About this file
This is an AIA Standard Form Agreement (A132-2019) between the Washington County Transportation Authority (WCTA) dba Freedom Transit and an unidentified contractor for the construction of a fuel system installation at the new WCTA Operations Facility located at 375 Berry Road, Washington, PA 15301. The project, identified as Contract WCTA PA 2026-1.1GC, is a general construction contract with a substantial completion date of August 9, 2030. The contractor must achieve substantial completion within 366 calendar days from the notice to proceed date. A non-mandatory pre-bid conference is scheduled for September 8, 2026, at 2:00 PM EST at the project site in JMT's construction office. Bid submissions are due electronically via the PennBid program by 2:00 PM EST on September 25, 2026. The agreement identifies Johnson, Mirmiran & Thompson, Inc. (JMT) as the construction manager and KCI Technologies, Inc. as the architect. The project is governed by AIA Document A232-2019 General Conditions and incorporates federal prevailing wage rate requirements.
The contract sum is structured as a stipulated sum with a lump sum contingency allowance referenced in Section 012100. Liquidated damages are assessed at $1,500.00 per calendar day if the prime contractor fails to achieve substantial completion within the 366-calendar-day period from the notice to proceed date. Progress payments are calculated monthly based on the schedule of values, with retainage withheld at 10 percent initially and reducible to 5 percent once 50 percent of the contract sum is achieved and deemed acceptable by the construction manager. The construction manager reserves the right to withhold retainage release if the contractor has pending litigation against the owner or has failed to execute work in accordance with the contract and applicable Pennsylvania laws and regulations. The agreement specifies payment within 60 days of application receipt and includes provisions for federal Disadvantaged Business Enterprise (DBE) requirements, with certified DBEs to be fully utilized with adequate documentation to satisfy federal and PennDOT requirements. Final payment is due within 30 days of issuance of the final certificate for payment.

§ 5.1.5.5 In taking action on the Contractor’s Applications for Payment, the Construction Manager and Architect shall be entitled to rely on the accuracy and completeness of the information furnished by the Contractor, and such action shall not be deemed to be a representation that (1) the Construction Manager and Architect have made a detailed examination, audit or arithmetic verification of the documentation submitted in accordance with Article 5 or other supporting data; (2) that the Construction Manager and Architect have made exhaustive or continuous on-site inspections; or (3) that the Construction Manager and Architect have made examinations to ascertain how or for what purposes the Contractor has used amounts previously paid on account of the Contract. § 5.1.6.2 Each Application for Payment shall be based on the most recent schedule of values submitted by the Contractor in accordance with the Contract Documents. The schedule of values shall allocate the entire Guaranteed Maximum Price among: (1) the various portions of the Work; (2) any contingency for costs that are included in the Guaranteed Maximum Price but not otherwise allocated to another line item or included in a Change Order; and (3) the Contractor’s Fee.
