Solicitation 47PD0321R0015
| Question | Answer | |
| 1 | I heard a lot of conversations on a multiplier coefficient and how it relates to a Means book job order contract. We currently hold MATOC contracts that are competitively bid and JOC contracts based on Means pricing. I’m still not understanding how the multiplier will be used in a competitive bid situation. It seems you are marrying the two in a way that has not been done before. | See Section III.M(iv)(h) of the agreement "Special Terms and Conditions for IDIQ Contracts. |
The Ordering Procedures for this contract are:
1.) For all orders estimated to be $15,000 or less the government intends to solicit them using the RS Means Line Items and the awarded Coefficients.
2.) Orders estimated to be above $15,000 or more the government may elect to utilize Lump Sum Pricing Competitive Bids. If LS pricing is used for task orders the awardees will be bound to the maximum markups (Profit/OH/B&I) that are evaluated with the IDIQ Proposal and included in their contract.
The two methods will not be used simultaneously on any future task orders. The solicitation at the task order level will clearly define which method will be utilized.
The Locality Bid Coefficients, Markups, and Labor Rates are the maximums awardees may utilize on future task orders. An offeror may elect to discount the awarded coefficients, markups and labor rates at the task order level.
| 2 | From what I hear the jobs will be lump sum bid. How does the means book and multiplier fit into a lump sum bid? As I stated in my question in the meeting, if a project is let out and say 4 contractors bid on it, all quantities must be the same. This means the lower multiplier contractor will get every project unless a contractor with a higher multiplier misses a few things and has lesser quantities in their bid, in which case they only have to install what they bid on and get a change order to provide actual quantities. | Please refer to RFI #1 response. RS Line Items and Coefficient (Multiplier) are intended to be utilized for orders estimated below $15,000.00. In addition an offeror may elect to discount the awarded coefficients, markups and labor rates at the task order level. |
| 3 | With the above stated, what is to keep a contractor from submitting a low coefficient multiplier to get an award for the umbrella contract, but then provide a lump sum price that is not governed by the multiplier. | The Solicitaiton states, the government will evaluate pricing for unbalanced pricing IAW 15.404-1(g). |
| 4 | Do we have to bid on both the East and West? | No, contractors may bid on the East, West, or both locations. The Government intends to award 2 separate Multiple Award Contracts, 1 for the East and 1 for the West. Please make clear in your proposal email which location(s) you are submitting your proposal for. |
| 5 | Can I get a copy of the agenda? | See Amendemnt 01 |
| 6 | Can I get a link to the 2021RS means (this is typically provided in any JOC contract) it is unreasonable for the Government to expect a contractor to buy a subscription to Means for bidding purposes. | A link/subscription will not be provided to offerors. If offerors need access to RS Means Database prior to bidding this cost is their burden. Access to the RS Means database is required post award. |
| 7 | Are we locked in to whatever the rate in RS Means is for our construction labor and material? Example: VCT flooring fully loaded in RS Means is $7/sf. Is this our bid price at the task order level? If everyone is bidding the same rate, then it boils down to the coefficient? | See response to RFI #1 and #9. When the government elect to use RS Means for task order pricing the RS Means Data and the Award Coefficent will be used to develop price proposals. An offeror may elect to discount the awarded coefficients, markups and labor rates at the task order level. | |
| 8 | How do you handle price fluctuations (especially given how prices have jumped this year)? RS Means pricing is basically created based on the previous years data. Over the contract year, material prices can triple. | Contractors should consider risks in market price fluctuation as they develop their price proposals. This will be a Firm Fixed Price contract. Please referernce RFI #9 Response for more information. | |
| 9 | Page 8 of 64 of C101 states that bid factors should include, among other things, material, insurance, bonds, mob/demob, QC, all contingencies, etc. How is that accounted for up front like this with the coefficient? | RS Means pricing is the base price for the each individual line item in the cost book. The offerors proposed cooefficent allows the offeror to account for any variation in price from the RS Means Cost Book they determine is neccessary to complete the work described in the line item, ie. cost for the applicable wage rates, travel, supervision, sales tax, B&I, etc. | |
| 10 | As per the pre-proposal conference it was mentioned that both the Technical Proposal and the Price Proposal need to be emailed as separate documents. In the Request for Proposal (Page 8 of 52) it states that numerous documents (SF 1442, SF 527, Bonding, etc.) must be submitted under the pricing proposal as separate files. Can the above-mentioned files me combined into one PDF file and labeled as our Company Name Pricing or you want 2 separate emails from each company one with the technical data and one with the pricing data as all separate files? | Please refer to the updated Request for Proposal section in the updated Solicitation. | |
| 11 | Line item 13B on the SF1442 states an offer guarantee is required. In the Request for Proposal (Page 9 of 52) it states otherwise. | An offer guarantee is not required, and the SF 1442 has been updated accordingly. | |
| 12 | Contract Definitions, Express Menu of Services states: "The government may utilize the express menu of services and/or RS Cost Means Book to award task orders that are simpler in size and scope." | ||
| Please provide the Express menu of services link and/or book of the pre-priced and scoped, construction and general building services. | This definition will be deleted in part. The government will only use the RS Means Cost data to award task orders that are simpler in size and scope. This solicitation does not have an Express Menu of Services. | ||
| 13 | Please define the "RS Means Locality Coefficent". | Please refer to the Agreement C101 - Section I.B. Contract Price Form. The standard definition is: |
A numerical factor that represents costs (generally indirect costs) not considered to be included in RS Means unit prices, e.g. general and administrative and other overhead costs, insurance costs, bonding and alternative payment protection costs, protective clothing, equipment rental, sales tax and compliance with tax laws and contractor’s profit.
Coefficients proposed are multiplied times the established unit prices in the RS Means price book to price a job or project on individual task orders.
In regards to this solicitation, the governemnt devised "locality coefficients" in order to capture the varying cost(s) of doing business throughout the entire state of Pennsylvania.
| 14 | Are we to use 2021 RS means Building Construction Cost Data or the Facilities Construction Data? According to RS means, RS Means facilities construction Cost is for larger scale industrial, manufacturing and institutional projects and the Building Construction Cost is for commercial buildings. Please clarify which are we using? | The government utilizes electronic versions of RS Means Facilities Construction Cost Data as well as Assemblies cost Data and some offices utilize other RS Means guide books as well. |
| 15 | Is the design fee handled at the 6% fee for design with additional professional service such as pre- design work (measuring, generating base plans), and reports? (This is according to the Brooks Act) This would be more cost than just construction. How does the coefficient include this work? | This procurement is not being solicited under Brooks Act procedures. The 6% Design Fee Limiation does not apply to Design/Build Prorjets. Any design work required under this contract will be incidental to the overall requirement for small construction work. |
| 16 | Design-build projects have multiple engineers at varying hourly rates. For example a design-build team can be composed of geotechnical, structural, civil, mechanical, electrical, plumbing, commissioning, fire alarm and sprinkler systems engineers, project managers from the different disciplines, senior architects, architects, interior designers, and/or CAD operator plus the cost of construction. Also, if a project is a LEED project cost increase. How does the coefficient address this? | Please refer to Question # 1. |
| 17 | RS Means does not have a Locality Coefficient. Please provide information what we should use since RS Means does not have this information. | The offerors proposed RS Means Locality Coeeficient should take into account the locality where work is to be performed. Per the agreement the RS Means City Cost Index is not applied to RS Means rates. This is where the offerors coefficients are used to establish prices for the locality. |
| 18 | On the Excel sheet your mention an RS Means Coefficient Under IIB contract Price form yet in the note (6) you state that the City Cost Index for RS Means Book will NOT be applied to the Total Incl O&P Cost. Why is the RS Means Coefficient? | See RFI #17 Response |
| 20 | Since the Pandemic, construction costs have quickly and greatly increase. For example, sheet metal rose 30% in one Month. How will the government work with us so the construction experience is a win-win for the contractor and the government? | See RFI #8, #9 responses. |
| 21 | All estimators want to know what type of project the $95,000 amount is for. Do you have plans? Where is the RS Means coefficient? Is this in only for projects under $250,000? | See Revised Bid Sheet(s). |
The Total COW has been revised to $185,000 to better represent the value of project that wlll utilze the Lump Sum Competitve Bids. Therefore extending OH, Profit and B&I out to a more realistic representation of the cost.
The RS Means Multiplier has been revised to $15,000 to better represent a project that will typically use RS Means and Coefficients.
There are no plans or specifications.
22 On page 8 of 52 of the Solicitation, II.C Price Proposal states “The Price Proposal shall consist of the SF 1442 and the Agreement, with prices and/or rates indicated for each price element shown on the pricing form included in Section II of the Agreement. Indicate the Base Contract Price, or if no such distinction is made, the Contract Price, in Block 17 of the SF 1442, which must be fully executed by the Offeror.
| Can the government please clarify if offerors need to include a copy of the entire “Agreement” (64 pages) following the SF 1442? | No, returning a copy of the Agreement (64 pages) is not necessary. Please ensure Block 17 of the SF 1442 is completed. | |
| 23 | On page 9 of 52 of the Solicitation, II.C Price Proposal states “(2) Qualifications, Exclusions and Conditions" If the Offeror communicates in its proposal any qualifications, exclusions, or conditions to the proposed prices not provided for in the Contract Documents, the Contracting Officer may reject the proposal and exclude the Offeror from further discussions.” |
| Can the government please clarify where in the proposal this Qualifications, Exclusions and Conditions section is to be placed? Should it be at the end of the Price Proposal? | Yes, any Qualifications, Exclusions and Conditions should be included in the Price Proposal. The exact placement of such is up to the offeror, but should be clear and apparent to the Contracting Officer exactly what and where the offeror is including such documents. | |
| 24 | On the SF 1442, Block 12.a states that offerors are to furnish a payment bond and in the solicitation, and the government provided FAR 52.228-1 which provides directions on the Bid Guarantee. |
a. Can the government please clarify the difference between a Payment Bond and the Bid Guarantee?
| b. Where in the proposal should this Payment Bond and/or Bid Guarantee be placed. Should it be included at the end of the Price Proposal or the end of the Technical Proposal? | Bid and Performance Bonds are not required at this time. Please refer to section "II.C. Price Proposal - 2. BID GUARANTEES AND PERFORMANCE BONDS". Standard form 1442 shall be updated. | ||
| 25 | Can the government please clarify if title pages, tabs, covers, customer letters of commendation, other performance recognition documents and the bonding capacity letter are excluded from the 14 page limit of the technical proposal? | Attachment 1 Project Experience Information Worksheet, Title pages/Tab pages, Index pages, Attachment 2 Past Performance Questionnaire (PPQ), performance recognition documents such as awards, Customer letters of commendation and any other performance recognition, as well as evidence of bonding capacity are excluded from the page limitation. All other pages (including cover page) are included in the page limitation. | |
| 26 | Can the government please clarify what offerors are supposed to submit for introduction letters/introduction statements? Is this a separate section that should be included prior to Factor 1? | Introduction letters and/or statements are not requirements of the solicitation. | |
| 27 | Is there a file size limit for the submission of the two proposals? | 25 MB | |
| 28 | In the Technical Proposal, Factor 2 – Past Performance on Relevant Projects, can offerors submit a completed CPARS in lieu of a PPQ? | No, GSA would not consider permitting bidders to submit recently completed Contractor Performance Assessment Reporting System (CPARS) in lieu of Past Performance Questionnaires (PPQ). While the Government may elect to consider data from a variety of sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror. | |
| 29 | Can a firm just submit a price for the Western Region of PA? Or do you have to submit a price on both Western and Eastern Regions? | Contractors may bid on the East or West, or both locations. | |
| 30 | Can the project be more than $250,000 in dollar value. We have design-build projects over that amount and less than $900,000. The fees include design and construction which increase the over fee. Is this allowable? | Offerors shall consider the relevant characteristics listed in the solicitation to determine which projects they consider most relevant to the requirement. | |
| 31 | Is an offer guarantee required with the IDIQ bid as stated on the SF1442 or is this only for task orders as stated in II.C 2.? | An offer guarantee is not required, and the SF 1442 has been updated accordingly. | |
| 32 | We note that Instructions and Clauses, section V. E. is FAR 52.219-18 Notification of Competition Limited to Eligible 8(a) Participants. Please verify if this is in error or if it was intended so as to mean the contract is limited to 8(a) firms. | This clause is only applicable to contractors that participate in the SBA’s 8(a) Program. This solicitation is not limited to only 8(a) firms. | |
| 33 | Offerors may resubmit questionnaires previously submitted with other proposals or may obtain an updated/new PPQ from a client for any submission. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. | ||
| Can you clarify what this means? Are we able submit previous PPQs with our proposal? | Yes, you may submit previous PPQs with your proposal. | ||
| 34 | We are a WOSB with no lobbying activity. For a previous bid for a USACE project our PTAC through SEDA-COG advised us to submit SF LLL stating that we do not have lobbying activity and filling all section out with n/a – I am attaching a sample for your convenience. Would you please advise if GSA would accept us completing SF LLL in the same manner for Solicitation 47PD321R0015? | Yes, that is acceptable. | |
| 35 | Can you clarify whether the submission will consist of just 2 files, the Technical and Pricing, with all of the above included in the pricing section, OR if there will be one volume for technical, with all the above docs being sent as individual files to comprise the Pricing volume? | Please refer to the updated Request for Proposal section in the updated Solicitation. | |
| 36 | In filling out GSA Form 527, Contractor’s Qualifications and Financial information are you looking for the information of the JV, or the small business concern of the JV, or all three entities | All three entities. | |
| 37 | I sent the PPQs to our COR and he didn’t fully complete them and electronically signed them so now I cannot make changes.
