About this file

The document is a Request for Proposals (RFP) Addendum #2 issued by the Port Authority of New York and New Jersey for expert professional land surveying services to be performed on a task order basis over a four-year term. The RFP (number 6000002382) seeks proposals for professional land surveying services across multiple categories, including hydrographic, photogrammetric, and topographic/boundary services. Firms may submit proposals for one or all service categories, with the proposal submission deadline set for 2:00 P.M. on September 27, 2024. The contract will allow multiple agreements to be awarded through a call-in program, with no specific limitations on the number of agreements.

The addendum includes clarifications on multiple aspects of the RFP, such as minority and women-owned business enterprise (M/WBE) requirements, subconsultant participation, and specific technical requirements. Key points include a 10% WBE goal, 20% MBE requirement, and specific professional credentials needed, such as a Professional Engineer (PE) for Subsurface Utility Engineering (SUE) tasks. Notably, only the Prime firm's qualifications, projects, and resumes will be considered in the evaluation. Additional requirements include OSHA and NYC Sight Safety Training certifications for field personnel, and a preference for certified professionals in hydrographic and photogrammetric work at the task order level. The Port Authority will require Hull & Machinery Coverage for watercraft or equipment used in the work, with specific insurance provisions detailed in the addendum.

PROFESSIONAL PERFORMANCE OF EXPERT PROFESSIONAL LAND

SURVEYING SERVICES AS REQUESTED ON A “TASK ORDER” BASIS

FOR A) FOUR-YEAR TERM (RFP# 6000002382 – ADDENDUM #2)

Dear Sir or Madam:

The Port Authority of New York and New Jersey (the “Port Authority” or “Authority”) hereby amends the subject Request for Proposals (RFP) as follows:

In Section 26 of the Agreement, after the Professional Liability Insurance section, skip a line and insert the following:

“Hull & Machinery Coverage (if appropriate) - property Insurance for the watercraft or equipment used in the work for the total value of the watercraft or equipment. In addition, this policy will provide coverage for any damage sustained by colliding with another vessel of $5 million per occurrence for bodily injury and property damage liability.”

The following are questions from Request for Proposals (RFP) recipients. The questions and the corresponding Port Authority of New York and New Jersey (the Authority) answers are provided for your information and use, as appropriate.

Question #1: If a company currently holds an active M/WBE agreement as a Prime, can they also be on a team for these agreements?

Answer #1: Yes, however, the firm will only be counted once unless they are certified as an MBE and SDVOB.

Question #2: Can a Professional Land Surveyor be substituted for a Professional Engineer for the SUE portion?

Answer #2: No.

Question #3: How many agreements of this type does the Port Authority intend to issue?

Answer #3: There are no limitations with respect to the number of agreements that will be awarded for the call-in program.

Question #4: What is the contract value of the agreements?

Answer #4: This information is not being made available at this time.

Question #5: Is there a place in the proposal documents where we can address a project approach?

Answer #5: This is not required, as it is not a factor that is considered in the evaluation.

Question #6: Can a WBE Prime firm, self-fulfill the WBE 10% requirement?

Answer #6: If a firm is WBE certified and will self-perform, the 10% WBE goal will be satisfied, but the MBE and SDVOB good faith goals will still need to be met. When self-performing, please remember to add your firm’s name to the participation plan document on the first line.

Question #7: Are the MBE requirements broken down by type of MBE, or 20% non-specific?

Answer #7: No.

Question #8: Are the staffing and firm qualifications required to be submitting in the forms provided in the RFP or can we provide in our standard formats? Are these forms available separately for download?

Answer #8: The Proposer should use the space allocated in the Proposal Template.

Question #9: Should we include projects and resumes from our subconsultant(s) within Sections E and F or should they only contain content from the Prime Proposer?

Answer #9: No. Only the Prime Proposer’s projects and resumes will be considered in the evaluation.

Question #10: Can subconsultants submit separate multipliers, or do they have to use the Prime

Proposer’s multiplier?

Answer #10: They may, but only the Prime Proposer’s multiplier(s) will be used if they are selected for an Agreement.

Question #11: Can an M/WBE firm be on multiple teams?

Answer #11: Yes, however they will not receive double credit, unless they are an MBE and an

SDVOB.

Question #12: Can a firm propose as a Prime as well as a subconsultant on a team?

Answer #12: Yes. A firm may submit as both a Prime and as a subconsultant (for another Prime proposer).

Question #13: Do MBE/WBE firms have to meet the same requirements as the Prime firm for the

Professional Engineer status on SUE?

Answer #13: Only resumes of Prime firm will be considered in the evaluation.

Question #14: Could you define what percentage of the task orders may be hydrographic-related?

Answer #14: The Authority p performs a hydrographic survey of the New Jersey Marine

Terminal, Port Jersey, Howland Hook (NY) and Brooklyn Marine Terminal (NY) two times a year as part of the on-going dredge program. We have had no more than three to four other hydrographic projects in a year and sometimes no other hydrographic work for isolated areas at other facilities.

Question #15: Regarding the hydrographic survey, do you require a certified hydrographer?

Answer #15: A certified hydrographer is preferred at a task order level.

Question #16: What exactly will be the PE's role regarding the SUE task? Could we have an in-house PE with a utility background oversee and review the work being performed by a SUE subconsultant?

Answer #16: The PE would be needed if drawings are to be signed for as built or design conditions. The Prime must have a PE who is in responsible charge of Subsurface Utility Engineering activities and decisions of the firm.

Question #17: Are resumes and projects only required from the Prime firm, or should projects/resumes be submitted for our subconsultants as well?

Answer #17: Only resumes of the Prime firm will be considered in the evaluation.

Question #18: The RFP requires that the Prime firm has the PE on staff. Can a subconsultant cover the PE requirement?

Answer #18: No.

Question #19: Under the SUE agreement, who would be responsible for picking up the utility markings? The SUE provider or someone with a survey agreement?

Answer #19: The survey portion of a mark out would be field measured and mapped by an in-house survey crew or another consultant. This work would be managed and contracted through the Central Survey Group and not be needed from the SUE firm.

The SUE firm would only be responsible for the mark out and would have a final map review.

Question #20: Per Section IV of the RFP, services are categorized as per below. If we pursue Option A, do we have to be able to provide hydrographic services? Or can we just choose to pursue photogrammetric and topographic/boundary services?

Answer #20: Firms may submit a Proposal for one category, or all of them.

Question #21: Regarding Attachment E, is there a limit as to how many projects we can include?

Answer #21: No.

Question #22: Per Section IV of the RFP, we have to provide a current copy of our Certificate of Authorization and any PE/PLS licenses. Do we have to include copies of OSHA certifications for field staff or will the PE/PLS licenses suffice?

Answer #22: OSHA and NYC Sight Safety Training certifications will be required for personnel on site at Authority facilities at a task order level.

Question #23: Can a subconsultant that is a certified WBE firm by New York State and New York City Small Business Services fulfill the WBE requirements? If not, can we fulfill our WBE requirements with a firm that will start the process of getting certified by the Port Authority?

Answer #23: A firm is accepted in good faith for starting the WBE certification process.

Question #24: Will there be a shortlist process with presentations?

Answer #24: No.

Question #25: When completing the proposal template, are we allowed to insert images?

Answer #25: Yes.

Question #26: Will a certified photogrammetrist also be required for the photogrammetric work under this contract?

Answer #26: A certified photogrammetrist will be required at a task order level.

Question #27: Are the insurance limits to be provided by the Prime firm only or are they for the subconsultants as well?

Answer #27: Our insurance requirements are meant to apply to the Prime and subconsultants alike, unless noted otherwise.

The date for receipt of proposals for the subject RFP remains 2:00 P.M. on September 27, 2024.
