About this file

This is a U.S. Department of Labor Wage and Hour Division wage determination conformance letter dated March 23, 2026, addressing a request from the Michigan Department of Environmental, Great Lakes, and Energy regarding well plugging work in Montcalm County, Michigan. The letter responds to a proposal to add multiple job classifications and wage rates to wage decision MI20260040 MOD 0 for projects numbered 2518104, 2518105, 235763, and 235771. The Department of Labor approved four requested classifications—Roustabout Laborer, Toolpusher, Power Swivel Operator, and Cementer—at their proposed rates. However, nine classifications (Rig Operator, Derrick Hand, Floor Hand, Water Truck Operator, Mud Truck Operator, Pump Truck Operator, Bulk Truck Operator, Wireline Operator, and Wireline Rigger) were conformed to a single rate of $41.32 per hour plus $25.25 in fringe benefits because the proposed rates did not bear reasonable relationship to existing wage determination rates. Three equipment operator classifications (Bulldozer Operator, Backhoe Operator, and Electrician) were rejected as duplicative of existing classifications already in the wage decision, with appropriate alternative classifications and rates substituted. The Welder classification was requested to be resubmitted with clarification on whether welding comprises 100 percent of the work performed.

All conformed wage rates and fringe benefits must be paid retroactively to the first day work is performed under the contract in compliance with 29 CFR 5.5(a)(1)(iii). The approved classifications include: Roustabout Laborer at $20.00 per hour plus $30.00 fringe benefits; Toolpusher at $31.00 per hour plus $69.00 fringe benefits; Power Swivel Operator at $23.00 per hour plus $69.00 fringe benefits; and Cementer at $39.00 per hour plus $46.00 fringe benefits. The substitute classifications carry the following rates: Bulldozer at $44.00 per hour plus $25.25 fringe benefits; Backhoe at $44.00 per hour plus $25.25 fringe benefits; and Electrician at $36.52 per hour plus 41% plus $10.18 fringe benefits. Appeals of the conformance decision must be submitted within thirty days to dbabcwdappeal@dol.gov.

The requested Roustabout Laborer, Tool pusher, Power Swivel Operator and Cementer, classifications are approved and conformed to the wage determination number MI20260040 MOD 0. The proposed conformed wage rate for the requested Rig Operator, Derrick hand, Floor hand, Water Truck Operator, Mud Truck Operator, Pump Truck Operator, Bulk Truck Operator, Wireline Operator and Wireline Rigger are not approved because the proposed classifications do not bear a reasonable relationship to wage rates contained in wage determination number MI20260040 Mod 0. Instead, the requested Rig Operator, Derrick hand, Floor hand, Water Truck Operator, Mud Truck Operator, Pump Truck Operator, Bulk Truck Operator, Wireline Operator and Wireline Rigger classifications and wage rates are approved at the conformed rate of $41.32 per hour and $25.25 in fringe benefits. Section 5.5(a)(1)(ii)(A)(1)]. The appropriate classification is Bulldozer at a rate of $44.00 per hour plus $25.25 in fringe benefits and shall be paid to all workers performing work in this classification under this contract from the first day on which work is performed.

The request for Backhoe Operator is not approved because the work to be performed by the classification is performed by a classification already included in the wage decision [see 29 C.F.R. Section 5.5(a)(1)(ii)(A)(1)]. The appropriate classification is Backhoe at a rate of $44.00 per hour plus $25.25 in fringe benefits and shall be paid to all workers performing work in this classification under this contract from the first day on which work is performed.

The request for Electrician is not approved because the work to be performed by this classification is performed by a classification already included in the wage decision [see 29 C.F.R. Section 5.5(a)(1)(ii)(A)(1)]. The appropriate classification is Electrician at a rate of $36.52 per hour plus 41%+$10.18 in fringe benefits and shall be paid to all workers performing work in this classification under this contract from the first day on which work is performed.
