About this file
This is a notification document issued by Pflugerville Independent School District (PfISD) in Texas regarding compliance requirements under Texas Government Code Chapter 2252.908, commonly known as HB 1295, which mandates disclosure of interested parties for certain contracts. The notification applies to the Armored Vehicle Courier Services procurement, which PfISD intends to implement district-wide. Under HB 1295, all non-exempted business entities seeking contracts with PfISD that either require Board of Trustees action or approval, or have a value of at least $1 million, must submit a completed Certificate of Interested Parties form (Form 1295) with their proposal. An "interested party" includes any person with a controlling interest in the business entity or anyone actively participating in facilitating or negotiating the contract terms.
The document specifies that authorized representatives of bidding firms must complete the online Form 1295, print a copy with the certificate of filing and unique certification number, and submit it with their bid proposal. The District will then notify the Texas Ethics Commission of receipt of the filed form no later than 30 days after contract execution. Certain business entities are exempted from this requirement, including publicly traded companies and their subsidiaries, electric utilities, gas utilities, sponsored research contracts of higher education institutions, and interagency contracts of state agencies. Non-exempted firms must submit Form 1295 even if no interested parties exist. Additional information, frequently asked questions, and the online filing portal can be accessed through the Texas Ethics Commission website at https://www.ethics.state.tx.us/whatsnew/elf_info_form1295.htm.
