an invite to an enrollment appointment.

mailto:zonec-hspd12@gsa.gov

e. The applicant must complete the enrollment appointment before completing e-Qip.

f. Following the instructions in the invitation to apply to e-Qip email, the applicant will log into e-Qip and complete a background history questionnaire.

g. As per the instructions in the invitation to apply to e-Qip email, the applicant is also required to complete the Declaration for Federal Employment OF-306.

(Note: Digital signatures are not accepted, all questions must be checked, answered, or marked NA. The completed OF-306 must be signed, scanned into a PDF and uploaded to E-Qip.)

h. As per the instructions in the invitation to apply to e-Qip email, the applicant is also required to complete the Authorization to Obtain Credit Report 3665.

(Note: Digital signatures are not accepted. The completed 3665 must be signed, scanned into a PDF and uploaded to E-Qip.)

i. After completing steps e-h above, the applicant is required to certify that their answers are true, electronically sign and submit the e-QIP application.

j. Office of Mission Assurance (OMA) will notify the applicant directly if any errors occurred when completing the e-QIP application.

(Note: Failure to respond to these messages will result in delay of their Tier 1 or termination of e-Qip.)

k. A contractor Enter on Duty (EOD) email will be received by POC and applicant upon clearance adjudication.

l. Upon completion of HSPD-12 credential processing, the applicant will be notified by email that an appointment will need to be scheduled for the HSPD-12 credential pick up and activation.

b) Escort Procedures

i) A HSPD-12 credentialed contractor may escort up to five (5) non-cleared individuals to access GSA-controlled facilities.

ii) Escort procedures are limited to individuals needing site access for no more than fifteen (15) consecutive days.

iii) A contractor may be escorted for a total of fifteen (15) cumulative days, on either a single day or multiple day escort, per six (6) month interval, per escorted individual.

iv) Individuals in the process of obtaining the HSPD-12 credential will not be eligible for escort during the HSPD-12 adjudication period.

v) Procedures:

a. Persons being escorted must be added to the Requesting Official (RO) Contractor Approval List.

b. A current CIW for the escortee must be submitted with the updated Requesting Official (RO) Contractor Approval List by the POC.

c. The POC is responsible to submit changes to the Requesting (RO) Official Contractor List to the Requesting Official (GSA POC).

d. The POC is responsible to submit the escortee CIW no later than three (3) business days in advance of the escort date, via email to zonec-hspd12@gsa.gov.

EVALUATION

Basis for Award GSA anticipates awarding a fixed-priced, task order to one quoter for this project. Vendors should have experience implementing upgrades to/installing building automation systems.

The Government’s intent is to evaluate the submitted quotes against the criteria set forth below and then make award based on best value.

Selection will be made in accordance with 15.404-1, Proposal Analysis Techniques, with initial response requirements for the RFQ outlined below. Contractors will be selected based on affirmative responses received to this RFQ and the technical experience, past performance, and price component criteria stated herein.

The RFQ will be evaluated with the objective of selecting the proposal that offers the best value to the Government. Since this approach provides the opportunity for cost/technical tradeoffs, the award will not necessarily be made to the lowest priced offer.

(a) The Government will award an order resulting from this Request for Quote to the responsible quoter whose quote conforming to the Request for Quote that represents the best value to the Government, price and other factors considered. The following factors shall be used to evaluate offers.

1. Volume I - Technical

• Factor 1 – Targeted Experience

• Factor 2 – Vendor and Technician Certification & Warranty support acknowledgement

• Factor 3 – Past Performance Questionnaire

2. Volume II - Price Quote

• Factor 1 – Price Submission Sheet

All evaluation factors other than cost or price, when combined, are more important than price.

The anticipated award will be made to the Contractor providing the highest demonstrated technical capabilities with capacity to perform the work on schedule, and who proposes a reasonable and realistic price when compared to the other proposals. Price is always evaluated and price rises in importance when technical experience, and past performance merit among the quotes becomes more equal. The Government intends to make an award based upon initial proposals received from Contractors without discussions with Contractors. Quoters are advised to submit their best price and technical quotes in the initial submission; however the right to hold discussions is reserved.

A detailed review and evaluation will be performed on each response submitted as a result of this RFQ.

The government will “down select” to one contractor whose response is determined to offer the best value to the Government.

The government reserves the right to reject any or all submissions if such action is in the Government’s best interest.

A written notice of award or mutual acceptance of a quote, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the quote shall result in a binding order without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of an quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

NOTE: The Government anticipates selecting an awardee based upon initial quotes received.

Technical Experience

Factor 1 – Targeted Experience Each contractor shall identify and describe their experience as a BAS contractor as it relates to the property types and desired outcomes as described herein. Experience must be for projects in which the project has been completed and accepted in the past three (3) years – projects that were completed and accepted more than three (3) years ago will not be considered. (Provide only projects where construction was completed and accepted no earlier than March 2016.)

Provide a minimum of three (3) and no more than five (5) projects that are of similar size and scope to the project described in this RFQ. Contractor experience as both a prime and subcontractor will be considered. Provide a concise summary of each project, outlining the “Project Information” and relevant “Targeted Experience” topics addressed below. The summary provided will be used to determine relevance. Ensure each project summary is identified separately. The response to the “Technical Experience” volume is not to exceed ten (10) single-sided pages.

Project Information

• Building Owner and Project Location

• Date of the contract or task order award; scheduled construction completion date; actual completion date; if not completed on time, provide an explanation as to why.

• Building Type (i.e., office buildings, warehouses, data centers, etc.)

• Brief description of the facility (i.e. square footage, approximate age and occupancy)

• Note whether the building was/was not occupied during any project phase

Targeted Experience While not every project example must capture all “targeted experience” bullet points below, in summation, the selected project examples must cover all of the following:

• Experience working with CSI I/NET BAS controllers

• Experience working with CSI I/NET 7 workstation software

• Experience working with Schneider Electric EcoStruxure product line:

o Experience using the Automation Server product o Experience integrating CSI I/NET

• Experience implementing BACnet (ASHRAE Standard 135) solutions

• Experience utilizing IT infrastructure and is familiar with GSA cybersecurity policies and requirements

Factor 2 – Vendor and Technician Certification & Warranty support acknowledgement Vendor must provide proof that they are a certified/authorized Schneider Electric EcoStruxure dealer/distributor. Vendor must also show proof that all technicians that are to work on the project are Schneider Electric factory trained.

Furthermore, vendor must acknowledge that they are capable of remote support via R8 virtual server and Vendor must acknowledge that they will be capable of on-site support within 24 hours during performance and warranty period.

Price Component Quoters shall submit a Firm-Fixed Price Quote, utilizing the Pricing Form named “Attachment J - ND- BAS Upgrades Pricing Template.xlsx”, for all work described in the RFQ package to include the

SOW.

The pricing form shall be in MS Excel Format. Missing or incomplete pricing data in the Pricing Form may result in the quote no longer being considered, or downgraded.

The quoted discounts will apply for the entire period of performance to include all locations.

Past Performance Past performance evaluations assess the degree of confidence the Government has in a contractor’s ability to successfully perform requirements.

For each project identified in Experience, above; a separate past performance information form shall be completed; form found at the bottom of this RFQ. The contractor shall complete section 1 of the attached form, and the contractor’s reference(s) shall complete section 2. Past Performance Questionnaires are not included in the ten (10) page count limit. Completed past performance information forms shall be sent directly to the contracting office (Felipe Jolles, felipe.jolles@gsa.gov) by the past performance reference. The deadline for submission is June 17, 2019 at 4:00PM MDT.

Past performance information received directly from the proposal respondent will not be accepted for evaluation, nor will past performance information received after the response deadline. It is the responsibility of the contractor to communicate with their references to ensure that the past performance information has indeed been successfully submitted to

GSA.

EVALUATION CRITERIA AND QUOTE SUBMITTAL INSTRUCTIONS

The quoter shall submit two separate volumes electronically:

1. Volume I - Technical

• Factor 1 – Targeted Experience

• Factor 3 – Past Performance Questionnaire

2. Volume II - Price Quote

• Factor 1 – Price Submission Sheet

Volume I – Technical Factors Evaluation Criteria:

GSA evaluators will be using the following guidelines to evaluate each component of “Factor 1 – Targeted Experience”:

Significant Strength: The Offeror demonstrates excellent understanding of requirements and approach and meets or exceeds requirement. The Offeror has exceptional strengths and there are no significant weaknesses or deficiencies.

Significant Weakness: The Offeror demonstrates a suboptimal understanding of requirements and/or proposes an approach or response that does not meet requirements.

Unacceptable Components: The Offeror fails to meet performance or capability standards and the requirements are not likely to be met. There are numerous weaknesses and deficiencies. The risk of unsuccessful performance is high.

GSA Evaluators will then give an overall score to the “Factor 1 – Targeted Experience” section:

RATING DESCRIPTON

3 The proposal meets and exceeds the criteria set forth in “Factor 1 – Targeted Experience

2 The proposal meets the criteria set forth in “Factor 1 – Targeted Experience

1 The proposal does not meet the criteria set forth in “Factor 1 – Targeted Experience

“Factor 2 - Vendor and Technician Certification & Warranty support acknowledgement” will be scored on a pass/fail basis:

• Vendor proof of being a certified/authorized Schneider Electric EcoStruxure dealer/distributor

• Proof that all technicians that are to work on the project are Schneider Electric factory trained

• Acknowledgement of capability to remote support via R8 virtual server

• Acknowledgement that they will be capable of on-site support within 24 hours during performance and warranty period

GSA Evaluators will then give an overall score to the “Factor 3 – Past Performance Questionnaire” section:

RATING DESCRIPTON

3 Adequate references were provided; all references provided a favorable evaluation indicating excellent past performance on all projects.

2 Adequate references were provided; most references provided an above average evaluation indicating very good past performance on most projects.

1 Some references were provided; references provided an unfavorable evaluation indicating poor past performance on most projects.

Volume II – Price Quote Evaluation Criteria:

After the technical evaluations are complete, the evaluation team shall rank the Acceptable proposals in order of lowest to highest price. Starting with the lowest priced quote, the reviewers will evaluate the Pricing Worksheet. A proposal may be rejected at this point if:

• The Government determines that the proposal prices are significantly unbalanced. A proposal price is unbalanced when the proposal is based on prices significantly less than the cost for some work and/or significantly overstated for other work.

• The Government determines that the proposal price is not fair and reasonable. Factors contributing to this determination include historical pricing data and currently available pricing in other venues.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers must be submitted by email. As a minimum, offers must show --

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers;

or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified.
