About this file
This is a Wage and Hour Division Conformance Decision from the U.S. Department of Labor issued to the Michigan Department of Environmental, Great Lakes, and Energy regarding wage determinations for an orphan well plugging project in Gratiot County, Michigan. The decision, dated March 23, 2026, addresses proposed classifications and wage rates for WHD Number FY26-40474 (2 of 2) covering Projects 2518104, 2518105, 235763, and 235771. The Department of Labor approved five requested classifications—Electrician, Roustabout Laborer, Toolpusher, Power Swivel Operator, and Cementer—at their proposed rates with specified fringe benefits. For nine additional classifications (Rig Operator, Derrick Hand, Floor Hand, Water Truck Operator, Mud Truck Operator, Pump Truck Operator, Bulk Truck Operator, Wireline Operator, and Wireline Rigger), the Department conformed the wage rate to $39.57 per hour plus $25.25 in fringe benefits, determining these did not bear reasonable relationship to existing wage determinations. Two operator classifications—Bulldozer and Backhoe—were rejected as duplicative of existing classifications and recharacterized as Bulldozer and Backhoe at $41.28 per hour plus $25.25 in fringe benefits. The Welder classification requires additional clarification regarding whether welding constitutes 100 percent of assigned work.
All conformed wage and fringe benefit rates must be paid retroactively from the first day work is performed on the contract. The conformance decision was made consistent with All Agency Memorandum 213 and applicable Davis-Bacon regulations under 29 CFR 5.5(a)(1)(iii). Contractors and the state must ensure compliance with these wage determinations across all worker classifications. Appeals of the conformance decision must be submitted within thirty days of the letter date to dbabcwdappeal@dol.gov. Inquiries regarding implementation or compliance should be directed to Tina Williams at the Department of Labor's Wage and Hour Division.

Dear Lisa VanOstran:
This is in response to your request proposing the addition of classifications and wage rates to the above wage decision in accordance with 29 CFR 5.5(a)(1)(iii).
Proposed Classification Proposed Hourly Rate Fringe Benefits Rig Operator $23.00 $30.00 Derrick Hand $22.00 $30.00 Floor Hand $20.00 $30.00 Roustabout Laborer $20.00 $30.00 Toolpusher $31.00 $69.00 Power Swivel Operator $23.00 $69.00 Bulldozer Operator $36.00 $25.00 Backhoe Operator $36.00 $25.00 Water Truck Operator $26.00 $12.00 Mud Truck Operator $26.00 $12.00 Cementer $39.00 $46.00 Pump Truck Operator $24.00 $30.00 Bulk Truck Operator $24.00 $30.00 Wireline Operator $29.00 $30.00 Wireline Rigger $23.00 $30.00 Welder $41.00 $40.00 Electrician $35.00 $23.00 mailto:VanOstranL@michigan.gov mailto:KidderK1@michigan.gov
The requested Electrician, Roustabout Laborer, Tool pusher, Power Swivel Operator and Cementer, classifications are approved and conformed to the wage determination number MI20260040 MOD 0. The conformed wage rates shall be paid to all workers performing work in the classifications under this contract from the first day on which work is performed.
The proposed conformed wage rate for the requested Rig Operator, Derrick hand, Floor hand, Water Truck Operator, Mud Truck Operator, Pump Truck Operator, Bulk Truck Operator, Wireline Operator and Wireline Rigger are not approved because the proposed classifications do not bear a reasonable relationship to wage rates contained in wage determination number MI20260040 Mod 0. See 29 C.F.R. 5.5(a)(1)(iii)(A)(3). Instead, the requested Rig Operator, Derrick hand, Floor hand, Water Truck Operator, Mud Truck Operator, Pump Truck Operator, Bulk Truck Operator, Wireline Operator and Wireline Rigger classifications and wage rates are approved at the conformed rate of $39.57 per hour and $25.25 in fringe benefits. This conformed wage and fringe benefit rate must be paid retroactively to the first day work is performed. See 29 C.F.R. 5.5(a)(1)(iii)(A)(3).
The request for Bulldozer Operator is not approved because the work to be performed by the classification is performed by a classification already included in the wage decision [see 29 C.F.R. Section 5.5(a)(1)(ii)(A)(1)]. The appropriate classification is Bulldozer at a rate of $41.28 per hour plus $25.25 in fringe benefits and shall be paid to all workers performing work in this classification under this contract from the first day on which work is performed.
The request for Backhoe Operator is not approved because the work to be performed by the classification is performed by a classification already included in the wage decision [see 29 C.F.R. Section 5.5(a)(1)(ii)(A)(1)]. The appropriate classification is Backhoe at a rate of $41.28 per hour plus $25.25 in fringe benefits and shall be paid to all workers performing work in this classification under this contract from the first day on which work is performed.
In order to efficiently process your request for the Welder. Please resubmit your request to DbaConformance@dol.gov and include the following information: (1) Is the Welder performing 100% welding, or if Welder is incidental, who would be performing the Welding?
Your request has been conformed consistent with All Agency Memorandum 213 (https://sam.gov/content/wage-determination/resources/all-agency-memos) which describes the conformance process in detail. For additional guidance, please follow the link WHD Davis- Bacon WD Conformance Request Guide, Sep. 2021.
