About this file

The document is a HUB (Historically Underutilized Business) Subcontracting Plan (HSP) Quick Checklist from the State of Texas, designed to guide contractors in completing their subcontracting requirements for state contracts. The checklist provides a comprehensive workflow for contractors to follow based on their subcontracting intentions, including options for awarding work to only Texas certified HUB vendors, subcontracting to both HUB and Non-HUB vendors, or completing the entire contract with the contractor's own resources.

The document outlines four distinct scenarios for completing the HSP, each with specific section requirements. The primary focus is on ensuring that contractors make a good faith effort to include Texas certified HUB vendors in their contract work, with detailed instructions for documenting subcontracting plans. Key components include listing subcontracting portions, indicating percentages of work to be awarded to HUB and Non-HUB vendors, and completing either Attachment A or Attachment B depending on whether the contractor meets the agency's HUB goal. The checklist also defines a "Continuous Contract" and provides guidance on how to classify contracts and subcontracting relationships.

*Continuous Contract: Any existing written agreement (including any renewals that are exercised) between a prime contractor and a HUB vendor, where the HUB vendor provides the prime contractor with goods or service, to include under the same contract for a specified period of time. The frequency the HUB vendor is utilized or paid during the term of the contract is not relevant to whether the contract is considered continuous. Two or more contracts that run concurrently or overlap one another for different periods of time are considered by CPA to be individual contracts rather than renewals or extensions to the original contract. In such situations the prime contractor and HUB vendor are entering (have entered) into “new” contracts.
