About this file

This is an Affidavit of Eligibility form issued by the City of Midland, Texas, for consideration of local bidders in municipal procurement. The form is designed to evaluate bidders whose principal place of business is located within Midland city limits for contracts valued between $50,000 and $100,000 for services and up to $500,000 for commodities. Bidders must complete and submit the affidavit to the Purchasing Manager, Erika Martinez, at the City of Midland's offices. The form requires bidders to confirm their local business address, verify it as their principal place of business, and provide information regarding employment of Midland residents, business establishment date, reseller permit details if applicable, multi-office locations in Texas, and local tax payment history.

The affidavit operates under Texas Local Government Code 271.9051, which permits the City Council to award contracts to local bidders whose bids fall within five percent of the lowest bid received, provided the City determines the local bidder offers the best combination of price and economic development opportunities including local employment and increased tax revenue. Bidders must certify under penalty of perjury that all submitted information is accurate, with false submissions resulting in a one-year prohibition from bidding on City contracts. Incomplete affidavits may be rejected, and the form requires authorized signature, date, and printed name and title of the signatory.
