About this file
This is a Use and Non-Disclosure Agreement (NDA) template for solicitation N6817126QN020 related to USNS ARCTIC (T-AOE 8) FY26 Voyage Repair. The agreement governs the handling of restricted technical data provided by the Government to prospective contractors and their subcontractors during the proposal development phase. Recipients are authorized to use the data solely for proposal support purposes and must implement physical security measures and operating procedures to protect the information from unauthorized disclosure. The agreement requires that data marked with limited rights legends receive the same degree of security afforded by the Department of Defense and prohibits release to any person, nation, or outside entity without express written permission from the Contracting Officer, except to subcontractors and suppliers who require the data to submit offers.
The agreement imposes significant compliance obligations on recipients, including an indemnification clause holding the Government harmless from claims arising from misuse or unauthorized disclosure of the data, and subjects non-U.S. companies to U.S. laws, regulations, and jurisdiction. Recipients who are unsuccessful offerors must destroy all copies of the documentation and provide a destruction statement to the Contracting Officer within 30 days of non-selection notification, ensuring all persons to whom they released the data do likewise. Successful offerors may be required to execute a separate NDA under DFARS 252.227-7025. The agreement becomes effective upon execution and terminates upon notice of non-selection, though its obligations survive termination. Enclosure 1 referencing specific FDRMC restricted documents is included but not populated in this template version.
