About this file

This is a New Mexico Resident Preference Information document applicable to the Bus Repairs and Services term contract opportunity for district fleet maintenance in New Mexico. The document outlines the requirements and procedures for bidders and offerors to claim resident preference status under New Mexico Statutes 13-1-21 and 13-1-22. Bidders seeking preference consideration must submit a valid Resident Preference Certificate issued by the New Mexico Taxation and Revenue Department with their bid or proposal; certificates issued by the State Purchasing Division are not valid. Resident preference categories include Resident Business, Resident Contractor, or Resident Veteran designations. The Resident Veterans Preference Affidavit is required only for bidders holding a current Resident Veterans Preference Certificate from the Taxation and Revenue Department. Preferences are non-cumulative, meaning bidders are entitled to only one preference classification.

For joint bids or proposals involving both resident and nonresident businesses, the resident business preference is reduced proportionally based on the percentage of contract work, measured by dollar amount, to be performed by the nonresident business partner. Bidders submitting joint proposals must complete a detailed breakdown identifying each firm name, location, description of work to be performed, and the percentage of total contract value associated with each entity. Failure to include a valid Resident Preference Certificate with the bid or proposal response will result in no preference being applied. Additional information and applications for resident preferences are available through the New Mexico Taxation and Revenue Department website at www.tax.newmexico.gov.
