7. Q: Anticipated Schedule: Do you have an estimated evaluation/award timeline and a target Base Year start date?
A: Please refer to the RFP Letter. The estimated award date will be in January or February of 2026.
8. Q: Labor Categories: Is there a standard BNL catalog (titles/levels/min quals) we should align to, or may we propose our own catalog aligned to typical BNL needs?
A: Please refer to RFP Letter, Enclosure 1 Draft Contract, Attachment A Statement of Work (SOW), Enclosure A to SOW for description of all job classifications. Offerors should not propose their own catalog.
9. Q: Security/Badging: Please confirm required screening (e.g., background checks, drug testing, I-9/E-Verify) and any DOE/BNL-specific badging steps. What is the expected timeline for a new hire to obtain badging/site access?
A: I-9 and E-Verify as agency is the employer Background check - education and work references Usually don’t hire for clearance but if so, would be Q and/or SCI Employees would register in our Guest Information System and need to be cleared for site access Timeline – depending on all pre assignment steps completed - approximately two weeks from start date.
10. Q: SLAs/Fill Times: Are there defined KPIs/SLAs (e.g., submittal within 24–48 hours, fill within 5 business days, backfill windows, no-show thresholds), or should we propose targets for BNL’s consideration?
A: The contractor shall furnish candidates within two (2) weeks as stated in the Statement of Work. BSA is not looking for offerors to propose targets.
11. Q: Work Location: Will assignments be onsite only, or can some roles be hybrid/remote?
If hybrid/remote is allowed, should distinct rates be proposed?
A: Assignments could be onsite, hybrid, or remote. Rates remain the same, regardless if onsite, hybrid, or remote.
12. Q: Rate Structure: AMS-043 requests fully-loaded hourly rates. Please confirm whether overtime (OT) is billed as:
a) [Base Wage × OT factor] with full burdens applied to the entire OT amount; or
b) burdens applied to base hours only, excluding the OT premium portion.
(If BNL has a standard convention, we will follow it.)
A: The OT is 1.5 times the hourly rate this is not “built into” the multiplier
13. Q: Differentials & Premiums: Should we include shift differentials, holiday rates, and any rapid-response premiums on AMS-043 now, or provide them as optional lines/notes?
A: Review SOW, no rapid response premiums nor anything different for markup.
14. Q: Escalation: Is a fixed annual escalation acceptable (e.g., 3%) for option years, or should rates remain flat for the term of the BOA?
A: Escalation should not be included. Rates remain flat and remain same throughout the assignment.
15. Q: Discounts: May we include volume or prompt-pay discounts (e.g., monthly hour thresholds, Net-15 discount) and, if so, where should those be documented?
A: Payment terms are typically NET 10 for Small Businesses. This type of requirement is not set up for additional discounts based on volume, prompt pay, etc. Please do not include additional discounts.
16. Q: Conversions/Buyouts: If BNL converts a temporary worker to a BNL employee, does BNL have a standard conversion/buyout policy and timing schedule we should price?
A: BSA does not have a standard conversion/buyout policy or timing schedule that should be priced. BSA has the right to convert temporary support personnel to BNL employee without paying a conversion fee.
17. Q: Minimums/Cancellations: Are there minimum hour charges per assignment/shift and any cancellation/no-show policies we should reflect in our pricing notes?
A: No, as payments are made for actual hours worked
18. Q: Ordering Method: Will tasking be via orders/call-offs under the BOA with defined position descriptions, durations, and ceilings?
A: When BSA has a need for temporary support services, BSA will reach out to the contractor. An order will be placed under the BOA should BSA desire to utilize the services proposed. Please review SOW for additional details regarding staffing process for inside and outside of the United States.
19. Q: Timekeeping & Approval: Does BNL require use of a specific timekeeping system or approval workflow?
A: BSA does not require a specific system and the designated BSA assignment contact reviews time submitted by jobshopper and agency will approve the time for their employee.
20. Q: Invoicing/Payment: What is the preferred invoicing platform/process and typical payment terms?
A: Please review Enclosure 1 – Draft BOA as well as all attachments for invoicing terms.
Payment terms for small businesses are typically NET 10.
21. Q: Union/CBA: Are any positions covered by a CBA or union requirements at BNL that would affect wage/fringe assumptions?
A: The Service Contract Labor Standards is applicable for this effort as explained in Enclosure 1 of the Draft BOA: Most up to date Wage Determinations will be attached at time of award. No other requirements should affect wage/fringe assumptions.
22. Q: Insurance/Compliance: Beyond standard commercial coverages, are there additional insurance or site-specific compliance requirements for this BOA
A: Please review the entire RFP including the terms and conditions referenced in Enclosure 1 Draft BOA and the SOW for insurance and site-specific requirements.
Insurance and site-specific compliance requirements are located in the BSA Supplemental Terms and Conditions for Work by Contractors Onsite at Brookhaven National Laboratory.
23. Q: Are non-WOSB small businesses (such as SDVOSBs) eligible to submit proposals for this solicitation, or will these be considered non-responsive under this set-aside?
A: Only Certified WOSB are eligible to submit proposals for this solicitation.
24. Q: If not eligible, is Brookhaven National Laboratory planning any Small Business or SDVOSB-specific BOA opportunities for similar temporary staffing support in the near term?
A: At this time BNL has no other plans for any other temporary staffing support in the near future, but please follow SAM.gov for possible future opportunities.
25. Q: Alternatively, is there a vendor teaming or subcontracting pathway available under this BOA that allows SDVOSB participation?
A: Non-WOSB concerns could enter into a Joint Venture with a WOSB. In this case WOSB must own 51% of the joint venture and the small business partner must perform at least 40% of the work. Joint Venture would need to submit the executed Joint Venture agreement and WOSB control statement. The documentation must include the different responsibilities, roles, and percentages (or other allocations) of work as it relates to the acquisition. Another alternative is if a WOSB subcontracts out up to 50% of the work to an entity that is other than WOSB.
26. Q: Is this a new request for support or is there a current vendor?
A: This is a follow-on Basic Ordering Agreement. There are current vendors. See answer to Q 1 above.
27. Q: Who is the current vendor and how long have they had the contract and why do you want to change?
A: The current BOA is expiring soon, and we must compete the follow-on requirement.
See response to Q 1 above for current vendors.
28. Q: This is an RFP/ BOA for support staff only, the contractor is not required to provide any work space or equipment?
A: Depending on the assignment, the temporary support personnel should have what is required for the assignment. If the assignment is onsite BSA will provide necessary workspace and equipment. Any BSA provided equipment will not be authorized to be taken off site at any time.
29. Q: Are there any other locations other than the New York area facility?
A: Yes. Staffing may also be needed in other areas of the United States as well as outside of the United States as stated in the SOW. Because this requirement will be fulfilled on an as needed basis BSA does not have a list of possible locations to provide at this time.
30. Q: How many support personnel are estimated to be used during the year?
A: This requirement will fulfilled on an as needed basis. Support personnel may vary depending on specific needs; therefore, no estimated level of effort or quantity can be provide at this time.
31. Q: How many support personnel are currently on staff, will you provide the number and current positions staffed for all personnel?
A: The number of support personnel on staff fluctuates based on our operational needs, which can vary significantly throughout the year. Historically we have had needs range from 25-100 personnel; However, these figures are provided for reference only and should not be interpreted as a guarantee or commitment to specific staffing levels. The types of roles anticipated are outlined in the SOW. Actual staffing needs may increase or decrease beyond these historical ranges depending on program requirements and other influencing factors.
32. Q: What is the current spend for the past 12 months on a monthly basis?
A: The past 12 month spend is not indicative of future spend given fluctuations due to business need and lack of visibility into future needs which can change from prior years.
33. Q: What are the current bill rates for each position currently staffed? What is the current markup assessed?
A: This is proprietary company information that cannot be given out.
34. Q: What are the current number of openings not being staffed?
A: Assignments are not necessarily based on the current number of openings not being staffed so we are unable to answer this question.
35. Q: What are the two most critical staffing issues you face on a daily / yearly basis?
A: These evolve throughout the year our roles are very niche/unique to fill as such we do not have two “most critical staffing issues” to provide at this time.
36. Q: How many personnel are working outside of the United States?
A: The number of temporary support personnel working outside of the United States varies based on project and operational requirements. Historically, this number has been fewer than 10 temporary support personnel. However, this information is provided for reference only and does not represent a guarantee or commitment to future staffing levels.
Actual needs may fluctuate significantly, potentially exceeding historical range, depending on program needs and other circumstances at the time.
37. Q: What level’s of security clearance are used — Public Trust to Confidential, Secret, TS, TS/SCI, Q or L?
A: See answer to Q 9 above.
38. Q: Assuming there is a new contract award, how many personnel are there to be transitioned to the new service?
A: Due to the current economic climate our temporary employees are at a minimal level however this can rapidly change, so BSA is unable to provide an exact number at this time. Additional detailed information will be provided at time of award.
39. Q: Can this effort be subcontracted out by the WOSB awardee to other than WOSB contractors?
A: Yes, a WOSB may subcontract up to 50% of the effort out to an entity that is not a certified WOSB.
40. Q. Can you please confirm that we do not need to include Enclosure 4 (Vendor ACH
Authorization Form) and Enclosure 5 (W-9 Form) with our proposal?
A: Confirmed. Encl 4 and 5 are not necessary at time of proposal submission. You may be asked to complete these forms upon award.
41. Q. In the Evaluation Criteria, Tab 2 – SOW Compliance Matrix, it states that “The offeror shall provide a paragraph-by-paragraph compliance matrix for each section of the Statement of Work (SOW) that clearly show’s the Offeror’s acceptance. Offerors shall list each SOW section by number…”
a. Can you please confirm that this numbering starts with I. General Terms for Temporary Support?
b. Can you please confirm that this numbering ends with VIII. Physical/Drug Screening?
c. Some of these numbered sections have bullets. Do we need to address each bullet individually or can we address all bullets within that numbered section as a whole?
A: The numbering begins with I. General Terms for Temporary Support and ends with VII. Physical/Drug Screening. To make it more straightforward, the matrix can be responses directly under each paragraph of the SOW in a different color. The SOW remains unchanged and responses are directly under the paragraph which will be clear rather than having to number a different document and add each bullet, though that is also acceptable.
42. Q. Under section Tab 4 – Organizational Experience/Past Performance, Item B., please confirm that if we have NOT provided temporary staffing services in the NY metropolitan area, we leave this section blank?
A: Vendors shall include all the information requested whether they have provided temporary staffing in the NY metropolitan area or not. Any area left blank will receive zero points.
43. Q: Under Business – Volume 2, 5.3.1 Tab A Corporate Profile and Financial Capability, please explain what we need to provide for our corporate profile.
A: Corporate profile usually includes legal name of company, business address and contact information, type of business, years in business and a brief history, core capabilities or services that company specializes in, a brief summary of experience or qualifications, etc.
44. Q: Under Business – Volume 2, 5.3.1 Tab A Corporate Profile and Financial Capability, there is no mention of providing anything for our financial capability. Can you please confirm this is correct?
A: Financial capability usually includes a statement of financial health or stability possibly a summary of revenue or other financial data to show that the company is financially responsible to fulfil this requirement.
45. Q: If an addendum is issued and we must return the signed addendum, please indicate if we include this in Volume 1 or Volume 2.
A: Not sure what is meant by this question. If any additional documents are submitted after the proposal package has already been submitted it will need to be submitted as a separate email to the contract specialist.
46. Q: Since there is only a week between the questions deadline and the proposal deadline, will you please consider extending the due date?
A: Please follow the requirement on SAM.gov for any amendments to the solicitation. An extension is being considered and will be updated on the solicitation if one is provided.
47. Q: Can BNL provide an estimate on the number of foreign placements on the last contract and where to assist us in determining proper overhead rates?
A: Your multiplier should include your overhead rate for foreign nationals See answer to Q 36 above regarding estimate of temporary support personnel outside of the U.S.
48. Q: How many awards does BSA anticipate making on the BOA?
A: BSA anticipates up to three awards, note BSA may change the number of awards actually awarded.
49. Q: Can BSA provide a ceiling value for this award? What number of positions should the offeror anticipate filling in a contract year?
A: BSA cannot provide any budget or ceiling value for this award. Offerors are expected to propose pricing that is fair, reasonable, and reflective of their independent assessment of the effort described. Work to be performed will be on an as needed basis; therefore, an estimate on the number of positions expected to be filled per year cannot be provided as it can fluctuate greatly.
50. Q: Can the Offeror’s proposed PM/management team be located off-site (remote) for contract performance?
A: If this means do their managers need to be onsite – the answer is no but they need to continuously monitor their employee(s).
51. Q: What are the proposal page limits and formatting requirements, if any? (font, figures, etc.)
A: See answer to Q 6 above.
52. Q: Tab 4 Section B: The evaluation criteria preferencing offerors with staffing experience specifically in the Brookhaven/Long Island area is too narrow for a competitive proposal.
Would BSA consider broadening the staffing location experience criteria, such as to include New York State or multi-state?
A: The criteria will not be changed as this is a preference not a requirement. Those that meet this preference will get a higher score.
53. Q: In Tab 4 Section C of the evaluation criteria – Organizational Experience/Past Performance, BSA states that “The Offeror shall describe in detail any previous experience with Brookhaven National Laboratory and any other national laboratory. If the Offeror has no experience with National Laboratories, the Offeror is to provide a minimum list of ten (10) commercial accounts”. If the Offeror is comprised of a Team and the subcontractor has extensive experience supporting the National Laboratories, can the subcontractor's past performance be used to satisfy the past performance requirements, thereby negating the requirement to provide a “minimum list of ten (10) commercial accounts”?
A: Please provide all experience of who will be providing these services. If you are subcontracting this effort out, note that only up to 50% of the work may be subcontracted out, but we would need to know their experience as well since they are performing some of this work.
54. Q: Tab 4 Section C - Can the offeror provide other government agency science laboratory staffing (e.g. NIH) past performance to fulfill the required National Laboratory past performance to meet the evaluation criteria?
A: For evaluation criteria Tab 4 C, BSA is trying to understand if the offeror has experience with national laboratories. Note NIH is a government agency, but not a national laboratory. Please include all national laboratory experience, or provide a minimum list of ten (10) commercial accounts, which may include the NIH.
55. Q: Tab 4 Section C - How many references is BSA requesting to satisfy the evaluation criteria?
A: Tab 4 Section C asks for a minimum of ten (10) commercial accounts if no experience with a national laboratory. Otherwise, please include listing of government accounts (clients) during the past 3 years as you have them.
56. Q: In Tab 4 Section D – Organizational Experience/Past Performance, BSA States that “The Offeror shall provide the number of temporary personnel for the past three (3) years assigned to the clients (as noted above) and include their job classifications such as engineers, technical, scientific support, technical support, information technology, and scientists. The Offeror shall provide supporting documentation (e.g., staffing reports, invoices, timesheets, references, etc.) to substantiate these figures”. Would BSA please clarify the requirements to satisfy this evaluation criterion? Is BSA requesting timesheets and other supporting documentation for all positions on all contracts, or will one representative example suffice for supporting details (contract, positions, single documentation, such as a staffing report or invoice)?
A: A staffing report would be sufficient.
57. Q: Tab 4 Section D Evaluation Method - Please clarify the evaluation criteria for “Offeror will be evaluated on the number of temporary staffing and types of classifications they fill”. Can the Offeror’s team provide representative, consolidated data to streamline the burden on small business responders instead of BSA’s requirement for comprehensive documentation?
A: A staffing report is sufficient.
58. Q: In Tab 5, Section A of the evaluation criteria –Payroll Outside the U.S. and Security Clearances, BSA states that “The Offeror shall describe and provide details on the firm’s ability and experience processing payroll for those working outside the U.S. The Offeror shall provide examples of previous contracts where the firm provided this service.” Will experience of a proposed subcontractor satisfy this requirement?
A: We are asking for experience and process supporting foreign payroll even if using a subcontractor. Please provide all relevant experience as requested.
59. Q: In Tab 5, Section B of the evaluation criteria –Payroll Outside the U.S. and Security Clearances, BSA states “The Offeror shall describe and provide details on the firm’s ability and experience maintaining security clearances. The Offeror shall provide examples of previous contracts where the firm was required to maintain security clearances.” How many references are required? What levels of Security Clearances will be required on the contract?
A: See response to Question 9 above for levels of security clearances. Note Evaluation
Criteria Tab 5 B does not include a minimum amount of examples of previous contracts where the firm was required to maintain security clearances.
60. Q: What information should be entered into the “Amount” column of Enclosure_3_-
_AMS_Form_043_Pricing_Sheet?
A: Apologies for the confusion the “Amount” column was inadvertently included and may be removed.
61. Q: Can BSA extend the proposal due date for 2 weeks? Question responses are relevant to the structure of the proposal and evaluation criteria and will require time after BSA responds to address.
A: See response to Question 46 above.
62. Q: Enclosure 1+ Draft BOA, Section I - The Contractor shall provide temporary support personnel to perform services for Brookhaven Science Associates (BSA) on an as-needed basis. Temporary support may be requested in the following categories: (a) administrative, (b) engineering, (c) scientific support, (d) technical support, (e) information technology, and (f) scientists.
Please detail the historical distribution of personnel across labor categories.
A: Typically there is a higher distribution on administrative, engineering, and technical support. But offerors need to be able to provide and have experience supporting all categories listed.
63. Q: Enclosure 1+ Draft BOA, Section I -The Contractor shall provide temporary support personnel to perform services for Brookhaven Science Associates (BSA) on an as-needed basis. Temporary support may be requested in the following categories: (a) administrative, (b) engineering, (c) scientific support, (d) technical support, (e) information technology, and (f) scientists.
Can you provide the estimated budget allocation for temp staffing and payrolling?
A: Please see question 49 above.
64. Q: Enclosure 2+ Evaluation Criteria- The Offeror shall describe and provide details on the firm’s ability and experience processing payroll for those working outside the U.S.
The Offeror shall provide examples of previous contracts where the firm provided this service.
What international locations are supported by payrolling services?
A: Work under this requirement will be fulfilled on an as needed basis. We do not have a list of locations we can provide at this time. It will be any location needed at the time the need is known. This could be anywhere in the world.
65. Q: Tab 4 (b) and (c): Will the subcontractor or partner's experience (as a team) be accepted?
A: See Question 53 above
66. Q: Tab 4 (c): Will government references be accepted as well as commercial accounts?
A: Yes, offeror may provide both.
67. Q: Tab 5 (a): There are no performance locations outside of the U.S.. Will this be added to the contract later? If this is not applicable, would you consider removing this section?
A: Because this is a requirement on an as needed basis we do not have a list to provide at this time for locations outside of the U.S. We will not consider removing this section as this is a requirement and Offerors must be cable of meeting this requirement should this need come up in the future.
68. Q: Tab 5 (b): Would the government please specify the nature and type of security clearances required, if any?
A: See question 37 above.
69. Q: What is “Foreign Payroll Processing” referring to? Work outside of the U.S.? Or hiring foreign nationals?
A: This is referring to being able to pay someone outside of the US as your employee.
70. Q: Would evidence of Foreign Payroll Competency be acceptable if it is outside the scope of a contract?
A: Evaluation Criteria Tab 5 A asks that offerors describe and provide details on the firm’s ability and experience processing payroll for those working outside for the U.S.
The offeror shall also provide examples of previous contracts where the firm provided this service, if they have said examples. Please provide what is being asked for in the evaluation criteria.
71. Q: Will Brookhaven Science Associates, LLC, provide a list of pay rates for each position to apply our multiplier to get a final amount?
A: Pay rates for each position is determined at time of hire. BSA cannot provide a list of pay rates for each position at this time. Offerors may use the Wage Determination for a general idea of various labor rates.
72. Q: If not, will the contractor be expected to provide market pay rates for the awarded labor categories at the time of bid or at the time of award?
A: As mentioned in Q 71 above, pay rates for each position will be determined at time of hire.
73. Q: How is the amount on the pricing sheet (enclosure 3) expected to be calculated without a provided number to apply the multiplier?
A: See answer to Q 60 above. Enclosure 3 was updated and posted to SAM.gov.
74. Q: Draft BOA Section III Paragraph B – Multipliers and Statement of Work Sections III and IV. Can you provide historical information on how many contract workers BSA finds
vs. those found by the Contractor? From the SOW it looks like within the U.S, the Contractor is responsible for finding temporary employees and BSA will provide/suggest temp employees working outside the U.S. Is that correct?
A: BSA can provide/suggest individuals for assignment through the agency both within and outside the US. BSA is not requesting agencies to find employees for assignments who are outside of the US.
75. Q: Draft BOA Section III Paragraph B - Multipliers Foreign Payroll Processing. Would this payroll processing involve U.S Nationals, Foreign Nationals, or both?
A: See response to Q 69 above.
76. Q: Draft BOA Section III Paragraph - B Multipliers Foreign Payroll Processing . Can you provide a list of countries that would/could need Foreign Payroll Processing?
A: See question 64 above.
77. Q: Statement of Work Section 1 Holidays - Can you provide a list of holidays observed by BSA?
A: BNL holidays change year to year. Please refer to BNL website for current holiday schedule at the following linkhttps://www.bnl.gov/bnlweb/admin/holidays.php Please keep in mind this holiday schedule may change and it is recommended you review the website for current schedule.
78. Q: Statement of Work Section VI Government Property states Government property not authorized. Will BSA be providing office space, utilities, phones for official use, information systems, etc. to be used by temporary employees to support the contract?
A: BSA will provide office space, utilities, phones for official use, information systems, etc as required to complete their job as a temporary support personnel if they are working onsite. Any BSA provided equipment is not authorized to be taken offsite.
79. Q: How many awards are anticipated?
A: See Question 48 above.
80. Q: Could you provide 24–36 months of historical demand (requisitions, average assignment length, weekly headcount) by category and a forecast for the next 12 months?
A: See response to Q 31 and 36 above.
81. Q: Sections 6.1 and 6.3 of the RFP outline a Best-Value trade-off process and evaluation of “Organizational Experience/Past Performance,” but do not specify whether subcontractor experience will be evaluated on equal footing with that of the prime Offeror. Please confirm whether subcontractor past performance may be considered as part of the Offeror’s overall experience and evaluation scoring.
A: Yes, provided subcontractor experience will be evaluated. Note, only up to 50% of the work may be subcontracted out.
82. Q: Enclosure 2, Tab 2 directs Offerors to provide a paragraph-by-paragraph Compliance Matrix for each SOW section. We understand this must clearly demonstrate acceptance and detailed explanation. However, several SOW paragraphs overlap across functional areas. May we consolidate overlapping requirements under a single response in the Compliance Matrix where the same process or control satisfies multiple subsections, provided cross-references are clearly cited?
A: Please provide a response even if it overlaps with another section of the SOW. If your answer is the same as any given answer and you want to reference that answer an acceptable response would be “Please see response provided at__________”.
https://www.bnl.gov/bnlweb/admin/holidays.php
83. Q: Draft BOA Section V lists separate “Technical” and “Contractual” Representatives for both BSA and the Contractor. Please confirm whether BSA prefers a single primary point of contact for all contractual and technical matters or whether Offerors should designate separate individuals consistent with the BOA format.
A: We prefer the correct POC for each category whether that is one person or two different people. If one person can be reached for contractual questions, issues, modifications, etc. and the same person can answer any technical questions, please provide that person’s name, email and phone number. If there is only one designated person with the authority to handle contractual issues and one designated person with the authority to handle technical issues, please provide the name, email, and phone number of those two separate people.
84. Q: The Statement of Work (Attachment A, § III) references email or SharePoint for staffing requests and candidate submissions. After award, should all deliverables and compliance artifacts (e.g., invoices, reports, timesheets, or audit responses) be transmitted via the same SharePoint/email channels described in the SOW, or will BSA designate a separate portal or system for contract administration?
A: BSA is currently utilizing email and working on a sharepoint site to which awardees would be provided access to – agency will need to be able to access sharepoint sites.
85. Q: Section 2.0 of the RFP states that multiple awards are contemplated for this requirement. Please confirm whether awards may be made by specific labor category or service group (e.g., administrative, IT, engineering) or if each selected Offeror will hold a BOA encompassing all categories identified in Attachment A.
A: Each Offeror must be able to provide all labor categories / services as described in the
SOW.
86. Q: How many vendors are you looking to bring in?
