MAXIMUM ORDERING LIMITATIONS

GUARANTEED MINIMUM

The guaranteed minimum amount under the proposed contract is $2,000 for the base year of each contract. If the awardee does not receive an order, or several orders, totaling $2,000 or more during base year of the contract, the Government will be obligated to pay that awardee the guaranteed minimum amount of $2,000.

Failure to submit a proposal in response to any Request for Proposal (RFP) issued during the base year, in accordance with the terms and conditions of this contract will result in the contractor's forfeiture of this guaranteed minimum amount.

METHOD OF PLACING TASK ORDERS UNDER THIS CONTRACT

(a) The Contracting Officer/Ordering Official (CO) shall provide each awardee a fair opportunity to be considered for each Task Order (TO) in excess of $2,000. TO’s that do not exceed $2,000 may be placed with any contractor after a fair and reasonable price determination.

(b) Upon identification of a requirement, the CO will make a determination as to whether the project will be awarded using the pre-priced line items or whether the action will be competed among the awardees. In each instances, the CO will also determine whether nonprice (i.e. technical) factors will be considered in the placement of the order. Non-price factors

PREPROPOSAL CONFERENCE Page 4 of 5 may include, but are not limited to, past performance, experience, qualifications of key personnel, project management plans, or other factors that may be relevant for the task order.

c) The CO will issue a written Request for Proposal (RFP) or Request for Quote (RFQ) which shall include the following:

d) The Contractor is obligated to accept pre-priced work items when issued a task order.

e) Contractors are required to respond to all RFP’s to be performed in buildings specifically listed in this contract. In the event of a Contractor not bidding, response is still required with justification stating reason for “No Bid”.

f) Written Task Order – Contractors will be provided a signed copy of each task order, utilizing the GSA Form 300, when task orders are executed. Contractor may be required to countersign GSA Form 300 to acknowledge acceptance of the Task Order.

BASIS OF AWARD

The Government will award contract(s) resulting from this Solicitation to the responsible Offeror(s) whose offer conforming to the Solicitation will be the best value to the Government, Total Evaluated Price and other factors considered. In addition to Total Evaluated Price, as stated earlier the following non-price factors shall be used to evaluate offers:

1. Experience as a GC on Repair and Alteration Projects

2. Project Management Plan

3. Staffing Plan and Qualifications of Key Personnel

4. Past Performance as a GC on Repair and Alteration Projects

Non-Price Factors are weighed equally and when combined are significantly more important than Total Evaluated Price.

After rating each individual factor, an overall rating for each proposal will be calculated based on the table as shown in the

RFP.

GSA reserves the right to conduct interviews with short listed Offeror’s to clarify and/or confirm submitted information. If GSA determines interviews to be appropriate, they will likely be conducted, in person, after an initial review of the technical proposals.

TOTAL EVALUATED PRICE CALCULATION

The Government will evaluate offers for award purposes by following pricing procedures outlined in FAR 15.402, pricing policy. The Contractor must price all items for the Zones that they are interested in receiving an award for. The quantities included from the line items schedule page are not a representation to an offeror that the estimated quantity will be required or ordered.

Overhead and Profit percentage rates, and Project Manager and Superintendent hourly rates will be evaluated separately from the Total Evaluated Price (TEP) and either accepted or rejected at time of award.

Total Evaluated Price shall be calculated using the Proposed Percentage Factors indicated in the Price Proposal. The process of evaluation for the Base Year is described below. These procedures and calculations are repeated for each Option Year. Total Evaluated Price will be calculated in the following manner:

STEP 1: The percentage factor submitted by the offeror for the Standard & Non Standard Hour Prices will be added to 100% and that sum percentage will be called the Standard & Non Standard Hour Price Adjustment Percentage.

STEP 2: The Standard & Non Standard Hour Price Adjustment Percentage will be multiplied by the Standard Price Schedule Total. This result will become the offer’s “Adjusted Standard Hours Total Price” for the base year. The Standard

PREPROPOSAL CONFERENCE Page 5 of 5

& Non Standard Hour Price Adjustment Percentage will then be multiplied by the Non-Standard Price Schedule Total.

This result will become the offer’s “Adjusted Non-Standard Hours Total Price” for the base year.

STEP 3: The sum of the offeror’s “Adjusted Standard Hour Total Price” will be added to the sum of the Offeror’s “Adjusted Non-Standard Hour Total Price”. This sum will comprise the Offeror’s proposed price for the base year. This same calculation will be performed for each of the Option years. Each percentage factor submitted for Standard & Non Standard Hours for each Option Year will be applied to the Standard Price Schedule Total and Non-Standard Price Schedule Total.

STEP 4: This calculation will repeat for each of the option years using the percentage factor proposed for each option year. The Total Evaluated Price will be the sum of the Offeror’s Proposed Price for the Base Year plus the Offeror’s Proposed Price for all four (4) Option Years. If the offeror is bidding in more than one zone, they will receive a TEP for each zone for which they have proposed on. The Total Evaluated Price submitted for each zone will be evaluated exclusive from the TEP for any other zone.

EXAMPLE:

Part A - Government Supplied Information

STANDARD PRICE SCHEDULE TOTAL, BASE = $94,858.85

NON-STANDARD PRICE SCHEDULE TOTAL, BASE = $126,279.05

BASE ESTIMATE TOTAL $94,858.85 + $126,279.05 = $221,137.90

Part B – Offeror Supplied Information for Base Year The Offeror’s example percentage factor is plus 2% (+2%) for the work to be performed during Standard Hours & Non- Standard Hours for the Base Year.

Part C – Government Calculations for Offeror’s Proposed Price for the Base Year Step 1 – Standard & Non-Standard Hour Price Adjustment Percentage = 100% + 2% = 102%

Step 2 – Standard & Non-Standard Hour Price Adjustment Percentage * Standard Price Schedule Total = 102% * $94,858.85 = $96,756.03 = Offeror’s Adjusted Standard Hours Total Price

Step 3 – Standard & Non-Standard Hour Price Adjustment Percentage * Non-Standard Price Schedule Total = 102% * $126,279.05 = $128,804.63 = Offeror’s Adjusted Non-Standard Hours Total Price

Step 4 - Offeror’s Adjusted Standard Hours Total Price + Offeror’s Adjusted Non-Standard Hours Total Price = $96,756.03 + $128,804.63 = $225,560.66 = Offeror’s Proposed Price for the Base Year
