This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice.
This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
Solicitation 47PE0721Q0008 is issuing a Request for Quote (RFQ) for HVAC Cleaning
Services.
This solicitation document and incorporated provisions and clauses are those in effect through
Federal Acquisition Circular 2021-02.
Applicable Wage Determinations:
Wage Determination No: 2015-4543 dated May 01, 2020.
This is a Small Business set-aside under NAICS code 561790 - Other Services to Buildings and

CLIN 0001 HVAC Cleaning and Repair
Provide all labor, equipment and materials necessary to remove and replace all these equipment with the new equipment and to remove the dirt, debris, and particles that have accumulated in the outside air chase/ductwork, air handler units, ductwork, turning vanes, splitters, dampers, all surfaces within the associated duct work, supply diffusers, and return grilles.
CLIN 0002 Mold Remediation
All foreign materials such as dust, mold, soot, lint, hair, bacteria, and other air movement residues shall be removed from the area.
CLIN 0003 Pre-Alterations Survey
Perform a Pre-Alteration Asbestos Survey and Report in order to determine the presence of asbestos containing materials.
Estimated period of performance for this requirement is 22 February 2021 – 27 June 2021 at the
James L. King Federal Justice Building, 99 NE 4th Street, Miami FL 33132.
In accordance with FAR Provision 52.237-1 Site Visit, Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Site visit has been scheduled for 27 January 2021.
Starting time will be 9:00 am (EST). Please arrive early to pass through Security Checkpoint.
All attendees for the site visit will be required to wear masks. Social distancing will be in effect to the maximum extent practicable. Masks will not be provided by the Government.
Visitors without masks will not be permitted to tour the facilities.

1 PROJECT DESCRIPTION
The General Services Administration proposes the cleaning and limited replacement of existing ductwork and equipment related to the HVAC System located on the 1st through 12th Floors at the James L. King Federal Justice Building with all incidental and related work for a complete project ready for the use intended.
This is in order to mitigate the propagation of dust particles through the existing air vents with all incidental and related work for a complete duct cleaning operation ready for the use intended.
1.1 Project Type
This is a BA54 and BA61 Duct Cleaning project.
1.2 Project Goals and Objectives
GOALS:
The strategic Project Goals include the mitigation of dust particle through the existing ductwork and air vents and replacement of the old equipment with the new equipment as it is outlined in 5.2 Scope of services on the 1st through 12th floors.
OBJECTIVES:
Tactical Project Objectives include the proper preparation, labor and equipment to eradicate the dust particles passing through the existing ductwork system and replace and install all these new equipment.
1.3 Project Delivery Approach
Work sequence as coordinated with the GSA Facility Manager.
1.4 Reference Materials
Existing Facility Mechanical HVAC Drawings (To be provided under separate cover).
2 GENERAL REQUIREMENTS
The requirements set forth in this section apply to all stages and phases of the project as described in the Scope of Services section below.
Some of the requirements of this section may be subject to exercise of contract option(s).
2.1 Contract Parties and Contract Work
The parties to this contract are the Contractor, hereinafter referred to as the Contractor, and the United States Government. For purposes of this contract, the office representing the Government is the General Services Administration (GSA), Southeast Sunbelt Region 4, Public Buildings Service, hereinafter referred to as the GSA.
The individual authorized to act on the behalf of the GSA in the administration of this contract is the GSA Contracting Officer. The GSA Contracting Officer may delegate certain of his or her authorities to others, and if so, will notify the Contractor in writing of the specific authorities delegated to, and limitations placed upon, named authorized representatives. The Contractor shall not take any direction, or act upon any information, from individuals other than those having the requisite authority as confirmed by the GSA Contracting Officer’s written notification.
The specific activities, tasks, and deliverables required of Contractor are further delineated in this Performance Work Statement.
2.2 Professional Ethics and Standards of Practice
In the conduct of all activities required for or otherwise related to the performance of the contract work, the Contractor shall conform to and uphold all established ethical principles and professional standards of practice governing the industry.
2.3 Project Delivery Team Roles and Responsibilities
In the performance of the requirements of this contract, the Contractor shall work in concert with other parties on the Project Delivery Team. The Project Delivery Team will include other contractors, the GSA personnel, customer agency representatives, and other stakeholders. The GSA will develop, periodically update, and maintain throughout the course of the project, a listing of the Project Delivery Team membership and respective roles and responsibilities.
The GSA may engage other parties to perform specialized duties and requirements as appropriate for the project.
2.4 Owner’s Project Requirements (OPR)
The Construction Stage work under this Performance Work Statement must comply with the GSA owner’s project requirements (OPR) documentation provided in Appendix A.
2.5 Anticipated Schedule
Work to be performed outside of ‘Normal Government Working Hours’, during a weekend or during a holiday weekend. Phased performance to be coordinated with the GSA Facility Manager.
Whether performing cleaning or construction operations and existing furniture being covered up note that the affected areas on each floor will need to be restored back to an acceptable condition prior to the start of Government business next day that may include further cleaning or wiping of furniture and/or equipment.

2.6 Contractor Team
The Contractor shall provide sufficient staff to perform the required work.
2.7 Performance Objectives
2.7.1 Standards and Criteria Documents
2.7.1.1 Applicability
All services must be conducted in accordance with the documents listed below. The applicable version of each document shall be the version current at the time of award of this contract. In the event of a conflict between the requirements stated in these documents and requirements provided elsewhere in this Performance Work Statement, the requirements in the Performance Work Statement will prevail.
2.7.1.2 Document List
2.7.1.2.1 US. General Services Administration (GSA)
2.7.1.3 Waste Management Plan
A waste management plan shall be submitted prior to issuance of Notice-to-Proceed. The plan includes at the minimum the following requirements:
1. Describe strategies for minimizing waste
2. During project planning, include a bulk estimate in weight (tons) or volume (cubic yards) of waste diverted and anticipated weight/volume for materials going to landfill.
3. Anticipated recycling revenue: Shall be factored into contractor bid and contractor should provide an estimate of the recycling proceeds amount.
4. Final rates based upon weight (tons).
5. List of diversion facilities and disposal activities to be used. (Include name, location, and phone number)
2.7.1.4 Waste Management Monthly Reports
Contractors are required to submit a monthly waste management report that details the amount of C&D waste by material diverted/recycled as well as the amount sent to landfill on the project. These reports shall be submitted to the GSA PM and/or COR in electronic format.
2.7.2 Project Progress Meetings/Presentations
After project begins, the Contractor shall conduct weekly project progress meetings.
2.8 Record Keeping
The Contractor is responsible for preparing correspondence and other documentation and maintaining accurate and detailed records of the project's progress during each Phase. The Contractor is responsible to maintain records so as to facilitate document storage and retrieval. Refer to the Scope of Services section below for detailed requirements for project documentation.
3 SCOPE OF SERVICES
The Contractor shall perform all services described in this Scope of Services (including services required under exercised options, if any) in accordance with applicable requirements and provisions set forth in the General Requirements above.
3.1 Design Stage (Not Applicable)
No services required
3.2 Cleaning Stage
Upon receipt of notice to proceed with the Cleaning Stage work, the Contractor shall perform all services described in this section as a part of the Stage work.
3.2.1.1
3.2.1.1.1 Schedule of Values
Prepare and submit schedule of values for the GSA approval.
3.2.1.1.2 Inspections and Testing
Develop an overall field inspections and testing plan. (HVAC performance, etc.)
Conduct Construction safety (OSHA) inspections as required.
3.2.1.1.3 Clarifications/Requests for Information/Change Orders
Each must include a specific description of the issue requiring clarification, citing the specific related contract documents requiring clarification. RFI’s should only be submitted after performing due diligence to confirm that the contract requirements in question are in fact unclear or otherwise inadequate.
3.2.1.2 Turnover Process
3.2.1.2.1 Punch-List
After the GSA certification that the work or each designated portion thereof is substantially complete, assist the GSA in conducting a final inspection and preparing a punch-list documenting remaining work.
Participate with the GSA in conducting follow-up inspections to administer resolution of punch-list items, involving the tenant agencies and other stakeholders as appropriate.
3.2.1.2.2 Warranties, Guarantees and Certificates
Prepare and submit applicable warranties, guarantees, and certificates, ensuring that the GSA rights and responsibilities are clearly defined.
3.3 Closeout Stage
3.3.1 Final Project Photographs (Not Applicable)

Resolve all remaining punch-list items.
Submit release of claims.
4 ADMINISTRATION
4.1 Payment for Work
Refer to FAR 52.232-1 Payments and FAR 52.232-25 Prompt Payment.
5 APPENDIX A - Owner’s Project Requirements
Project must incorporate applicable requirements for use of biobased, rapidly renewable content, and recycled content materials as per the latest P100. Contractor to provide detailed report and certification as described in FAR 23.4 and 552.223-9 that the requirements have been meet.
1st through 12th Floors
5.1 GENERAL DESCRIPTION:
Project provides all labor, equipment and materials necessary to remove and replace all these equipment with the new equipment and to remove the dirt, debris, and particles that have accumulated in the outside air chase/ductwork, air handler units, ductwork, turning vanes, splitters, dampers, all surfaces within the associated duct work, supply diffusers, and return grilles.
a. Worker Training: All workers shall be trained by a NADCA CERTIFIED AIR CLEANING SPECIALIST. Contractor to provide a copy of worker certification.
5.2 SCOPE OF SERVICES.
5.2.1 HVAC SYSTEM PROJECT for 1st through 12th Floors of HVAC system
a. Any Insulation found damaged beyond repair or contaminated with microbial growth may be recommended for replacement.
b. Replace all twenty four old sound attenuators located in supply and return ductwork of all twelve
AHUs with the new sound attenuators.
c. Install a new draw–thru P-trap condensate drain line for any air handling units (AHUs) that do not have it installed. Please make sure the height of the pipe from discharge off of the AHUs to leaving pass the P-trap is total of fan inlet pressure in W.C. plus 2 inches. Also make sure the condensate drain line is free of any clogging
d. Remove all twelve AHUs’s floor pressurization ductwork with all their dampers, elbows, turning vanes, and duct insulation located in each floor mechanical rooms.
5.2.2 HVAC system cleaning of Fresh Air Intake duct chase, inside all twelve AHUs, VAV boxes, medium pressure and low pressure ductwork including all flexible ductwork with their supply diffusers and return grilles, Decontamination and Sanitization.
a. Compliance with NADCA standards.
b. Ducts negatively pressurized using high efficiency purified air whips. Inside surfaces to be cleaned using purified high-pressure air sweeps as per NADCA standards. This process is called source removal.
c. All duct surfaces sanitized with EPA rated disinfectants designed for this purpose per manufacturers’ specifications.
d. All supply diffusers removed, cleaned and sanitized and reinstalled after cleaning and sanitizing.
e. All return registers cleaned in place.
f. Evaporator coils at associated AHUs serving the 1st through 12th Floors: Chemically cleaned using a non-acidic self-rinsing commercial grade coil cleaner designed for this purpose.
g. Condensate Drain Pans/Blower Motors at associated AHUs serving the 1st through 12th Floors:
Condensate drain pans will be vacuumed clean of debris and visible microbial growth, after removal of debris, pans will be sanitized, blower motor fins and assemblies to be mechanically cleaned.
h. Interior lines of all twelve AHUs to be cleaned utilizing localized H.E.P.A. vacuum equipment and air sweep and sanitized.
i. Contractor to carefully perform service work to mitigate possible paint chipping and peeling from access to supply or return grilles/registers.
j. Inside of the AHUs including return and fan compartment shall be cleaned.
k. All Fan Powered VAV and constant volume VAV boxes for all the 12th floors.
l. Inside of all twelve AHUs’s wall shall be cleaned and all existing insulation inside the AHUs in good condition.
m. Contractor to identify/mark all the locations where they have accessed the duct work (existing or new locations) for inspection and cleaning, This shall be required to have for future reference as well as for GSA to be able to inspect that the contractor left the duct work properly sealed and without any leaks.
n. At the completion of this work, please make sure to take photos of the interior of all ductwork that has been cleaned. The entire HVAC duct system for each AHUs is inclusive of outside air ductwork thru AHUs to medium pressure supply air ductwork, VAV boxes, and low pressure supply air ductwork all the way to supply diffusers.
o. Perform a Pre-Alteration Asbestos Survey and Report in order to determine the presence of asbestos containing materials.
5.3 TIMELINE
Project is anticipated to take up to 10 Calendar Days at each floor outside of ‘Normal Government Working Hours’ over a weekend or holiday weekend as coordinated with the GSA Facility Manager.
Start time: Friday night through Sunday. This gives us maximum job time per visit.
Anticipated Crew Size: 8 to 10 man crew on a floor by floor basis is expected to complete this project.
Whether performing cleaning or construction operations and existing furniture being covered up note that the affected areas on each floor will need to be restored back to an acceptable condition prior to the start of Government business next day that may include further cleaning or wiping of furniture and/or equipment.
5.4 COST BREAKDOWN
5.4.1 Equipment Replacement: Contractor to provide the cost breakdown in cost proposal for each floor to GSA: Replacement of items described in 5.2 Scope of Services.
Contractor to field verify all quantities.
5.4.1 Duct Cleaning: Contractor to provide the cost breakdown in cost proposal for each floor to GSA: Clean 1 unit as follows: All Supply, Return Vents, and VAV Mounts, and Turning Vanes.
Contractor to field verify all quantities.
5.4.2 Architectural Finishes: Contractor to provide a line item in the cost breakdown related to removing, properly storing and re-installing all associated ceiling and/or wall finishes directly affected by the equipment replacement work.
This includes cut and patch work, access points, detach/clean/reinstall specified diffusers (linear diffusers will be cleaned in place.) AC and surrounding cabinets will be cleaned in place. All associated duct work will also be thoroughly coated with an antimicrobial sanitizer
Note: All smoke/Fire detectors located at each floor must be put on test prior to any work being performed. Applicable security services as provided by the Government.
5.5 SPECIFICATIONS FOR DUCT CLEANING
5.5.1 Equipment and Workmanship:
If the vacuum unit is to be located inside the building the vacuum system shall pull at least 2500 CFM and shall use a filtration system that incorporates HEPA filtration as a final filter. If the vacuum unit is to be located outside the building it shall be a truck mounted unit pulling at least 8,000 CFM. The compartments shall be dust tight. Air compressor must produce a minimum of 175 PSI at 17.5 CFM. All work shall be accomplished by workmen skilled and trained in HVAC system cleaning.
5.5.2 Ductwork Cleaning:
Ductwork shall be cleaned by inserting a vacuum hose in one end of the duct or trunk line and, with a Reverse Jet Air Nozzle, brush all interior surface areas of the duct system including re-heaters, joints, seams, splitters turning vanes, scoops, baffles, cracks and crevices otherwise inaccessible. As the RJA Nozzle is operating, the residues shall be drawn into the vacuum unit (minimum 2,500 CFM).
All foreign materials such as dust, mold, soot, lint, hair, bacteria, and other air movement residues shall be removed from the area.
5.5.3 Duct Access Openings:
Access openings shall be provided at required points of the duct system for physical and mechanical entry. These openings shall be provided as required at points adjacent to turning vanes, dampers, and other obstructions that might tend to trap or entrain dust, dirt, lint, and debris. Duct access openings shall be constructed in accordance with SMACNA HVAC Duct Construction Standards.
5.5.4 Grilles and Registers:
All grills, registers, and diffusers shall be cleaned with a non-toxic, disinfecting solution. Areas around registers shall be lightly cleaned by blowing with air. After cleaning, adjust all registers to insure proper air flow. Leave all areas free of any debris or dust.
5.5.5 Coil Cleaning:
Coils shall be cleaned using a self-rinsing bio-degradable cleaner.
5.5.6 Fans:
Fan shall be cleaned by using 175 P.S.I. air pressure and an air nozzle designed for that purpose.
Each blade of the fan shall be cleaned individually using care not to disturb any balancing weights.
5.5.7 Visual Inspection:
Upon complete cleaning of each section, notify Government inspector for visual inspection. Upon acceptance by Government inspector seal with silicon caulking and neatly patch with galvanized sheet metal the same gauge as the ductwork.
5.5.8 Area Clean Up:
Every precaution shall be taken to prevent the spread of dust and dirt in occupied areas. All desk, computers and work tables shall be covered with drop cloths while work is performed in that area. A complete area cleans up after each work cycle shall be performed and no debris left behind.
Whether performing cleaning or construction operations and existing furniture being covered up note that the affected areas on each floor will need to be restored back to an acceptable condition prior to the start of Government business next day that may include further cleaning or wiping of furniture and/or equipment.
5.5.9 Sealants and Encapsulates:
Any sealants or encapsulates will be properly applied to any and all access points made to ensure no leaks can occur and air can flow fluently.
5.6 ARCHITECTURAL FINISHES AFFECTED BY THE DUCT CLEANING
PROJECT.
5.6.1 General: All architectural ceiling and/or wall finishes directly affected by the duct cleaning project shall be appropriately removed, temporarily stored properly and reinstalled subsequent to the finalization of the duct cleaning project. Contractor shall replace with new all damaged finishes at no cost to the Government.
6 APPENDIX B – Existing Facility Drawings.

REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE
SERVICES OR EQUIPMENT (OCT 2020)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the
Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-
Commercial Items. (a) Definitions. As used in this provision—
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for
Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal
Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for
Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August
13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
Nothing in the prohibition shall be construed to—

(c) Procedures. The Offeror shall review the list of excluded parties in the System for
Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(d) Representation. The Offeror represents that—
(1) It □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the
Offeror represents that—

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number;
and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or https://www.sam.gov/

52.212-2 EVALUATION-COMMERCIAL ITEMS
EVALUATION--COMMERCIAL ITEMS (OCT 2014) (TAILORED)
(a) This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the
Government, price and other factors considered. The following factors shall be used to evaluate offers:
• Janitorial Cleaning Program
• Past Performance
An award will be made to the responsible vendor that submits the lowest priced quote that conforms to the requirements of the solicitation. The Government intends to make an award to the vendor whose proposal represents the best value to the Government based on (1) responsiveness to the Performance Work Statement and (2) price.
Acceptability will be based on the demonstrated ability to meet the requirements of the
Performance Work Statement. A mere statement that the vendor “will meet the Government’s requirements” is insufficient; the vendor must demonstrate how it will meet the requirement.
To ensure technical compliance with the requirements, vendor quotes shall include the following information:
a. Vendor’s quote shall include an active Cage Code and Federal Tax Identification Number.
Vendors are required to be registered with the SAM database and have an active CAGE code at the time of submission of quote.
Past performance will be verified via the Contractor Performance Assessment Reporting System
(CPARS).
(b) Options. Not Applicable
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer`s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) Quotes shall be submitted in two (2) parts as follows:

52.204-25 Prohibition on Contracting for Certain Telecommunications and Video
Surveillance Services or Equipment.
PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)
(a) Definitions. As used in this clause—
Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).
Covered foreign country means The People’s Republic of China.
Covered telecommunications equipment or services means–
(1) Telecommunications equipment produced by Huawei Technologies Company or
ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National
Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
Critical technology means–
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part
774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations
(relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of
Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the
Export Control Reform Act of 2018 (50 U.S.C. 4817).
Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.
Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.
Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal
Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for
Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August
13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
(c) Exceptions. This clause does not prohibit contractors from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement.
(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the
Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the
Contracting Officer(s) for any affected order or, in the case of the Department of Defense, https://www.acquisition.gov/far/4.2104#FAR_4_2104 https://www.acquisition.gov/far/4.2104#FAR_4_2104 https://dibnet.dod.mil/ identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause
(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known);
brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.
(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (b)(2), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

52.212-3 CERTIFICATIONS AND REPRESENTATIONS
OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL ITEMS (MAR 2020)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management
(SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.
(a) Definitions. As used in this provision—
“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video
Surveillance Services or Equipment.

Forced or indentured child labor means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following:
ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
