NOTICE CONCERNING SOLICITATION

GENERAL SERVICES ADMINISTRATION’S MISSION

The mission of GSA is to deliver the best value in real estate, acquisition, and technology services to the U.S Government and the American people.

AFFIRMATIVE PROCUREMENT PROGRAM (APP)

The General Services Administration (GSA), as a Federal procuring agency, is required to procure and use products containing post-consumer content (recycled material) by the Resource Conservation and Recovery Act (RCRA), Section 6002, Executive Order (EO) 13101, "Greening the Government Through Waste Prevention, Recycling, and Federal Acquisition” and EO 13148, “Greening the Government thru Leadership in Environmental Management.”

EO 13101 also requires Federal agencies to procure and use environmentally preferable and bio-based products.

RCRA Section 6002, EO 13101 and Office of Federal Procurement Policy (OFPP) Letter 92-4 require Federal agencies to develop and implement an Affirmative Procurement Program (APP) to facilitate the procurement of these products.

FAR 23.7 require consideration of environmental factors when purchasing products and services.

Note that FAR 4.303 and FAR 52.204-4 require double sided printing on recycled paper for all reports required by this contract. Also, note FAR 52.223-10, which encourages vendors to practice waste reduction.

QUALITY CONTROL PLAN (QCP)

The Contractor shall establish and implement a complete QCP to ensure the requirements of the contract are met.

The QCP is a written document that specifies a system for determining whether or not contract and/or position description requirements are being met and identifying and correcting deficiencies before the level of performance becomes unacceptable.

The QCP is a living document and may be subject to change depending on the needs of the contract. The Contractor shall be obligated to adhere to the QCP. The QCP will be utilized by the Government to effectively assess the Contractor's performance and ensure that the services performed meet contract standards. The Contractor is required to provide an updated QCP to be approved by the CO or their designee not less than annually. The contractor shall also update the QCP if the contract is modified to the extent where a change in the QCP is necessary.

The Contracting Officer’s Representative (COR) must accept a completed QCP prior to the notice to proceed. The QCP will be specific to the contract specification and location(s) in accordance with the provisions and requirements of the solicitation. The QCP must include a Virtual Oversight Plan (VOP) and Strike Contingency Plan (SCP).

VIRTUAL OVERSIGHT PLAN (VOP)

Due to telework becoming increasingly popular in the post-pandemic hybrid work environment, offerors shall submit their VOP as part of their technical proposal. The VOP should describe the basic procedures for monitoring, communicating with, and disciplining remote workers. Due to IT concerns, third party remote work software will not be allowed under this contract. Therefore, offerors must develop and enforce their own in-house VOP.

STRIKE CONTINGENCY PLAN (SCP)

The Contractor shall prepare a SCP to be used in the event of a strike by their employees. The SCP shall be submitted to the CO or their designee 5 calendar days prior to the contract’s start date and updated annually. At a minimum, the SCP shall include the following information:

Support Personnel: The SCP shall describe in detail how the Contractor shall staff the building to provide the services defined in this specification in the event of strikes by his employees. The Contractor shall keep HSPD-12 requirements and time frames in mind when preparing this plan.

Training and Certifications: The SCP shall describe in detail how the Contractor shall provide personnel that meet experience requirements, assuring the Government that all temporary or replacement employees (including the sub-contractor’s employees) shall meet the experience and certification requirements defined in this contract

SHALL vs. MUST Throughout this solicitation, the terms “shall” and “must” are used. “Shall” and “must” denote the imperative. They indicate an obligation to act. In this solicitation, and any resulting contract, “shall” and “must” have the same meaning.

NOTE TO OFFERORS

Submit questions to: thomase.prince@gsa.gov no later than 2:00 P.M. CST on February 23, 2023. Questions received after the cutoff date/time will not be answered.

Submit proposal to: thomase.prince@gsa.gov no later than 2:00 P.M. CST on March 15, 2023.

Proposals will only be accepted via email. One email shall contain the technical proposal and the price proposal.

PART I - THE SCHEDULE PART II - CONTRACT CLAUSES

SECTION B - Supplies or Services and Prices B.1 - Description of Services

The Contractor shall provide all labor and supervision necessary to deliver the variety of administrative and professional support classifications described herein at various locations in the Heartland Region. Services are currently being provided at each of the locations listed below:

Kansas City, Kansas Kansas City, Missouri (majority of contract work) St. Louis Metropolitan Area Topeka, Kansas Des Moines, Iowa Omaha, Nebraska Lincoln, Nebraska Other areas in the four-state Region as determined by the Government

B.2 - Schedule of Services The Government anticipates an award including four (4) one-year option periods. The base period may range from three (3) months to twelve (12) months. The current base period and start date for the new contract is unknown but is anticipated to start October 1, 2023. This schedule of services will be updated, via amendment, with set dates prior to the close of the solicitation period.

Due to funding limitations, the Base Period is subject to change or reduction. Subsequent Option Periods will be effective for 12 months from the end of the base period. The Government reserves the right not to exercise option periods if it it’s determined to be in the best interest of the Government.

B.3 - Offer for Services Please insert a fully loaded per hour price for each position classification in the Excel Spreadsheet title “Section B – Bid Sheet. The stated rates shall be fully loaded to include labor, supervision, health and welfare benefits, sick leave, vacation benefits, payroll taxes, profit, overhead, general & administrative (g&a), and any other expenses. The Government reserves the right to order classifications at a later date. Such position classifications will be added via modification and negotiated at time of inclusion. Failure to submit a per hour price for all classifications for the base period and all option years will render your proposal non-responsive and will not receive further consideration for award.

It is the responsibility of the Contractor to ensure they build into their proposal price the necessary costs it will take to meet the performance standards specified.

Offeror should note that not all position classifications appear on a Wage Determination. With this, the solicitation will separate positions into two separate classifications of positions:

a. Professional Positions (those not appearing on a Wage Determination)

b. Service Contract Labor Standards (SCLS) Positions (those where prevailing wage rates are provided within the Wage Determination)

The Government has identified the SCLS classification for each SCLS covered position under this solicitation, these classifications must not be altered by the Offeror. Proposing base hourly rates (take home rates) and/or health and welfare rates for SCLS positions lower that the minimum rate identified in the applicable Wage Determination will result in an automatic rejection of the proposal by GSA, and the proposal will not be further evaluated.

The Government anticipates ordering 2,080 hours for each full time position required under this contract. The GSA Form 300 (task order) or SF30 (modification) will specify GSA's requirement, if different. The contractor will be compensated only for all actual hours worked plus observed holidays (if the employee is normally scheduled to work on the holiday). The contractor will not be compensated for hours that employees do not work for scheduled leave, vacation, illness, etc. The contractor shall account for these costs in their fully burdened hourly rates.

B.4 – Professional Position Fringe/Compensation Benefits Offerors shall provide benefits in accordance with standards set forth in the Service Contract Labor Standards Act (formerly known as the Service Contract Act) to all professional positions ordered under this contract. Although benefits for professional positions are not included under the SCLS, offerors shall provide benefits to the professional positions that is equal to, or better than, the required SCLS fringe benefits. Offerors must account for the inclusion of these benefits in their price proposal. Failure to identify associates costs for these professional position benefits will result in an automatic rejection of the proposal by GSA, and the proposal will not receive further evaluation.

Please note, any escalation in the applicable Wage Determinations will not result in a comparable escalation for professional positions. Example, a health and welfare increase from $4.41 to $4.51 would allow a contractor to propose a request for equitable adjustment on the SCLS covered positions, but not on the professional positions under this contract.

B.5 – Market Research for Professional Positions Market research for salary and fringe benefits must be provided for all professional positions proposed under this solicitation. Failure to provide salary and fringe benefit market research may result in your proposal being removed from further consideration for award

B.6 – Proposed Base Wages for All Positions Contracted staff must be paid as their base hourly rate no less than the amount identified in the “Base Hourly Rate” column of the Bid Sheet and any later contract modifications that impact this rate. The Government reserves the right to review payroll data to verify hourly wage rate. Contractors found to be paying under the “Base Hourly Rate” will be required to pay that rate, including any required back pay, and will be fined a 10% penalty based on the total underpayment.

B.7 - Pricing of Option Periods:

When pricing option periods, Professional Positions shall be priced inclusive of escalation. These prices will be used for the duration of the contract and shall not change unless there is a change in the scope of work. If there is a change made to the scope of work, the contractor will be allowed to submit a request for adjustment in price.

When pricing the base and option periods, SCLS Positions shall be priced without escalation. SCLS Positions shall be priced in accordance with the prevailing wage rates in the respective wage determination for each location.

Offerors shall base their prices for the Base Year and all four (4) Option years off the wage rate provided with the solicitation and any applicable solicitation amendments, and then include applicable payroll taxes, profit, overhead, General and Administrative (G&A), and any other expenses.

In the event the option(s) is exercised by the Government, the contract price(s) can be adjusted upward or downward at the time the option is exercised in accordance with the clause entitled "52.222-43 Fair Labor Standards Act and Service Contract Labor Standards Act - Price Adjustment (Multiple Year and Option Contracts)".

Offerors are cautioned that any offer may be rejected as non-responsive if it is materially unbalanced as to prices for the options and the initial contract period. An offer is unbalanced when it is based on prices which are significantly less than cost for some work or prices which are significantly overstated for other work.

B.8 - Price Sheets (Return the completed Excel price sheets below with your Price Proposal) The estimated numbers of positions are given below for offeror’s reference in understanding the magnitude of the contract at the time of issuance of solicitation. This number may change at any time and does not represent a guaranteed minimum or maximum. Additionally, the Government reserves the right to alter the number of positions at any time throughout the life cycle of the contract.

This worksheet must be used to submit your pricing. Submission of any other worksheet will result in the proposal being deemed non-responsive to the solicitation and the proposal will receive no further consideration. Some cells are purposefully locked and are not to be edited. With the exception of locked cells, the Price Sheet must be completed for all positions and for all geographic locations. Failure to completely fill out the Price Sheet will result in the proposal being deemed non-responsive to the solicitation and the proposal will receive no further consideration.

While offerors are not prohibited from proposing an initial escalation in these fixed amounts (i.e. an increase from the Base Period to Option Period I to Option Period II, etc), the Government will not adjust these fixed dollar amounts upwards or downwards in the event of a price escalation in accordance with FAR 52.222-43(e). The proposed dollar amounts for these costs will remain fixed for the duration of the contract.

B.10 Part-time Employees The Government reserves the right to order less than full time employees.

B.11 Overtime Overtime may at times be required under this contract. A separate order or modification will be issued when overtime is necessary and will be compensated on an hourly rate basis. Overtime is not authorized, and will not be paid, unless prior authorization is received. Offerors shall provide an overtime hourly price in the price sheets.

SECTION C - Description/Specification/Statement of Work

C.1 - General Information and Background The General Services Administration is a federal agency whose Heartland Region is headquartered in Kansas City, Missouri at Two Pershing Square, 2300 Main Street, Kansas City, Missouri, 64108. The Heartland Region consists of four states; Missouri, Iowa, Nebraska and Kansas. The contractor employees provided under the contract will work side-by-side with other federal workers; however their roles will be non-inherently governmental in nature.

The Contractor will be required to provide all management, supervision and manpower to provide services as specified in the contract. The Government shall determine the resource allocations.

The support provided under any purchase is not related to Federal employment requirements nor does it involve temporary help services that may be authorized under 5 CFR Part 300. There is no direct employee-employer relationship between the contractor employees and the Federal Government under any purchase.

The Government anticipates awarding a single award Indefinite Delivery, Indefinite Quantity, contract for these services. Services will be either awarded on a separate GSA Form 300, Standard Form 30 (SF30), or via the GSA purchase card and will specify the quantities/services required at that time.

C.2 - Days and Hours of Operation Days of operation are Monday through Friday. Work shall not be required on the following Federal holidays or on days observed in lieu thereof:

New Year’s Day, Martin Luther King Day, Presidents Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day

Holidays that fall on Saturday are observed on the previous Friday. Holidays that fall on Sunday are observed on the following Monday. For all positions, the contractor will be paid for all Holidays if they are normally scheduled to work on that day.

In general, contractor employees are expected to work the hours of 8:00 a.m. – 4:30 p.m., which includes a 30-minute lunch. These hours may be flexible with coordination of the GSA Point of Contact and Contracting Officer and/or COR. GSA core hours are 9:00 a.m. - 3:00 p.m., meaning during these hours employees must be in attendance.

Contractor employees should not begin work before 6:00am or work beyond 6:00pm, unless coordinated with the GSA Point of Contact and Contracting Officer and/or COR.

Contractor employees should not work in excess of 10 hours per day unless coordinated with the GSA Point of Contact and Contracting Officer and/or COR.

Contract employee positions, with the exception of the Project Manager, are not required to be backfilled when the contractor filling that position takes leave (ex. vacation leave, sick leave, etc.). If the period of leave exceeds two weeks, then the Government reserves the right to request a substitute to fill that position.

Each GSA Form 300 or SF 30 will specify the hours of operation if they differ from the above.

C.3 - Unanticipated Federal Holidays Unanticipated holidays declared by the President will be treated as a Federal Holiday. For all positions, the contractor will be paid for any unanticipated federal holiday if they are normally scheduled to work on that day.

C.4 - Unanticipated Building Closures/Shutdown In the situation in unanticipated closure of the building, employees may be provided the option to make up work through the remainder of the pay period or work in a telework arrangement for the day of building closure, as coordinated with the Government.

If a contract employee is located in a building in which is provided an “optional early dismissal” (typically weather related), the contract employee shall be provide the following options: take leave without pay, leave the building and make up work throughout the remainder of the pay period, use leave provided by contractor, work in an alternative telework arrangement or continue to work as normal.

C.5 - Congressional Appropriation of Funds In the event Congress fails to appropriate funds, contract employees, on a case-by-case basis, may be required to work. The Contracting Officer will notify the contractor in regard to which positions will be required to work in a Government “shutdown.” The contractor will not be paid for contract employees who do not work during a “shutdown.” The contractor will be paid for employees whom do work in a “shutdown” situation.

In this event, a stop work order will be issued by the Contracting Officer for those contract employees who are not required to work, in accordance with FAR 52.242-15, Stop Work Order.

C.6 - Telework At the Contractor's discretion, employees under the contract may be eligible for telework. Permission for an employee to telework can only be granted by the Contractor's Project Manager/Supervisor. Permission to telework shall only be granted if the telework arrangement does not prohibit any normal work activity or services provided to the Government. The contractor shall develop a telework agreement and provide to the COR for comment and approval. Within the telework agreement, at minimum:

The contractor shall maintain and provide to the Government a listing of their employees expected telework schedules (including days and hours).

Ensure employees acknowledge that there may be situations when they will be required to report to an agency worksite during an otherwise planned telework day.

Ensure when an employee is teleworking, they are fully accessible as if they are working in an office setting.

Maximum response times to business-related communications during normal business hours.

Provide that employees will comply with requirements set forth by the Safer Federal Workforce Task Force and

GSA Safer Federal Workplace.

The Labor Position Telework Categorization Table in Section J outlines the maximum number of telework days every 2 weeks, which will be determined by the contract employee’s position. Limited exceptions may arise and will be communicated by the Government.

As noted, telework will generally not be determined by the individual employee but by their Position Description and types of activities required of the position. Customer facing positions or positions which inherently require on-site presence will generally be On-Site Required. Full-time virtual positions, in general, will not be allowed and must report to their designated office.

Project Manager:

Project Manager in office presence is required at minimum 5 days every two weeks and should typically align with employees’ in-office presence. The project manager shall report to their designated office as much as feasible and make a good faith effort to attend all GSA meetings in-person.

Allowable Deviations The Government reserves the right to, at any time, remove all telework privileges from any or all positions.

When extenuating circumstances exist, the Government may consider deviations from categorization and telework limitations on a case-by-case basis.

Position categorization does not prevent a POC from requesting less telework for individual contractor employees (i.e. Field Office Admin Staff).

Telework schedules can be changed weekly as required to meet the Government’s needs and required activities in coordination between the Project Manager, Government POC and COR

C.7 - Project Manager(s)/Supervision The Contractor shall provide full time supervision (see C.6 for onsite requirements) to assure conformance with the contract requirements. Not less than one person shall fulfill this role and will be referred to as the Project Manager of the contract. The contractor may provide additional supervision if they deem necessary.

The Project Manager will be required to travel to all locations where contractor employees are located at a minimum of once per fiscal quarter. These trips will not be paid for by the Government. They shall be included in the contractor’s overhead. Additionally, since the Project Manager is considered overhead, Government Owned Vehicles may not be used by the Project Manager.

Other responsibilities of Project Manager(s):

(a) Project Manager is the individual with overall responsibility for personnel working under this contract.

(b) Project Manager may be responsible for assignment of work to their contractor employees in coordination with the GSA point of contact.

(c) Shall coordinate with the Government Point of Contact work hours of employees under the contract, start/stop delays, telework arrangements, workspace set-up

(d) Shall coordinate with PBS Security team the processing of security clearance for employees under contract as well as removal of employees (collecting of badges, escorting from building, obtaining Government issued equipment, etc.)

(e) Keep the Contracting Officer and COR informed of job changes/movement of employees

(f) Promote healthy culture and work environment

(g) Ensure GSA customer needs are met

(h) Have authority to sign modifications to task orders and base contract.

(i) Disseminate information to contract employees regarding building closures, inclement weather, suspension of performance, etc.

(j) Ensure contract employees’ security clearance(s) are maintained and active throughout the life of the contract.

When the Project Manager is temporarily unavailable to manage the contract effort for a period longer than 48 hours, including absence due to vacation or illness, the Contractor will provide to the CO and COR a written designation of an alternate supervisor, itemizing any limitations in the alternate’s authority. Furthermore, the Project Manager shall carry a mobile device during working hours to be reached when needed and must be available within 2 hours of contact after normal business hours. The PM must work a minimum of eight hours per day and these eight hours must be between 7:00 am CST and 5:00 pm CST. The PM shall not telework more than 5 days every two weeks unless approved in writing by the CO and/or COR.

C.8 - Supervision of Contractor’s Employees In accordance with the Federal Acquisition Regulation (FAR 37.104) this contract may not be used to provide personal services. GSA’s contract administration and monitoring will not be detailed or continual as to constitute supervision of the contractor personnel. Government personnel may not perform any supervisory functions of contractor personnel. The contractor/Project Manager will be responsible for interviewing, appraising individual performance, scheduling leave or work, or providing direction on how to perform work for contract employees.

The contract personnel assigned to render services shall at all times be employees of the Contractor and under the direction and control of the Contractor. Notwithstanding any other provisions of this contract, the Contractor shall at all times be responsible for the supervision of its employees in the performance of the services required. At no time shall the Contractor personnel be considered employees of the United States Government.

C.9 - Timesheets and Timekeeping In accordance with FAR 16.601(c)(1), appropriate Government surveillance of contractor performance is required to give reasonable assurance that efficient methods and effective cost controls are being used. As part of the Government’s surveillance, the Government has determined it is necessary to require certain timekeeping controls and, as a result, will require the successful offeror to comply with those timekeeping system requirements. If offeror utilizes subcontractor(s) in fulfilling the contract requirements, the contractor and all subcontractor(s) must employ the same time keeping system proposed herein.

The proposed timekeeping system for each contractor/subcontractor must meet the following criteria:

System must provide for automated time-stamp generated upon either (1) contractor employee arrival/departure to/from duty station or (2) login/logout using a Non-Government hosted web-based timekeeping system located at employee duty station. System shall allow for recording a minimum, of four

(4) time-stamps each day (i.e. - arrival, leave for lunch, return from lunch, departure) System must provide for controls disallowing employees to manually enter time or override automated time-stamp.

System must possess controls that disallow any contract employee from making an arrival/departure or login/logout entry for anyone other than themselves (i.e. - biometric controls, passwords, etc) System must notate if the hours logged are fulfilled in office or in a telework capacity.

Any discrepancy of time must be notated on the time sheet. Any time in excess of 10 minutes must be highlighted and approved through the CO/COR.

Hours must be broken out by regular hours, holiday, sick, vacation or any other approved leave.

System must track available sick and vacation hours and present an updated total for each staff member.

System must provide for Project Manager override of the system time-stamps. (This will only be allowable in certain instances when approved by the CO and/or COR).

System must not require installation, interface, or maintenance with Government technology or resources.

System must be able to record time in increments equal to one (1) minute.

The timekeeping system must be able to generate a monthly time sheet (using the Arrival/Departure or

Login/Logout data as recorded via automated time-stamp) for each contract employee which includes, at a minimum, the following information:

o For each day of the month

1. Start Time (Beginning of Workday)

2. Stop Time for lunch

3. Start Time after lunch

4. Stop Time (End of Workday)

GSA will pay for the cost of training. Less formal training or activities may be attended by Contractor employees at the discretion of the CO and/or COR.

Cell Phones The Government reserves the right to issue Government cell phones to contract employees. They will be issued solely at the Government’s discretion and approval and shall not be used for personal use.

Fines imposed on a contractor employee for an offense committed by him or her are imposed on the employee personally or payment thereof is his or her personal responsibility.

The Contractor shall provide insurance coverage as stated below for use of GOV’s:

The Contractor shall provide and maintain workers, employer's liability, comprehensive general liability (bodily injury), comprehensive automobile liability (bodily injury and property damage) insurance, and such other insurance as the Contracting Officer may require under this contract.

(a) The Contractor shall be liable for, and shall indemnify and hold harmless the Government against, all actions or claims for loss of or damage to property or the injury or death of persons, resulting from the fault, negligence, or wrongful act or omission of the Contractor, its agents, or employees.

(b) The Contractor shall provide and maintain insurance covering its liabilities under paragraph (b) of this clause, in amounts of at least $200,000 per person and $500,000 per occurrence for death or bodily injury and $20,000 per occurrence for property damage or loss. This equates to at least $1,000,000 in automobile liability insurance in which proof must be submitted to the CO and/or COR. This automobile insurance coverage must include coverage for all Government Owned Vehicles that the Contractor may be authorized to use.

(c) Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the interests of the Government shall not be effective (1) for such period as the laws of the State in which this contract is to be performed prescribe or (2) until 30 days after written notice to the Contracting Officer, whichever period is longer. The policies shall exclude any claim by the insurer for subrogation against the Government by reason of any payment under the policies. The policy shall also list the United States of America as an additional insured under the comprehensive automobile liability insurance policy.

All travel costs will be placed on a separate task order, modification, or the vendor shall accept the Government purchase card as reimbursement after the travel has occurred. Since the travel reimbursement process may take several days or weeks, the contractor shall issue their own travel card to their employees. That way, the contractor covers the initial travel costs instead of the individual employee.

The contractor will be responsible for enforcing their own policy for using the travel card. The Government is not liable for covering unapproved travel expenses incurred on the contractor’s travel card.
