Appendix 1.6.11
1.6.11. Environmental Requirements
1.6.11.1 Environmental Officer: The Contractor will assign an Environmental Officer (EO) as the focal point for all environmental issues. This person shall ensure operational compliance with environmental requirements during the duty day and coordinate all environmental matters with the ATEC Environmental Officers. The EO shall serve as the local point of contact in preparing for internal and external environmental inspections, participate in EO quarterly meetings provided by the Government and complete initial and annual refresher environmental officer’s training conducted by the Government. The Contractor shall submit an appointment letter identifying the name, title, and contact information. The On-site manager can be the environmental POC for the project or other designee by the Contractor as necessary depending on the depth and breadth of the environmental requirements.
This contract does not perform or need to manage environmental requirements such as these listed as a large percentage of the contract. It is very small effort on the Contractors’ part. However, the individuals that are hired to assist Test Officers under this contract may be performing some of these functions such as hazardous materials management, universal waste management, satellite accumulation point management, environmental coordination and petroleum, oil and lubricants. This information is in the contract to assist those individuals that will be hired.
1.6.11.2. Hazardous Materials: The Contractor is required to have all purchased hazardous material coordinated and tracked with:
Supply Service Activity - HazMart Building 1870 Aberdeen Rd White Sands Missile Range, NM 88002
The tracking system used for the Hazardous Materials Management Program is called Environmental Safety and Occupational Health Management Information System (EESOH-MIS). Once the material has been processed through the Supply Service Activity (SSA) and the HAZMART, the Contractor can pick up the material. Excess material that can still be used but is not needed anymore shall be taken back to the HAZMART for redistribution. Additionally, the Contractor may use the HAZMART to receive free issue items that can be used for work to fulfill the contract needs. An SOP for Hazardous Material Supply Operations will be provided upon award.
The Contractor shall ensure that all hazardous material is recorded on an inventory list that shall be provided to the Government. The hazardous material inventory shall be updated at least annually or when changes occur and dated to reflect the review date.
The most current version of the Safety Data Sheet (SDS) shall be available to all personnel on all shifts, at all times, either electronically or by hard copy. SDSs shall also be available for all inspectors. It is the responsibility of the Contractor to obtain the SDS for each hazardous material in the inventory. The SDSs shall be provided to the Safety Office and the HAZMART as needed. The Contractor shall provide training to the employees who may work with or be exposed to hazardous materials such as HAZCOM (Hazardous Communications) and Hazardous Waste Emergency Operations (HAZWOPER) if applicable. As a reminder, something as simple as hand sanitizer is tracked through this process.
1.6.11.3. Petroleum, Oils, & Lubricants (POL): New and used POL’s shall be managed according to federal, Army and State regulations. These are regulated non-hazardous materials and wastes and shall be managed accordingly. POL’s shall be treated as recyclables and transported to various locations on WSMR to be managed in accordance with regulation. Each of these items have their own designated areas for turn-in. The Contractor shall complete all paperwork required for turn-in and provide SDS or waste profile information as needed. Any used oil generated by the Contractor is collected, labeled properly with documentation and taken to a central location. Any equipment or appurtenance that come into contact with used oil will be labelled “Used Oil” per Federal and State Regulations.
1.6.11.4. Environmental Coordination: The Contractor shall stay on designated roadways when out on the range. Off road travel is not allowed. Trash shall not be thrown out on the range and will be brought back to main post and placed in trash containers. The Contractor shall report all accidents whether by foot or vehicle of any wildlife injured or killed to include migratory birds, hawks, eagles and Oryx.
1.6.11.5. Spills: The Contractor shall report all hazardous materials, petroleum, oils and lubricants (POL), non-hazardous waste and hazardous waste spills to the contracting officer or his/her representative within one hour. All equipment will have drip pans, absorbent materials and spill equipment will be placed throughout the shop area. A large spill that would entail heavy equipment, shall be reported to the state, sampling and removal of contaminated media shall be paid for by the Contractor.
1.6.11.6. Environmental Constraints: There are environmental constraints while working on the range. The Contractor will receive environmental briefs by the Government upon award to avoid certain areas on the range or specific reporting or notices.
1.6.11.7 Universal Wastes: Hazardous and Universal wastes are defined in the Resource Conservation and Recovery Act (RCRA), Code of Federal Regulations (CFR)
– Title 40, Protection of the Environment. Universal Wastes are items such as fluorescent tubes, batteries, mercury, used oil, aerosol cans and electronics. This contract may come into contact with these types of regulated wastes. If so, annual training will be provided by the Government. An SOP will be provided upon award in order to manage these wastes in accordance with Federal and State regulations and local permits.
1.6.11.8 Industrial Wastewater: All liquids generated from an industrial process that are no longer needed shall be containerized and collected in a size commensurate with the amount of liquid being collected, i.e., 55 gallon drums, 30 gallon drum, 5 gallon etc.
The liquid shall also be compatible with the container it is being collected in. Examples are rinse water, boiler water, or equipment flushes. A policy will be provided to the Contractor upon award. No wastewaters will be placed on the ground.
1.6.11.9 Refrigerants: All refrigerant work shall abide by all federal, state and Army regulations.
1.6.11.10. Hazardous Waste Satellite Accumulation Points (SAPs): While performing work on WSMR, hazardous waste may be generated from your processes.
SAPs shall be established in order to handle regulated materials and waste properly.
The Contractor shall inspect, maintain, operate and provide necessary consumables / materials to manage hazardous waste SAPs. The Contractor shall operate the SAPs in accordance with AR 200-1, WSMR Hazardous Waste SAP Management Guide (provided upon award), 40 CFR 260-265 and the WSMR Hazardous Waste permit (https://www.env.nm.gov/hazardous-waste/wsmr/#FinalPermit). The Government will provide annual training in the procedures to follow for SAP management. The Contractor will be subject to “no notice” inspections by internal and external inspectors.
Non-compliance on the part of the Contractor, which creates a Notice of Violation and a monetary fine will be paid for by the Contractor.
