About this file
This document is a Question and Answer record from a prior bid solicitation issued by the County of Sussex, New Jersey, for Licensed Site Remediation Professional (LSRP) services. The RFP seeks a qualified LSRP to review existing site information and develop Environmental Improvement Programs (EIPs) for five contaminated sites: Frankford Road Garage, Hopatcong Road Garage, Lafayette Complex, Andover Maintenance Camp, and Layton Road Garage. Respondents are required to submit site-specific hypothetical EIPs, schedules, and cost summaries as part of their proposals. The County clarifies that these submittals are conceptual, planning-level estimates intended solely for evaluation and comparison purposes and are non-binding; they do not represent final remediation designs or guaranteed project costs, and respondents are not required to perform final EIP development work or provide bid-level remediation pricing prior to contract award.
The document addresses critical clarifications regarding regulatory oversight of the five sites under the Site Remediation Reform Act (SRRA). While Frankford Road Garage and Hopatcong Road Garage are identified as under New Jersey Department of Environmental Protection (NJDEP) Direct Oversight, the County confirms that the remaining three sites—Lafayette Complex, Andover Maintenance Camp, and Layton Road Garage—have not been formally subjected to Direct Oversight despite potentially meeting statutory criteria. For proposal purposes, respondents must assume continuation of LSRP-led remediation for all sites. Compensation under any resulting contract will be based on the submitted hourly rate schedule under a time-and-materials arrangement, with the County retaining flexibility regarding future regulatory oversight changes at individual sites.

Q1: The RFP is issued for the award of a professional services contract for Licensed Site Remediation Professional (LSRP) services, including the review of existing site information and the development of Environmental Improvement Programs (EIPs).
However, the RFP also requires Respondents to submit site specific hypothetical EIPs, schedules, and cost summaries as part of the proposal. Please confirm that these submittals are conceptual, planning level estimates provided for evaluation and comparison purposes only, are non binding, and form the basis for contract award, and that Respondents are not being asked to perform or complete the underlying EIP development work or provide bid level remediation pricing prior to contract award.
A1: Yes. The required hypothetical EIPs, schedules, and cost summaries are for planning purposes only and are used to evaluate and compare each Respondent’s technical approach and project strategy. These submissions are non-binding and do not represent final remediation designs or guaranteed project costs. Compensation under any resulting contract will be based on the submitted hourly rate schedule and approved time-and-materials work.
Q2: The RFP identifies two sites (Frankford Road Garage and Hopatcong Road Garage) as being under NJDEP Direct Oversight, while the three remaining sites are not identified as such. Please clarify if the County has formally evaluated whether the Lafayette Complex, Andover Maintenance Camp, and Layton Road Garage should be subject to NJDEP Direct Oversight, given that certain mandatory timeframes under the Site Remediation Reform Act (SRRA) appear to have been missed at those sites, and whether Respondents should assume continuation under LSRP led remediation or potential future Direct Oversight when developing hypothetical scopes, schedules, and cost summaries for proposal purposes A2: While certain sites may technically meet the SRRA's statutory criteria for Direct Oversight, NJDEP has not formally imposed Direct Oversight beyond the limited matters previously identified. The County continues active remediation under LSRP-led oversight. For proposal purposes, Respondents shall assume continuation of LSRP-led remediation when developing hypothetical scopes, schedules, and cost summaries.
