A) Paragraph II.B. of the Solicitation entitled Proposal Format is hereby changed to the following:
Offerors responding to the solicitation notice shall submit proposals in three (3) separate folders/documents, via email as well as hard copy.
1. Price Proposal, see section II.C.
2. Technical Proposal, see section II.D.
3. Other Documents as Required, see section II.E
Proposals will only be accepted in electronic format, via email, and one original hard copy. No disc or faxed proposals will be accepted. Offerors are to submit an email with the subject line: “PROPOSAL – IDIQ R&A”.
B) Paragraph II.E. of the Solicitation entitled Other Information to Submit with Proposal is hereby changed to add the following:
(4) Attachment D – Certification of Proposal
C) Paragraph II.D. of the Solicitation entitled Technical Proposal is hereby changed to revise non-price factor number one (1). Non-price factor number one (1) is replaced in its entirety as follows:
(1) Experience as a General Construction Contractor (GC) for commercial buildings on Repair and
Alterations Projects.
This factor considers the extent of the Offeror’s past experience as a GC on repair and alteration projects in commercial buildings. This factor will be evaluated on the Offeror’s presented projects in response to the RFP.
The Offeror must demonstrate successful experience as a GC responsible for the construction of at least seven (7) and no more than ten (10) repair and alterations projects that are completed or substantially completed within the past five (5) years of the closing date of this solicitation; current projects must be 75% complete by the closing date of this solicitation to be considered substantially completed. Projects can be federal, state, local, or private sector projects. Projects should demonstrate the GC’s ability to successfully complete a range of repair and alterations projects, of varying complexities and budgets.
Relevant repair and alteration projects are defined by the following characteristics:
● Total project construction cost at award was between $25,000 and $1,000,000;
● Project was performed in or around an occupied and functioning commercial building;
● Project required close coordination with property management and/or building occupants;
Projects within the dollar range stated above will be given preference over projects submitted outside the dollar range. A contractor may submit examples outside of the dollar range with which the Government will evaluate if they do not have the minimum number within the dollar range.
The offeror shall provide the following information for each of the projects:
1. Name and location of the project;
2. Detailed description of the project;
3. Type of building space (office, courtroom, judges’ chambers, server/IT space, etc.);
4. Project start and completion dates;
5. Construction cost at award and final construction cost at project completion;
6. A narrative description of the amount and type of work the offeror performed with in-house forces and the percentage of the work that was completed by subcontractors;
7. An explanation of Project Management techniques and the Quality Control measures that were used on the project. Provide a summary of issues that were encountered on the project and how they were resolved using the established Project Management techniques and Quality Control measures;
8. Name, title, address, phone number, and email address for building owner or representative of the owner who can attest to the services provided.
Complete one GC Experience Summary (Attachment A) for each project presented for this factor. The Attachment A form addresses most but not all of the information stated above. The offeror shall supplement the Attachment A form with the additional information needed not to exceed one (1), single spaced double-sided page, in 12 point Arial font and 1” margins. The offeror may also supplement the example with photographs or drawings but may not exceed the one (1) double sided page limit. The summary must be completed in its entirety in order for GSA to fully evaluate this factor. Lack of complete information may result in a project not being considered during the evaluation.
Standard for Evaluation:
1. At least seven (7) similar successful project examples have been submitted that demonstrate experience in delivering General Construction (GC) Services. These examples must have been completed within the last five (5) years of the closing date of this solicitation or if current must be at least 75% complete by the closing date of this solicitation to be considered substantially completed.
2. Each GC Experience Summary form should be completed in its entirety along with supplemental information. The similarity to this project is more important than the quantity of projects presented, however the offeror must have submitted at least seven (7) examples.
RATING DESCRIPTON
The proposal identifies at least seven (7) similar projects with adequate details that demonstrate significant, relevant experience.
The proposal identifies at least seven (7) similar projects with details that demonstrate fairly relevant experience.
The proposal identifies at least seven (7) similar projects with sufficient details that demonstrate somewhat relevant experience.
The proposal identifies less than seven (7) similar projects. Limited details are provided that demonstrate little relevant experience.

0 No project examples are identified in the proposal.
D) Paragraph II.D. of the Solicitation entitled Technical Proposal is hereby changed to revise non-price factor number two (2). The last sentence of paragraph two is revised to read as follows:
This factor will be evaluated based on the Offeror’s written response; the written response shall not exceed two (2), single spaced double-sided pages, in 12 point Arial font and 1” margins.
E) Paragraph II.E. of the Solicitation entitled Technical Proposal is hereby changed to revise non-price factor number three (3). The first paragraph is revised to read as follows:
This factor considers the Offeror’s staffing plan and qualifications of key personnel. This factor will be evaluated based on the Offeror’s written responses; the written response to demonstrate the staffing plan shall not exceed five (5), single spaced double-sided pages, including the organizational chart and the experience matrix, but does not include resumes. The written response shall be in 12 point Arial font with 1” margins. The organizational chart and experience matrix may be in any format the offeror chooses but must be contained within the maximum number of pages stated above.
The fourth paragraph is revised to read as follows:
Resumes shall be provided for key team member(s) filling roles 1-4. Resumes shall indicate currently held position/title, proposed project position/title, education, and qualifications. Do not provide more than nine (9) key personnel. Teams will have to prioritize and provide those that best represent your ability to accomplish the requirements of this contract. Executive personnel should not be submitted unless they will have direct responsibility for managing task orders under this contract. Resumes may be in any length and format and do not count towards the maximum five (5) single spaced double-sided pages response to this factor.
The sixth paragraph is revised to read as follows:
A matrix shall be provided that clearly identifies the work experience that each key team member has on the projects submitted under Factor 1. This factor considers the past performance of the Offeror. This factor will be evaluated based on the responses received from references. For at least seven (7) and no more than ten (10) of the projects identified in Factor 1; a separate past performance questionnaire shall be completed using Attachment B in this solicitation. References must have thorough knowledge of the Offeror’s performance on the project for the majority of the contract performance period; the quality of the reference information supplied will be considered. Past performance will be evaluated as a predictor of the offeror’s compliance with contract requirements and overall quality of performance. The offeror shall be responsible for disseminating and collecting the past performance questionnaires which shall be submitted with their electronic and hard copy proposal. The Government reserves the right to contact the references directly to discuss and/or clarify any and all information provided in the questionnaire.
G) Specification section 01 14 00 entitled Work Restrictions is hereby changed to revise paragraph 1.3 (A) regarding Government Occupied Hours to add the following sentence: Government Occupied Hours may vary slightly for some buildings, as such the scope of work for the individual task order requirement will identify the exact occupied hours for said project location if different from above.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.

* a survey underlying a wage determination

BUILDING CONSTRUCTION PROJECTS (does not include single family homes or apartments up to and including 4 stories).
Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.35 for calendar year 2018 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.35 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2018. The EO minimum wage rate will be adjusted annually.
Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the Davis-Bacon Related Acts, including those set forth at 29 CFR 5.1(a)(2)-(60). Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
