About this file
This document is Appendix Five of a Request for Proposal (RFP) focused on Access by Individuals with Disabilities, specifically addressing electronic and information resources (EIRs) provided to a University under an agreement. The appendix requires the Contractor to represent and warrant that all EIRs, including associated information, documentation, and support, comply with accessibility requirements outlined in Texas Administrative Code (1 TAC Chapter 213 and 1 TAC §206.70).
The key accessibility provisions mandate that if the Contractor becomes aware that any EIRs do not meet the specified accessibility standards, they must either remediate the resources at no cost to the University or replace them with compliant versions. If the Contractor fails to do so, the University may terminate the agreement and receive a full refund of amounts paid within 30 days. The Contractor is also obligated to provide assistance and cooperation for accessibility testing and documentation as required by the specified Texas Administrative Code section.
