13. PRICE PROPOSAL INSTRUCTIONS

Pricing for this contract will be based upon the 2021 Facilities Construction Cost with RSMeans Data Book (hereafter referred to as the RS Means Book) available here.

RSMeans will be used for pricing for the duration of this Contract. Each Task Order proposal shall be prepared in accordance with the current RSMeans edition. During the base year, the RSMeans edition applicable at the time of contract award will be utilized. Subsequently, the RSMeans edition applicable on the date that the most recent option was exercised will be utilized.

Each multiple-award zone (East and West) includes multiple bid-coefficient areas as follows:

1. Eastern Pennsylvania (excluding Philadelphia)

a. Bucks/Montgomery Bid Coefficient: Consists of the Pennsylvania counties of Bucks and Montgomery.

b. Harrisburg Bid Coefficient: Consists of the Pennsylvania counties of Adams, Bedford, Berks, Blair, Columbia, Cumberland, Dauphin, Franklin, Fulton, Huntingdon, Juniata, Lancaster, Lebanon, Northumberland, Perry, Schuylkill, Snyder, York.

c. State College Bid Coefficient: Consists of the Pennsylvania counties of Centre, Clinton, Lycoming, Mifflin, Potter, Tioga, Union.

d. Wilkes-Barre Bid Coefficient: Consists of the Pennsylvania counties of Bradford, Carbon, Lackawanna, Lehigh, Luzerne, Monroe, Montour, Northampton, Pike, Sullivan, Susquehanna, Wayne, Wyoming.

2. Western Pennsylvania

a. Erie Bid Coefficient: Consists of the Pennsylvania counties of Cameron, Crawford, Elk, Erie, Forest, McKean, Mercer, Warren.

b. Pittsburgh Bid Coefficient: Consists of the Pennsylvania counties of Allegheny, Armstrong, Beaver, Butler, Cambria, Clarion, Clearfield, Fayette, Greene, Indiana, Jefferson, Lawrence, Somerset, Venango, Washington, Westmoreland.

Each bid factor will apply for the entire five (5) year Indefinite Delivery/Indefinite Quantity (IDIQ) contract, which shall apply to all work items for which a unit price is stated in the 2021 RS Means Building Construction Cost Data. (Example: The unit prices listed in the 2021 RSMeans Building Construction Cost Data are bare costs. Bare cost equals a factor of 1.000, the same as “NET”, all other bid factors “MINUS” or “PLUS” will be added or subtracted from the bare cost factor. A “MINUS” 4% shall be written 0.96, a “PLUS” 4% shall be written 1.040 and “NET” shall be written 1.000.) The single offered bid factor for the base and each option period will be applied to all work items for which a unit price is stated in the Price Schedule that are ordered via task orders in the respective base/option period.

The Government anticipates using the RS Means Building Construction Cost Data pricing approach for task orders estimated to be under $50,000. The Government anticipates that task orders estimated to be $50,000 or more would be priced on a lump sum basis.

Bid Coefficient Frequently Asked Questions:

1. Q - Using the bid-coefficients, won’t the contractor with the lowest bid coefficient always win on the task order level?

A - Not necessarily. Normally, task order awards will be made to the lowest bidder.

However, task order pricing will be based on a number of factors, one of which will be accurate application of the contractors accepted bid coefficient to the applicable RSMeans data. Task Order pricing will also depend on other variables such as labor and material quantities, any bid coefficient discounts offered by the contractor, etc.

2. Q - Will any projects involve lump sum pricing?

A - Individual RFPs will specify whether proposals should be provided using each contractor's accepted bid coefficient(s) or lump sum pricing. For projects estimated at $50,000 or less, proposals will generally be prepared utilizing each contractor's accepted bid coefficient(s). For projects estimated to exceed $50,000, proposals will generally be prepared using lump sum pricing

3. Q - Will quantities be provided in the task order RFP for smaller projects?

A - Normally quantities will not be provided.

14. LATE PROPOSALS

Any proposals received after the time set for proposal closing are subject to Late Proposal provisions.

15. BONDING REQUIREMENTS

Prior to commencement of work on an awarded task order, the contractor will be required to provide Performance and Payment Bonds or alternate payment protection, as follows:

(1) Orders less than or equal to $35,000: No additional protection required

(2) Orders over $35,000 but less than or equal to $150,000: Alternate payment protection in accordance with FAR 52.228-13, Alternative Payment Protections

(3) Orders over $150,000: Bid Bond: 20% of the proposed price. Performance Bond: 100% of the awarded delivery order amount. Payment Bond: 100% of the awarded delivery order amount.

When additional bonding is required, the provisions of FAR 28.102-2(b)(1) and FAR 28.102- 2(b)(2) shall apply.

16. INSURANCE REQUIREMENTS

After contract award, the contractor must furnish the Contracting Officer with a current Certificate of Insurance, listing the Government as co-insured party and meeting the requirements specified in this solicitation. The contractor may not begin actual work on site until this certificate has been received and found acceptable.

See Solicitation No. 47PD0321R0015 C101 The Agreement Section III.F. Insurance Requirements for more information.

17. AWARD

The approach to source selection for this procurement will be pursuant to the best value tradeoff concept as identified in FAR Part 15.101-1 and FAR Part 15.3. It is the government’s intention to award a contract to the offerors whose proposals conform to the RFP requirements and are considered to be most advantageous to the government, price and technical factors considered.

Competitive proposals shall be evaluated and assessed based on the factors specified in this solicitation. For this solicitation, the combined weight of the technical evaluation factors is significantly more important than price.

The Government intends to evaluate proposals and award a contract without discussions with offerors (other than exchanges conducted for the purpose of minor clarifications). However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. Therefore, each initial offer should contain the offeror's best terms from a price and technical standpoint. The Government reserves the right to conduct negotiations if necessary.

18. SECURITY REQUIREMENTS

See Solicitation No. 47PD0321R0015 C101 The Agreement Section III.H - Administrative Matters as well as Solicitation No. 47PD0321R0015 C201 The Solicitation Section V.F - Security Requirements.
