About this file

This is an accessibility compliance attachment for a contract between the University of Texas at Austin and a contractor for a turnkey ultrapure DI water system. The attachment specifies that the contractor must represent and warrant that all electronic and information resources (EIRs) provided to the University, including associated information, documentation, and support materials, comply with accessibility requirements outlined in 1 TAC Chapter 213 and 1 TAC 206.70, which reference Subchapter M of Chapter 2054 of the Texas Government Code. The contractor is responsible for ensuring full compliance with these state accessibility standards for all deliverables under the agreement.

Should the contractor become aware that any portion of the EIRs fails to meet the accessibility warranty, the contractor must remediate the deficiencies at no cost to the University or replace the non-compliant resources with accessible alternatives. If the contractor is unable or fails to satisfy these requirements, the University may terminate the agreement and require a full refund of all payments made within thirty days of termination. The contractor must also provide complete cooperation and assistance for accessibility testing, planning, and execution activities conducted by the University or its designated third-party testing resources, as required by 1 TAC 213.38(g).
